ACKNOWLEDGEMENT
All Conditional Use and Special Use Applications are assumed to be complete when filed and
will be placed on the agenda for public hearing at the discretion of the staff. Based on the size
of the agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry.
Public hearings may be continued to the next public hearing. Public hearings will not be
tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or
a special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council. If after said period of
four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all filing fees. The application,
along with the required filing fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shall not be considered a part of the four month period.
I have read and understand all of the requirements as set forth by the application for
conditional use or special use permit and acknowledge that all requirements of this

BEING a tract of land situated in the Heirs of A. Foster Survey, Abstract No. 518,
Tarrant County, Texas, and being a portion of Lot 14, Block 1, Towne Center
Addition No. 2, an addition to the City of Grapevine, Tarrant County, Texas, as
recorded in Cabinet 'A', Slide 9474, of the Plat Records of Tarrant County,
Texas, and being more particularly described by metes and bounds, as follows:
COMMENCING from a point in the northerly end of a corner clip at the
intersection of the southerly right-of-way line of Ira E. Woods Avenue, (S.H. 26)

The subject properties are located at 811 and 819 Ira
E. Woods Avenue and are proposed to be platted as
Arport xI Lots 16 and 17, Block 1, Towne Center Addition No.

2. Each lot contains 22,283 and 18,364 square feet
respectively.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU 4-24 (Ord. 04-53) for a planned commercial center specifically to allow for the
development of two medical office buildings.
The applicant proposes the development of two separate medical office buildings on two
separately platted lots within the interior of the remaining undeveloped portion of the
Towne Center Addition. Both lots as presented have slightly over 25% landscaped open
space (25.38 and 25.33% respectively); however, the ordinance requires 30% open spaces
for all office uses within the "CC" Community Commercial District. As you may recall the
applicant provided a 50 foot landscape buffer around the remaining undeveloped frontage
portion of the Towne Center Addition in 2000 to account for a shortfall in the overall
landscaped open space requirement for the entire planned commercial center. Assuming
approval of this request, overall landscaping open space for the entire center is 24.85%.

The skilled nursing home project approved in 2004 provided 43% open space -20% is the
minimum required.
PRESENT ZONING AND USE:
The property is currently zoned "CC" Community Commercial District with a Planned
Commercial Center designation.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was zoned "C-2" Community Business District prior to the 1984 City
Rezoning. The tract was platted as the Towne Center Addition in 1986. The addition was
replatted twice in 1989. Conditional Use Permit CU89-15 for a Planned Commercial
Center to be developed as four lots with three restaurants (Luby's, Arby's and International
House of Pancakes) and one retail center, was approved in 1989. A one-year extension
of CU99-15 was approved in December 1990. CU91-19 for both a Jack in the Box
Restaurant and an amendment to the approved site plan of Luby's Cafeteria was approved
in 1991. CU93-05, approved in 1993, again amended the approved site plan and sign for
Luby's Cafeteria. CU95-02 (Ord. No. 95-10) was approved in February, 1995, allowing the
possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer
and wine only) in conjunction with an existing restaurant for Jason's Deli.
The Towne Center Addition II which contains 62.47 acres, was rezoned in 1992 (Z92-09
and CU92-23) from "PCD" Planned Commerce Development District to "CC" Community
Commercial District with a conditional use permit for a planned commercial center which
brought forward the development of the Target store. In 1994, the site plan was amended
to include Ross Dress for Less, Barnes and Noble, Famous Footwear, and Showcase
Hallmark (CU94-31, Ord. No. 94-100). In 1995 the master site plan was amended again
to allow for the development of Linens N' Things on Lot 4R-1 with Mattress Giant and
Chesapeake Bagel on Lot 5 (CU95-16). In 1996, the site plan was modified to develop
retail space for Barbecue's Galore and Coleman Spas on Lot 9 (CU96-20), Office Depot
and Cost Plus on Lot 6R (CU96-29), and a 20,000 square foot retail building on Lot 7 that
houses Chuck's Hamburgers, Haltom's Jewelers, and Busybody Home Fitness (CU96-36).
CU99-06 allowed the development of a 6,581 square foot restaurant (Mimi's Cafe) with the
possession, storage, retail sale, and on -premise consumption of alcoholic beverages (beer,
wine, and mixed drinks) along with an attached 3,295 square foot retail building. CU99-57
was approved in November 1999, allowing outdoor seating at Jason's Deli. Conditional
Use Request C000-11 (Ord. 00-34) was approved at the March 28, 2000 meeting which
allowed for a bank with drive-through service. In addition a 50 -foot landscape buffer was
approved with the request around the remainder of the undeveloped portion of the Towne
Center Addition including the bank site to bring the entire planned commercial center into
compliance with the landscaping requirements. The Site Plan Review Committee approved
CU03-01 in March 2003, allowing the placement of a pole sign for Haltom's Jewelers. The
Site Plan Review Committee also approved CU03-02 in March 2003, permitting a revision
of the Luby's Restaurant pole sign. At the August 19, 2003 meeting Council approved a

