43.E.3, Nonconforming Uses and Structures to allow for the front porch addition, rear primary
building addition, carport conversion and construction of a new detached garage with gym as
shown on the plot plan.

PROJECT DESCRIPTION: Section 43.E.3, Nonconforming Uses and Structures allows the Board of

front yard and the lot to remain as developed. (side yard setbacks are also not currently maintained
consistent with R-7.5 zoning district and rear building addition for master bedroom and bathroom encroaches

*For the purposes of this application, we only need the dimension control site plan, floor plans, and building
elevations for all buildings. Please remove the plumbing, electrical and foundation plans/details from the plan
set for the proposes of the BZA special exception request. These sheets can be submitted with the building
permit to Building Services.

developed with existing side yard setback encroachments for the existing residence, and to
allow a rear building addition for a master bedroom and bathroom to encroach into the
required side yard setback of less than the 6-feet.”
5. Update the case number on all sheets in the approval/signature blocks to BZA22-12 and project
name as 1321 S. Pine Street.
Dimensional Control Site Plan
6. Provide a site data table per the Site Plan Checklist to required and provided for the following:
height in stories and feet, total building area, lot area, total impervious area (including
percentage of lot), total open space (landscaping including percentage of lot), parking required
per unit in each building and for guest parking, number of buildings, number of total dwelling
units, size of dwelling units, number of bedrooms, and total lot coverage of all vehicular
elements divided between vehicular and pedestrian ways. Please find the Site and Landscape
Data Tables here.
7. Add the following notes to the Dimensional Control Site Plan:
o Refuse disposal areas shall be landscaped and screened from view.
o Mechanical and electrical equipment including air conditioning units, shall be designed,
installed and operated to minimize noise impact on surrounding property. All such
equipment shall be screened from public view.
o The masonry requirements of section 54 shall be met.
o Illuminated signage was including the determination of the illumination levels
o Proposed ground signage meets minimum requirements of Section 60 of the Zoning
Ordinance and will be approved through separate building permit.

SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA22-12
1321 SOUTH PINE STREET

BACKGROUND INFORMATION:
The subject property is developed with a one-story, 1,535 square foot single-family
detached residence on a 9,869 square foot (0.22 acre) lot. The lot was developed in 1956
and is platted as Block 5, Lot 4, Sky Harbor Addition. The zoning district for the subject
property at the time of development was “R-1”, Single-family Dwelling District and the
property was rezoned to “R-7.5”, Single-Family District in the 1984 City-wide rezoning.
The Board of Zoning Adjustment approved a special exception request, BZA21-09, on
August 2, 2021 for an expansion to the rear of the primary structure of 515 square feet for
an owner’s retreat keeping the existing 4.9-foot side yard setback adjacent to the southern
property line. The plot plan for BZA21-09 also showed a proposed 760 square foot
detached garage with 6-foot side and rear yard setbacks from those property lines. A small
front porch addition was also proposed in line with the existing face of the front elevation
and did not protrude into the unplatted 25-foot front yard building line.
The application was submitted by Jaime Paxton Morey, property owner and no
construction for previously approved expansions has occurred at this time.
REQUEST:
The applicant intends to expand the existing single-family detached residence by 515
square feet for an owner’s retreat (e.g., master bedroom, bathroom, and utility room) to the
rear of the existing building. With BZA21-09, the special exception request was to keep the
expansion in line with the established side-yard setback of 4.9-foot to the southern property
line. With this request, BZA22-12, the owner’s retreat addition is shown to step back to the
north slightly to meet the required 6-foot side-yard setback required in the “R-7.5” District.
The existing one-car garage that is part of the primary structure is proposed to be
converted into a pass-through carport. The existing exterior wall of the one-car garage is
approximately 5.7 feet from the northern property line. With the proposed conversion to a
pass-through carport, support poles will be added that are a minimum 6 feet from the
northern property line while the carport roof eave will extend into the 6-foot side-yard
setback by 1 foot 4 inches.
The required front-yard setback for the “R-7.5”, Single-Family District is 30 feet. The

established front yard setback along South Pine Street is 25 feet, as a 25-foot building line
is platted as part of Block 5 of the Sky Harbor Addition and therefore controls the minimum
front yard setback. The proposed front porch addition will not encroach into the platted
front building line as shown on the plot plan.
The proposed 760 square foot detached garage with gym is located in the rear yard
adjacent to the east property line. This detached accessory structure will meet the
minimum required rear and side-yard setback requirements of 6 feet for the “R-7.5” District.
The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing residential structure to
remain as developed along with an expansion as shown on the plot plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically,
the subject lot is an existing developed lot and the dwelling was built in 1956 prior to the
rezoning of the property in the 1984 City-wide Rezoning to an “R-7.5”, Single-Family
District. Currently and as proposed, the site is not compliant with Zoning Ordinance (82-73)
relative to the required 6-foot side yard setback adjacent to the north and south property
lines and the 30-foot front yard setback adjacent to the western property line. The
proposed expansion of the dwelling does not exacerbate the existing side yard setback
adjacent to the north and south property line of approximately 4.5 feet nor the existing front
yard setback adjacent to the western property line of 25 feet.
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve a special exception to the
Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses
and Structures to allow for the front porch addition, rear primary building addition, carport
conversion and construction of a new detached garage with gym as shown on the plot
plan.

SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA22-12A

BACKGROUND INFORMATION:
The subject property is developed with a one -story, 1,535 square foot single-family
detached residence on a 9,869 square foot (0.22 acre) lot. The lot was developed in 1956
and is platted as Block 5, Lot 4, Sky Harbor Addition. The zoning district for the subject
property at the time of development was “R-1”, Single-family Dwelling District, and the
property was rezoned to “R-7.5”, Single-Family District in the 1984 City-wide rezoning.
The Board of Adjustment approved a new special exception request, BZA2 2-12, on
September 12, 2022, to allow for a front porch expansion. With this request, the plot plans
provided showed and dimensioned that the previously approved building expansion to
the rear of the primary structure met the required side yard setback adjacent to the south
property line and the garage conversion to a drive-through carport, the posts met the
required side-yard setback adjacent to the north property line. This was done in error on
the plot plan drawing. Instead, the applicant intended their plot plan to depict a 5-foot side
yard setback adjacent to the south property line which was consistent with th e existing
primary structures' 4.9-foot side yard setback.
The Board of Zoning Adjustment approved a special exception request, BZA21 -09, on
August 2, 2021, for an expansion to the rear of the primary structure of 515 square feet
for an owner’s retreat keeping the existing 4.9-foot side yard setback adjacent to the
southern property line. The plot plan for BZA21 -09 also showed a proposed 760 square
foot detached garage with 6-foot side and rear yard setbacks from those property lines.
A small front porch addition was also proposed in line with the existing face of the front
elevation and did not protrude into the unplatted 25 -foot front yard building line.
The application was submitted by Jaime Paxton Morey, property owner and no
construction for previously approved expansions has occurred at this time.
REQUEST:
The applicant intends to expand the existing single-family detached residence by 515
square feet for an owner’s retreat (e.g., master bedroom, bathroom, and utility room) to
the rear of the existing building. With BZA21-09, the special exception request was to
keep the expansion in line with the established side-yard setback of 4.9-foot to the
southern property line. With BZA22-12, the owner’s retreat addition was shown to step

back to the north slightly to meet the required 6-foot side-yard setback required in the “R-
7.5” District. With this request, BZA22-12A, the owner’s retreat addition is now correctly
shown on the plot plan in line with the established side-yard setback of 4.9-foot to the
southern property line.
The existing one-car garage that is part of the primary structure is proposed to be
converted into a pass-through carport. The existing exterior wall of the one-car garage is
approximately 5.7 feet from the northern property line. With the proposed conversion to
a pass-through carport, support poles will be added that are a minimum 6 feet from the
northern property line while the carport roof eave will extend into the 6-foot side-yard
setback by 1 foot 4 inches.
The required front-yard setback for the “R-7.5”, Single-Family District is 30 feet. The
established front yard setback along South Pine Street is 25 feet, as a 25 -foot building
line is platted as part of Block 5 of the Sky Harbor Addition and therefore controls the
minimum front yard setback. The proposed front porch addition will not encroach into the
platted front building line as shown on the plot plan.
The proposed 760 square foot detached garage with gym is located in the rear yard
adjacent to the east property line. This detached accessory structure will meet the
minimum required rear and side-yard setback requirements of 6 feet for the “R-7.5”
District.
The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant is requesting a special exception to allow the existing residential
structure to remain as developed along with an expansion as shown on the plot plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically,
the subject lot is an existing developed lot and the dwelling was built in 1956 prior to the
rezoning of the property in the 1984 City-wide Rezoning to an “R-7.5”, Single-Family
District. Currently and as proposed, the site is not compliant with Zoning Ordinance (82-
73) relative to the required 6-foot side yard setback adjacent to the north and south
property lines and the 30-foot front yard setback adjacent to the western property line.
The proposed expansion of the dwelling does not exacerbate the existing side yard
setback adjacent to the north and south property line of approximately 4.9 feet nor the
existing front yard setback adjacent to the western property line of 25 feet.
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve a special exception to the
Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming
Uses and Structures to allow for the front porch addition, rear primary building addition,
carport conversion and construction of a new detached garage with gym as shown on the
plot plan.
