AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73
The City Council and the Commission will consider amendments and changes to the
Comprehensive Zoning Ordinance, No. 82-73, same being Appendix D of the Code of
Ordinances as follows: Section 51, Requirements for Open Space and Recreational Areas
and Section 20, "R-TH" Townhouse District relative to requiring dedicated open space in
the "R-TH" Townhouse District; Section 60, Sign Standards relative to roof signs, and any
other additions, deletions, or changes to various sections, articles and provisions contained
in said Ordinance No. 82-73.

1 The subject property is located on Enchanted Way
north of Bass Pro Drive on the east side of
FW syr A'Grp E Enchanted Way and is proposed to be platted as
Lots 3, 4 & 5, Block 2, Genesis Addition. The

REQUESTED CONDITIONAL USE, SPECIAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to establish a planned office center
and a special use permit to allow for a church in the "CC" Community Commercial District
The applicant proposes to develop a three building project that will consist of two, 20,408
square foot office buildings fronting along Enchanted Way and a 13,971 square foot church
with sanctuary seating for 300 patrons on the rear portion of the lot.
The subject and surrounding properties to the north and south, were the focus of several
tree removal requests (TR98-03, TR99-02) relative to a large clearing of trees that
occurred without appropriate permitting from the City. In September 2004 an agreement

was reached between the City and the owner of the property, Mr., Bill Thompson detailing
the process in which those trees that were removed would be replaced. Along the rights-
of-way of Bass Pro Drive, Enchanted Way, and Genesis Way, 176 replacement trees have
been planted. The remaining balance of trees to be replaced will be planted at a ratio of 43
caliper inches per acre as each property develops. For the subject tract this results in an
additional 13, three caliper inch trees above the standard landscaping requirements.
PRESENT ZONING AND USE:
The property is currently zoned "CC" Community Commercial District and is undeveloped.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding properties were zoned from 1-1" Light Industrial District to
"PID" Planned Industrial District during the 1984 City Rezoning. The subject property as
well as the properties to the north, south, east, and west were subsequently rezoned in
1996 (Z96-02, Z96-15) to "CC" Community Commercial District. The property to the west
has received several conditional use permits for a planned commercial center developed
with several limited service hotels.

The subject tract is located within "Zone B" Middle Zone of Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. In "Zone B"
the following uses may be considered only if sound treatment is included in building design:
multifamily apartments, motels, office buildings, movie theaters, restaurants, personal and
business services. Single family residential and sound sensitive uses such as schools and
churches should avoid this zone. The applicant's proposal relative to office uses with
sound attenuation would be an appropriate use in this noise zone however the proposed
church use is not considered an appropriate use in this noise zone.

The Master Plan designates the subject property as a Commercial land use. The
applicant's request is in compliance with the Master Plan.

This letter is to verify that your request to establish a planned office center and a special use permit
to allow for a church in the "CC" Community Commercial District on property located at 1900
Enchanted Way and platted as Lots 3, 4 and 5, Block 2, Genesis Addition was approved by the City
Council on March 21, 2006. A copy of Ordinances 2006-20 and 2006-21 and a copy of the
approved site plan are enclosed.
On March 21, 2006, the Planning and Zoning Commission recommended the City Council approve
the request.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
