1. Please add case number CU06-64 and label sheet numbers in
consecutive order on the lower right hand corner of all each sheets.
2. Please show the location of the proposed security fence, and an
elevation of the material used for the fence.
3. Please add the following note:
Conditional use request, CU06-64 is a request to amend a
previously approved site plan of CU04-17 (Ord. 04-35) for an
automotive dealership with sales and service of new and used
vehicles and a 30 -foot pole sign, specifically to expand the
operation to include additional vehicle display and storage areas.
The above comments must be reflected in the revised submittal,
which is due by Thursday, December 28 at 12:00 p.m. for the January
16, 2007 joint public hearing. Please submit the revised documents to
the Department of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) mylar of each sheet (minimum size 22" x 34")
one (1) colored version of the sign elevation and landscape plan on 11" x
17" or a digital version of the same
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edae
and then fold the right edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City -approved tax rolls, you received this notice. If you cannot or
do not wish to attend the hearing, the attached form is provided for your
convenience. If owners of more than 20% of the property within 200 feet of the

Purpose of Request:
The public hearing is to consider an application submitted by Patrick Lawler for property

Addition. The applicant is requesting a conditional use permit to amend the previously
approved site plan for an automotive dealership with sales and service of new and used

opaque mesh backing for screening purposes. A six-foot masonry screening fence along
the northern boundary with the Sky Harbor residential subdivision, east of Hill Street has
been installed. The screening fence will prevent vehicular access to or from Hill Street.
PRESENT ZONING AND USE:
The property is currently zoned "HC" Highway Commercial District and is developed as the
Grapevine Suzuki dealership.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was rezoned from "C-2" Community Business District to "HC"
Highway Commercial District in the 1984 Citywide Rezoning. The Board of Zoning
Adjustment approved BZA92-27 to allow variances to the minimum open space
requirements, maximum impervious area, front yard setback requirement, landscaping
requirements, and nonconforming uses. Variance request BZA94-12 was approved
allowing variances to the required minimum open space requirement, maximum impervious
area, front yard setback requirement, and allowing a special exception to allow an existing
nonconforming use to expand. Variance request BZA96-08 was approved allowing the
remodeling or enlargement of a nonconforming use. Conditional Use Application CU96-06
was approved at the April 16, 1996 meeting allowing automotive sales and service to new
and used cars and trucks. A conditional use permit for the relocation of an 88 -foot flag
pole (CU98-16) and a special use permit (SU98-03) to allow for cellular equipment was
approved by Council on April 21, 1998. A zone change request (Z01-17) to rezone the
property from "HC" Highway Commercial District to "CC" Community Commercial District
and a conditional use request (CU01-67) to allow for temporary used car sales for Nissan
automobile new and used car dealership was withdrawn by the applicant. A conditional
use permit (CU04-17) for a 30 -foot pole sign was approved on this site at the May 18, 2004
meeting. A conditional use permit (CU06-40) for the expansion of the dealership to the
vacant lot plus a pre -owned vehicle sales building was approved at the October 17, 2006
meeting.
The property to the east was rezoned from "C-1 " Community Business to "PO" Professional
Office District in the 1984 Citywide Rezoning. Zoning Change Request Z95-16 approved
the rezoning of this property to "HC" Highway Commercial District from "PO" Professional
Office District. Conditional Use Application CU95-16 allowed automotive sales and service
of new and used cars and trucks on the western side of this property.
The property to the north was rezoned from "R-1" Single Family District to "R-7.5" Single
Family District in the 1984 Citywide Rezoning. It is currently developed as the Bellaire
Addition.
The property to the west was rezoned from 1-1" Light Industrial District and "R-1" Single
Family District to "HC" Highway Commercial District in the 1984 Citywide Rezoning. This
property has developed as the Haley Addition Planned Commercial Center.

This letter is to verify that your request for a conditional use permit to amend the previously
approved site plan of CU06-40 (Ord. 2006-75) for an automotive dealership with sales and service
of new and used vehicles and a 30 -foot pole sign, specifically to expand the operation, create a
vehicle trade-in holding area and defer construction of a previously approved pre -owned vehicle
sales office building on property located at 440 West State Highway 114 and platted as Lot 1 R1,
Block 1 R, Payton Wright Addition was approved by the City Council on January 16, 2007. A copy of
Ordinances 2007-03 and a copy of the approved site plan are enclosed.
On January 16, 2007, the Planning and Zoning Commission recommended the City Council
approve the request.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.

Proposed Conditional Use:
is Grapevine Suzuki's intent to initially use the subject property for additional
new and used vehicle parking and display. In conjunction with this usage
additional improvements will be made to the property. These include lighting of
the lot, a concrete privacy fence where the lot adjoins existing residential
properties and professional landscaping along the south side service road.
7,Te feel that there will be no possibility of harm to the value of the property in
the neighborhood as the lot is currently vacant. The improvements to be made
should only serve to enhance the overall value and appearance of the property
