This letter confirms that on September 12, 2022 the Board of Zoning Adjustment approved
the following request for the property located at 2711 North O'dell Court:
Section 43.E.3., "Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use. A
special exception to allow a residential dwelling to remain as developed with a front yard
encroachment of six feet adjacent to the south property line.

BACKGROUND INFORMATION:
The subject property is developed with a one-story, 2,284 square foot single-family
detached residence on a 29,350 square foot (0.67 acre) lot. The lot was developed in 1973
and is platted as Lot Z, O’Dell Subdivision Addition. The zoning district for the subject
property at the time of development was “R-1”, Single Family Dwelling District and the
property was rezoned to “R-12.5”, Single Family District in the 1984 City-wide rezoning.
The application was submitted by the property owner, Bonnye and Jared Skyes.
The existing dwelling is approximately 29.8 feet from the adjacent the south property line,
an approximate four-inch encroachment into the required setback of 30 feet. A “R-12.5”
Single Family District subdivision approved prior to December 4, 1984 is allowed to have a
front yard setback of 30-feet which conforms to the “R-7.5” District setback requirement.
REQUEST:
The applicant intends to replat one lot into two lots. The plot plan depicts the existing
dwelling approximately 29.8 feet from the south property line, which encroaches
approximately 4 inches into the required setback adjacent to the south property line of 30
feet. Subdividing the subject property into two lots, permanently eliminates the permissible
30-foot front yard setback and will require a 35-foot setback along South and North O’Dell
Court. Replating of the subject site will result in a front yard encroachment of
approximately 5 feet 4 inches for the existing dwelling adjacent to the south property line.
The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing residential structure to
remain as developed.
SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically,
the subject lot is an existing developed lot, the dwelling was built in 1973 prior to the

rezoning of the property in the 1984 City-wide Rezoning to “R-12.5”, District. and at the
time of construction a form board survey was not required. Currently and as proposed, the
site is not compliant with Zoning Ordinance (82-73) relative to the required 30 foot and
proposed 35-foot front yard setbacks adjacent the south property line. The proposed 35
foot front yard setback adjacent to the south property line is exacerbated by the degree of
the location of the existing dwelling, the consequence of the proposed replat, and new
construction form board survey requirements.
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve a special exception to the
Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses
and Structures to allow the existing residential structure to remain as developed as shown
on the plot plan.
