RECOMMENDATION:
Staff recommends the Planning and Zoning Commission and City Council and accept the
applicant’s request to withdraw conditional use application CU22-35, and take any other
necessary action.
BACKGROUND:
Conditional Use application CU22-35 is a request to allow the possession, storage, retail
sale, and on- and off-premise consumption of alcoholic beverages (beer, wine, and mixed-
beverages) and to remove the retaining wall at the rear of the property in order to provide
additional parking in conjunction with a restaurant. The property owner has decided to
withdraw the request. See the attached letter.

Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City-approved tax rolls, you received this notice. If you cannot or
do not wish to attend the hearing, the attached form is provided for your
convenience. If owners of more than 20% of the property within 200 feet of the
subject tract object to the case, a 3/4 vote of the City Council is required to approve
the request.
Purpose of Request:
The public hearing is to consider an application submitted by Glazer Properties for property
located at 2140 Hall Johnson Road, Suite 118 and platted as Block 1, Lot 2, Hall-Johnson
Addition. The applicant is requesting a conditional use permit to amend the previously
approved site plan CU14-24 (Ord. 2014-34) to allow to allow outdoor dining and outdoor
speakers; this request is specifically to allow the possession, storage, retail sale, and on-
and off-premise consumption of alcoholic beverages (beer, wine, and mixed-beverages), to
remove the retaining wall at the rear of the property in order to provide more parking in
conjunction with a restaurant. The property is currently zoned “CC”, Community
Commercial District and owned by Heritage Crossing Dallas, TX, LLC.

2. Mechanical and electrical equipment including air conditioning units, shall be designed,

equipment shall be screened from public view in accordance with the Zoning Ordinance.
3. Open storage, where permitted, shall be screened in accordance with the Zoning Ordinance.
4. The masonry requirements of Section 54 of the Zoning Ordinance shall be met.
5. Illuminated signage was included in the determination of the site illumination levels.
6. Outdoor lighting shall comply with illumination standards within Section 55 of the
Zoning Ordinance unless specifically excepted.
7. Proposed ground signage shall meet the minimum requirements of Section 60 of the
Zoning Ordinance and is contingent upon approval of a separate building permit with
Building Services.
8. All onsite electrical conductors associated with new construction shall be located
underground.
9. Uses shall conform in operation, location, and construction to the following
performance standards in Section 55 of the Zoning Ordinance: noise, smoke and
particulate matter, odorous matter, fire or explosive hazard material, toxic and noxious
matter, vibration, and/or other performance standards.
10. All requirements of the City of Grapevine soil erosion control ordinance shall be met
during the period of construction.
6. ADDRESSED. Provide on the plan sheet drawings a written and graphic scale, north arrow and

pattern the areas where parking has been added or amended. Update the table to reflect the
total number of proposed parking spaces. Provide a site data summary table on the plan sheet,
utilize the table format link provided. Provide total lot areas in square feet and acres and open

The subject property is located at 2140 Hall Johnson
Road, Suite 118 and is platted as Block 1, Lot 2, Hall
Johnson Addition. The addition contains 2.441 acres
and has approximately 340 feet of frontage along
Hall Johnson Road
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU14-24 (Ord. 2014-34) to allow the possession, storage, retail sale, and on- and
off-premise consumption of alcoholic beverages (beer, wine, and mixed-beverages) and to
remove the retaining wall at the rear of the property in order to provide additional parking in
conjunction with a restaurant.
The subject site was developed in 2001 as a 22,614 square foot single story multi-tenant
building. The applicant intends to revise the floor plan of a 2,800 square foot restaurant
(Balkan Garden Bistro) to include a kitchen, bakery, dining room, and bar and remove the
retaining wall at the rear of the property in order to provide 13 additional parking spaces.
One hundred and forty (140) parking spaces are required and one hundred and forty (140)
parking spaces are provided.

PRESENT ZONING AND USE:
The property is currently zoned “CC”, Community Commercial District and is developed
with a multi-tenant shopping center.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject site was rezoned in 1984 from “R-1”, Single Family District to “CC”, Community
Commercial District.
• On June 07, 2000, the Site Plan Review Committee (SPRC) approved SP00-06 to
establish a multi-tenant retail center.
• On January 16, 2001, City Council approved CU00-74 (Ord. No. 2001-06) to allow
the possession, storage, retail sale, and on-premise consumption of alcoholic
beverages (beer, wine, and mixed drinks) in conjunction with a Zuroma’s restaurant.
• On May 16, 2001, the SPRC approved CU01-24 to allow revisions to the previously
approved floor plan CU00-74 (Ord. No. 2001-06) of Zuroma’s restaurant.
• On September 18, 2001, City Council approved CU01-44 (Ord. 2001-71) to allow
the possession, storage, retail sale, and off-premise consumption of alcoholic
beverages (beer and wine only) in conjunction with The Connoisseur a gourmet and
fine wine retail store.
• On July 19, 2011, City Council approved CU11-15 (Ord. 2011-30) to allow revisions
to the previously approved floor plan in conjunction with The Flats restaurant.
• On July 16, 2013, City Council approved CU13-17 (Ord. 2013-35) to allow revisions
to the previously approved floor plan and outdoor dining in conjunction with SoCal
Tacos restaurant.
• On June 17, 2014, City Council approved CU14-24 (Ord. 2014-34) to allow the
possession, storage, retail sale, and on-premise consumption of alcoholic
beverages (beer, wine, and mixed beverages), outdoor dining, and outdoor
speakers in conjunction with SoCal Tacos restaurant.

We, Andrew and Kelly Mitchell, are Property Owners within 200 feet of the subject property. We
PROTEST Conditional Use Application CU22-35, Balkan Garden Bistro, and have the following comments.
We OPPOSE this request for the following reasons:
1. Removal of the engineered retaining wall will have substantial and undue adverse effect on the
adjacent residential properties. Our lot is substantially supported by this wal.
Quality of Life will be impacted due to increased noise and increased traffic as well as an impact
on public safety.

There will be environmental impacts due to the removal of 29 large, mature trees which provide
a natural visual buffer against light pollution from the nearby commercial developments
including Balkan Garden Bistro.