conditional use request (CU03-26) for modifications to the site plan for the Target retail
store. Conditional Use Request CU04-24 was approved at the August 17, 2004 meeting
with allowed for a 132 bed skilled nursing facility within the Towne Center Addition
accessed from Ira E. Woods Avenue.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "CC" Community Commercial District, "R-3.5" Duplex, and "LI" Light
Industrial District—Baylor Hospital, Grapevine Industrial Park,
Clearview Park
SOUTH: "CC" Community Commercial District—Classic Chevrolet, Outback
Steakhouse, TGI Friday's, California Pizza Kitchen, Boston Market,
Don Pablos, Hooter's and Red Robin
EAST: "CC" Community Commercial District, "CN" Neighborhood
Commercial District, "GU" Governmental Use District, and "HC"
Highway Commercial District—numerous retail stores and restaurants
including: Joann's Superstore, PetCo, Subway, Baja Mexican Grill,
Firestone, Taco Bell, Silver Fox Steakhouse, Wendy's, Chick-Fil-A,
Mobile Service Station, U.S. Post Office.
WEST: "CC" Community Commercial District – State Highway 114, and
Regency Center including Academy Sports, Best Buy and Omni
Leather.
AIRPORT IMPACT:
The subject tract is located within "Zone A" zone of minimal effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Commercial Land Use. The
applicant's proposal is in compliance with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates Ira E. Woods Avenue as a Type C Minor Arterial with a
minimum 80 -foot right-of-way developed as four lanes with a turn lane.

This letter is to verify that your request for a conditional use permit to amend the previously
approved site plan of CU04-24 (Ord. 04-53) for a planned commercial center specifically to

approved by City Council on October 17, 2006. A copy of Ordinance 2006-74 and a copy of

Any changes to a site plan approved with a conditional use or a special use (no matter
how minor or major) can only be approved by city council through the public hearing
process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.

Let this letter serve to inform you that the two medical office buildings proposed
for Lot 16, Towne Center Addition No. 2 are in full compliance with all applicable
requirements relative to the City's zoning and subdivision ordinances. The
property, zoned "CC" Community Commercial District, with a Planned
Commercial Center designation approved by the City Council, allows multiple
buildings, both principal and accessory in nature, to be located on one lot of
record. Interior building setbacks, building separation, and landscaped open
space are criteria that can be established by Council through the conditional use
process. This project has been considered and approved by the City Council

Ron - to expand a little more on my last email regarding yours below, I
don't think they are looking for anything really specific. They just
want assurances that the City will grant building permits for this plat
and that the fact that the two office buildings that are being built on
one lot does not in any way violate your subdivision ordinance. They
are thinking that each building has an "implied" lot to itself and
therefore there are 2 lots that someone could say are below the 30,000
sqft minimum. I know that is really stretching it but if you could put
together something that addresses that it would sure help.

Conditional Use Request CU06-39 was approved by Council at their
October 17, 2006 meeting for two medical office building in the Towne
Center Addition No. 2. Shortly after approval it was discovered that the
minimum lot size requirement for the two medical office building lots had
not been met. The solution was to amend the plat for Lots 16 and 17 by
removing the interior lot line separating the two and redesignating the two
lots into one Lot 16. The two medical office buildings remain unchanged
and all zoning requirements have been met.

2. Contractor shall scarify, rip, loosen all areas to be hydromulchad to a
minimum depth of 4" prior to topsoil and hydromulch Installation.
3. Bermudagrass seed shall be extra hulled and: treated lawn type, and
shall be delivered to the site in its original unopened cointal-ner, and
shall meet Texas Slate Low requirements,
4. Fiber Shall be one hundred (100%) percent Wood Cellulose Fiber,
delivered to the site In Its original! unopened container. 'Conweb"or
equal.
5. Fiber Tack: Shall ba delivered to the alto in Its original unopened
container, and shall be 'Terro-Tack one, as ni anufactured by
Growers, Inc., or equal.
6. Hydromulch With Bermudagrass seed at a rate of two C2) pounds' -per
one thousand (1000) square foot
7. Use a 0W batter, board against 60' beds areas.
8. If installation occurs between September I and April 1, all
hydromulch areas to be Winter Ryegrass, at a rateof four (4) pounds
per one thousand (1,000) square feet. Contractor shall be required to
re-hydromulch with Bermudagrass the following growing season.
91. All: lawn areas to be hydromulched, shall have one hundred (100%)
percent coverage prior !to ff nal acceptance.
10. Contractor shall maTntain aillawn areas until OnRlacceptance. This
shall include but not be limited to: mawlng, watering, weeding,
cultivating, cleaning, andreplacIng dead or bare arsea to keepplants
In a vigorous, bealthy condition.
11. Contractor shall guarantee establishment of an acceptable turf area
