will be placed on the agenda for public hearing at the discretion of the staff. Based on the size
of the agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry.
Public hearings may be continued to the next public hearing. Public hearings will not be
tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or
a special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council. If after said period of
four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all filing fees. The application,
along with the required filing fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shall not be considered a part of the four month period.

352, and being a part of that 31.711 acre tract of land conveyed

BEGINNING at a 1/2 inch iron rod found at the most westerly

PROPERTY LOCATION AND SIZE:
The subject property is located at 2140 Hall- Johnson
Road, Suite 118, and platted as Lot 2, Block 1, Hall -
Johnson Addition. The addition contains 2.441
acres. The property has approximately 281 feet of
frontage along Hall- Johnson Road.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit for the possession, storage, retail sale
and on- Dremise consumption of alcoholic beverages (beer, wine and mixed drinks) in
conjunction with a proposed restaurant. This request is associated with a future Zuroma's
Restaurant, planned for the new strip center under construction, located on Hall- Johnson
Road, on the south side of Randy's Chevron Gasoline Station.
PRESENT ZONING AND USE:
The property is currently zoned "CC ", Community Commercial District and is under
development.

HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was rezoned in the 1984 City Rezoning from "R -1" Single Family
District to "CC ", Community Commercial District. A site plan for a small commercial center
was administratively approved in June 2000 (SP00 -06). The site is currently under
development.
The property located to the east of the subject site was rezoned in the 1984 City Rezoning
from "C -2 ", Community Business District to "CC ", Community Commercial District.
Conditional Use Permit 96 -23 allowing the possession, storage, retail sale and on- premise
consumption of alcoholic beverages possession, storage, retail sale and off - premise
consumption of alcoholic beverages (beer and wine), was approved by Council on
September 17, 1996 (Ord. No. 96 -76). Randy's Chevron Station was subsequently
developed on the site.
The land located to the northwest of the site was rezoned in the 1984 City Rezoning from
"R -1" Single Family District to "R -7.5 ", Single - Family District and was subsequently
developed as Belfort Estates. Parker Cemetery is located directly north of the site.
Zoning Case Z83 -29, approved in August 1983, rezoned the property located to the west
from "R -1" Single Family District to "R- MF -2 ", Multifamily Residential District (Ord. No. 83-
47), however the site was not developed. In January 1986, Council approved Z86 -01 (Ord.
No. 86 -09), rezoning a 16.3 -acre piece of this site to "CC ", Community Commercial District
for a mixed use retail concept that never developed. Case No. Z94 -01 (Ord. No. 94 -17)
revised the stipulations set forth in Ordinance 86 -09 by eliminating a 30 -foot right -of -way
dedication for a proposed street that was to connect Heritage Avenue to the southbound
service road of William D. Tate Avenue /State Highway 121. Zoning Case Z97 -18 (Ord.
No.97 -134) and CU97 -47 (Ord. No. 97 -135) were approved by Council on December 2,
1997, changing the zoning of the entire site to "CC ", Community Commercial District and
approving a conditional use permit for a Planned Commercial Center with the Possession,
storage, retail sale, and off - premise consumption of alcoholic beverages (beer and wine
only) in conjunction with a grocery store. Since that time, CU98 -23 (Ord. No. 98 -75)
allowing for the realignment of an interior drive aisle and subsequent reallocation of parking
spaces on Lot 1 was approved in June, 1998 and CU98 -44 (Ord. No. 98 -114) was
approved in September 1998 approving the addition of a monument sign to the site.
CU98 -27 (Ord. No. 98 -76) for a Wendy's Restaurant with a drive - through window was
approved in September 1998.

SPECIFICATIONS
HOUSING
The V Series aluminum housing is finished to produce a clean, sharp appearance and designed to ensure
weather -tight construction. Top- access cover provides ease of installation and servicing. All pole -top fixtures
are pre - wired. Each fixture is UL listed and GSA certified for wet locations.
LENS /GASKET
The V Series contoured tempered glass lens is sealed to the housing with an EPDM gasket, preventing entry of
moisture and insects.
TOP FASTENERS
The V Series four captive stainless steel door fasteners secure the top- access cover to the housing.
SOCKETS
Porcelain mogul -base sockets feature spring- reinforced contacts for long life.
LIGHT SOURCES
The V Series is designed to operate with any of the following lamp types: High Pressure Sodium, Super Metal
Halide or Metal Halide with mogul -base sockets.
REFLECTORS /DISTRIBUTION PATTERNS
The V Series fixture is available in five reflector systems and distribution patterns, all with vertical burn lamps:
Type II (2), Type III (3) (400 watt only), Type V Square (5), Automotive Forward Throw (FA) (1000 watt only),
and Perimeter Forward Throw (FP). Reflectors are field - rotatable, enabling generous flexibility in distribution
patterns without fixture movement.
FINISHES
Each V Series fixture is finished with a revolutionary superior baked -on polyester powder finishing process, to
give the fixture an exceptionally attractive appearance. Standard finish colors include bronze, cocoa, buff,
black, platinum, white and green. The polyester finish withstands extreme weather changes without cracking
or peeling. Finish is guaranteed for five full years.
BALLAST
High -power factor ballast with removable ballast tray. Metal Halide, Super Metal Halide and High Pressure Sodium fixtures
j feature a type CWA ballast. All ballast types are designed for -20 F operation.
BRACKETS
Arm Mount: 2-1/2"x 6'x 12' length, extruded aluminum bracket shipped standard with medium luminaire. Fourteen -inch
arm mounts are shipped standard with large luminaires. (An eight -inch bracket is available, but must be ordered
separately from Optional Bracket Ordering Information.) A Round Pole Plate (RPP) is required for mounting to 3' - 5'
round poles. (See Options in Luminaire Ordering Information.)
Pole Top: The cast aluminum mounting hub conceals wiring compartment and mounting hardware (consisting of four
11/16' O.D. aluminum rods for medium fixtures and 7/8' O.D. aluminum rods for large fixtures, and a high - strength
grade -five steel bolt with nylon insert and split lock washer for double locking).
