All Conditional Use and Special Use Applications are assumed to be complete
when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

1. Please add case number CU09-46 to the signature block (provided
below) to all sheets. Each sheet needs to be sealed by a registered
surveyor, architect or engineer. Please add a graphic and numeric scale to
each sheet.
2. Please add the following note to the site plan stating the purpose of the
conditional use request:
Conditional use request CU09-46 is a request to amend
the previously approved site plan of CU08-09 (Ord. 08-20)
to allow the development of a yogurt restaurant with
outdoor dining in the Central Business District.
3. Please include a dimensioned floor plan/floor plan, label the uses, i.e.
dining, storage, kitchen, restroom, main (rear) entry, including outdoor
dining area.
4. On the floor plan sheet please show the following: the proposed indoor
and outdoor seating plan, label South Main Street, dimension the depth of
the outdoor seating area to the property line.
5. Please revise the site plan as follows: provide a site date table which
includes (Lot size, building foot print square footage of the three
buildings on Tract I/Lot C, total parking provided, existing land
square footage, square footage of landscaping, current zoning,
existing building height of 603 South Main Street, seating proposed
for the yogurt shop, parking required for the yogurt shop based upon
1 seat 13 persons) provide the names and label the approximate location
of the existing retail tenants and or vacancies within 603 and 601 South
Main Street and label the office building as office uses, highlight the
location of the yogurt shop, remove Tract II (Lot 3R, Block 15) from the
site plan, show the location of the yogurt shop on the site plan sheet, show
existing zoning of subject site as "CBD" Central Business District, show
adjacent zoning to the east as "CBD" Central Business District, southeast
and directly south of the office building as "LI" Light Industrial, and directly
south of 603 as "CBD" Central Business District, if would be very helpful to
remove much of the existing text from the site plan (please call for
suggestions). Please include an internal traffic circulation plan on the site
plan and provide a landscape plan.
6. Please provide on the site plan an elevation for the dumpster enclosure
and label the exterior materials used including the gate.
7. For verification purposes please email a PDF of the final site/floor
plan prior to producing the final copies.

Ms. Hobbs provided some much needed information, which is attached, but the site plan still
needs some work. Page five of the second attachment is another example of a the type of site
plan/floor plan the Council is accustomed to. The site / landscape plan must a be a clear drawing
of the subject site absent any unnecessary text. A couple of options may be to contact the
Landes and Associates to find out if they can provide a digital version of the site or have Mr.
Hutch prepare a site plan based upon the survey. Please feel free to contact me.

On Tuesday evening, January 19, 2010 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
CU09-46 YUM YUM YOGURT - submitted by Yum Yum Yogurt for property located at 603
Main Street #302 & #303 and platted as Lot C, Block 15, City of Grapevine Addition. The
applicant is requesting a conditional use permit to amend the previously approved site plan
to allow the development of a yogurt restaurant. The property is zoned "CBD" Central
Business District and is owned by owned by Harry Hines Medical Center.
CU09-47 - DFW INDUSTRIAL PARK - submitted by Middleton & Associates LLC for
property located at 1702 and 1712 Minters Chapel Road and proposed to be platted as
Lots 1R1 and 1R2, DFW Industrial Park, Phase 3. The applicant is requesting a
conditional use permit to establish a planned industrial park. The property is zoned "LI"
Light Industrial District and is owned by BREOF AIP Dallas, LP.
AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73 - The City Council
and the Commission will consider amendments and changes to the Comprehensive Zoning
Ordinance, No. 82-73, same being Appendix D of the Code of Ordinances as follows:
Section 43, Nonconforming Uses and Structures relative to right of way acquisitions and
any other additions, deletions, or changes to various sections, articles and provisions
contained in said Ordinance No. 82-73.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to establish a yogurt restaurant.
With this request the applicant proposes to establish a new 1,290 square foot, 25 -seat, self
serve frozen yogurt restaurant (Yum! Yum! Yogurt!) within two suites of the Westwood
Centre development. The expected hours of operation for the yogurt restaurant are from
11:00 am to 10:00 pm. The total available parking on site of 81 -spaces will adequately
serve the proposed use.
PRESENT ZONING AND USE:
The property is zoned "CBD" Central Business District. The suites were recently used as a
coffee shop (Mawker Coffee).

HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was rezoned in the 1984 City Rezoning from "SP" Specific Use Permit
District to "CBD" Central Business District. The subject property is also located within a
Historic Overlay District (HL93-01). The properties to the west and south of the auto repair
were rezoned from "LI" Light Industrial District to "CBD" Central Business District in the
1984 City Rezoning. The area to the south with the existing mini -warehouse development
was rezoned to "LI" Light Industrial District in 1990 (Z09-09). The restaurant south of the
subject site was approved in April 1993 (CU92-25) for alcohol sales. The funeral home
property to the north and the auto repair business to the west retained the "CBD" Central
Business District during the 1984 City Rezoning.
At the April 15, 2008 meeting Council approved Conditional Use Request CU08-09 (Ord.
08-20) on the subject site to establish a wine tasting room for on- and off -premise
consumption (wine only) in conjunction with a coffee shop. On March 24, 2009 Council
approved an extension to the wine tasting room to expire on April 15, 2010.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "CBD" Central Business District and "R-7.5" Single Family District —
funeral home, single family residence and bed and breakfast
SOUTH: "CBD" Central Business District and "LI" Light Industrial District —
restaurant, warehouse and mini -storage
EAST: "CBD" Central Business District and "LI" Light Industrial District —
professional offices and mini -storage
WEST: "CBD" Central Business District—various retail businesses and auto
repair
The subject tract is located within "Zone A" zone of minimal effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Central Business District land use.
The applicant's proposal is in compliance with the Master Plan.

Block 15, Original Town of Grapevine Addition was approved by the City Council on January
19, 2010. A copy of Ordinance 2010-01 is enclosed.
On January 19, 2010, the Planning and Zoning Commission recommended the City Council
approve the request.
Any changes to a site plan approved with a conditional use or a special use (no matter
how minor or major) can only be approved by city council through the public hearing
process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an

We are planning on opening up Yum! Yum! Yogurd, a self -serve frozen yogurt business on Main
Street in Grapevine. Yum! Yum! Yogurt! will sell and market a rotating menu of 18 frozen yogurt
flavors and over 40 toppings, allowing each guest to create their own Yum! Yum! Yogurt! experience.
Guests will customize their cup with their frozen yogurt and topping selections and their cup with be
weighed to determine sale price.
Yum! Yum! Yogurt! will be open seven days a week. The tentative hours will be 1 lam-9pm
Sunday through Thursday and l lam- IOpm Friday and Saturday.
As proprietors, we promise to maintain an in depth relationship with both our community and our
customers. We have shopped and we have lived the Grapevine experience and it is something we love so
much, that we want to become a part of it.
The success of the self -serve yogurt store throughout the Metroplex cannot be questioned. In
every possible avenue, Yum! Yum! Yogurt! will help bring in both traffic from outside of Grapevine, as
