All Conditional Use and Special Use Applications are assumed to be complete when filed and
will be placed on the agenda for public hearing at the discretion of the staff. Based on the size
of the agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry.
Public hearings may be continued to the next public hearing. Public hearings will not be
tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or
a special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council. If after said period of
four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all filing fees. The application,
along with the required filing fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shalt not be considered a part of the four month period.

1. Please add case number CU06-40 and label sheet numbers in
consecutive order on the lower right hand corner of all each sheets.
2. Please add adjacent zoning as follows: to the east Highway
Commercial; to the west Highway Commercial; and to the north
R.7.5 Single Family.
3. Please add the following in a chart form showing the amount
required and provided: height of current and proposed buildings;
total building area; total lot area; total impervious surface; total
open space (landscaped area) and distance from property lines of
existing and proposed structures.
4. Please provide location, size, arrangement and elevation of all outdoor
signs (pole signs, wall signs, and ground signs) and sign cabinet
dimensions of pole and ground signs.
5. Please add the calculation of the percentage of the masonry of the entire
proposed and current structures excluding doors and windows.
6. Please note the location, designation and total area of all usable open
space (landscaped areas).
7. Please correct the typographical error within General Note (B) on the site

12. Please add the following note to the site plan: all on-site electrical
conductors associated with new construction shall be located under
ground.
13. Please revise the illumination plan. Lighting adjacent to single family
residential may not exceed 0.2 footcandles. Please provide on the site
plan an elevation of the proposed light fixtures.
14. Please add the following note:
Conditional use request, CU06-40 is a request to amend a
previously approved site plan of CU04-17 (Ord. 04-35) for an
automotive dealership with sales and service of new and used
vehicles and a 30 -foot pose sign, specifically to expand the
operation to include the previous pre -owned sales office building.
The above comments must be reflected in the revised submittal,
which is due by Friday, September 29 at 12:00 p.m. for the October 17
joint public hearing. Please submit the revised documents to the
Department of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) mylar of each sheet (minimum size 22" x 34")
one (1) colored version of the sign elevation and landscape plan on 11" x
17" or a digital version of the same
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU04-17 (Ord. 04-35) for an automotive dealership with sales and service of new
and used vehicles and a 30 -foot pole sign specifically to expand the operation to include
a pre -owned vehicles sales office building_
The applicant proposes expansion of the existing automobile dealership by adding a pre-
owned sales office to the western portion of this site. The western portion of this site has
remained vacant after two smaller buildings, previously used as a used vehicle sales office
and a make-ready/frame shop, were demolished.
A six-foot masonry screening fence along the northern boundary with the Sky Harbor
residential subdivision, east of Hill Street has been installed. In conjunction with this

request, the applicant proposes construction of a six-foot masonry screening fence along
the remaining portion of the northern border of this site. The screening fence will prevent
vehicular access to or from Hill Street.
PRESENT ZONING AND USE:
The property is currently zoned "HC" Highway Commercial District and is developed as the
Grapevine Suzuki dealership.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was rezoned from "C-2" Community Business District to "HC"
Highway Commercial District in the 1984 Citywide Rezoning. The Board of Zoning
Adjustment approved BZA92-27 to allow . variances to the minimum open space
requirements, maximum impervious area, front yard setback requirement, landscaping
requirements, and nonconforming uses. Variance request BZA94-12 was approved
allowing variances to the required minimum open space requirement, maximum impervious
area, front yard setback requirement, and allowing a special exception to allow an existing
nonconforming use to expand. Variance request BZA96-08 was approved allowing the
remodeling or enlargement of a nonconforming use. Conditional Use Application CU96-06
was approved at the April 16, 1996 meeting allowing automotive sales and service to new
and used cars and trucks. A conditional use permit for the relocation of an 88 -foot flag
pole (CU98-16) and a special use permit (SU98-03) to allow for cellular equipment was
approved by Council on April 21, 1998. A zone change request (Z01-17) to rezone the
property from "HC" Highway Commercial District to "CC" Community Commercial District
and a conditional use request (CU01-67) to allow for temporary used car sales for Nissan
automobile new and used car dealership was withdrawn by the applicant. A conditional
use permit (CU04-17) for a 30 -foot pole sign was approved on this site at the May 18, 2004
meeting.
The property to the east was rezoned from "C-1" Community Business to "PO" Professional
Office District in the 1984 Citywide Rezoning. Zoning Change Request Z95-16 approved
the rezoning of this property to "HC" Highway Commercial District from "PO" Professional
Office District. Conditional Use Application CU95-16 allowed automotive sales and service
of new and used cars and trucks on the western side of this property.
The property to the north was rezoned from "R-1" Single Family District to "R-7.5" Single
Family District in the 1984 Citywide Rezoning. It is currently developed as the Bellaire
Addition.
The property to the west was rezoned from 1-1" Light Industrial District and "R-1" Single
Family District to "HC" Highway Commercial District in the 1984 Citywide Rezoning. This
property has developed as the Haley Addition Planned Commercial Center.

AIRPORT IMPACT:
The subject tract is located within "Zone A" zone of minimal effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Commercial land use. The
proposed use is in compliance with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan does not designate the frontage road of State Highway 114 West
as a local thoroughfare.

Dear Mr. Lawler,
This letter is to verify that your request for a conditional use permit to amend the previously
approved site plan of CU04-17 (Ord. 04-35) for an automotive dealership with sales and
service of new and used vehicles and a 30 -foot pole sign, specifically to expand the operation
to include a pre -owned vehicles sales office building on property located at 440 West State
Highway 114 and platted as Lot 1 R1, Block 1 R, Payton Wright Addition was approved by City
Council on October 17, 2006 with the condition that the applicant work with staff to revise the
pre -owned building elevations to have similar architectural features as the new car sales
building. A copy of Ordinance 2006-75 and a copy of the approved site plan are enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter
how minor or major) can only be approved by city council through the public hearing
process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy, Permit is obtained and a use commenced.
