To Whom It May Concern,
This letter is to verify that your request for a conditional use permit located 503 West Northwest
Highway and platted as Lot 2R, Floyd Harris to allow a scooter dealership with sales and service of
new and used scooters, and other equipment and a 17 foot, 6 inch tall pole sign was approved by
City Council on October 18, 2022. This approval is subject to the following condition:
Sales and service of scooters only.
A copy of the approved exhibits are enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.

Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City-approved tax rolls, you received this notice. If you cannot or
do not wish to attend the hearing, the attached form is provided for your
convenience. If owners of more than 20% of the property within 200 feet of the
subject tract object to the case, a 3/4 vote of the City Council is required to approve
the request.
Purpose of Request:
The public hearing is to consider an application submitted by Ridinger Associates, Inc. for
property located at 503 West Northwest Highway, platted as Lot 2R, Floyd Harris
Subdivision. The applicant is requesting a conditional use permit to allow a motorcycle
dealership with sales and service of new and used motorcycles, scooters, and other
equipment and a 17 foot, 6 inch pole sign. The property is currently zoned “HC”, Highway
Commercial District and owned by Wright Century Oak Properties, LLC.
A copy of the site plan is on file with the Department of Development Services or online

PLANNING SERVICES
Legal Description on 8 ½"x11” Sheet
1) Add the metes and bounds description to the sheet provided with
subdivision name and lot, and address. This can be taken from the
submitted 2004 replat of Floyd Harris Subdivision, Lot 2, however, the
metes and bounds information must match the bearings and distances
labeled on all property lines on the dimensional control site plan sheet.
Reconcile all calls between the replat, legal description sheet, and
dimensional control site plan.
All Sheets
1) Update the case number on all sheets in the approval signature blocks to
CU22-41.
2) Add the purpose statement to all sheets, “Conditional use request CU22-41
is a request to amend the previously approved site plan to specifically allow
a motorcycle dealership with sales and service of new and used

3) Number all sheets which sheet is what in the plan set. The only sheet currently
labeled with the sheet number is the dimensional control site plan and it states 1
of 5. We could only count four sheets submitted, excluding the replat: dimensional
control site plan, floorplan, building elevations and existing pole sign elevation.
4) Add title block per site plan checklist to all sheets in the plan set in the lower right-
hand corner of each sheet in the plan set. This block should be located to the left
of the title block.
5) Add approval/signature block should be located to the left of the title block.
6) Clearly label each sheet name within the Title Block (e.g., Site Plan, Floor Plan,
Building Elevation, etc.)
7) No landscape plan or photometric plan is provided. While we understand that there
is only 20 square feet, provide a note stating that the dimensional control site plan
serves as both a site plan and landscape plan. If no outdoor illumination changes
are proposed by this change in occupancy, provide a note stating this on the
dimensional control site plan.
Dimensional Control Site Plan – Sheet # 1 of 5
1) Update title block by stating it as the “Dimensional Control Site Plan” “Moxie
Scooters”. Add the lot area in acres and square feet to the title block per the site
plan checklist.
2) Correct the assigned project number from “CU22-xx” to CU22-41 within the
approval/signature block.
3) Correct under CUP Request subheading to: Motorcycle dealership with sales and
service of new and used motorcycles, scooters and other equipment and an
existing 17-foot, 6-inch pole sign.
4) Correct BZA Requests subheading to:
a) Subsection 26.F.3 - Minimum open space of 15%.
b) Subsection 26.F. 4 – Maximum impervious surface area of 85%.
c) Subsection 26.G.3 - Uninterrupted landscaped front yard of 25-feet.
d) Section 53 – Landscaping Requirements.

information has presented per the tables on our Planning Services website.

c) Correct proposed use from “Scooter Sales and Service” to “Motorcycle
dealership with sales and service of new and used motorcycles, scooters
and other equipment.”

a) Bearings and distances on site plan drawing do not mat the 2004 replat.
Legal description provided with other application materials references the
Lot and Subdivision name on the submitted 2004 replat. Review and
correct. These callouts should match.
b) Remove use of grayscale for all utilities and other surrounding
improvements and labels. This makes the drawing hard to read. Only use
black ink.
c) Provide a legend and all symbols used on the site plan drawing.
d) Label and dimension angled and parallel parking stalls onsite.
e) Label and dimension interior dimensions of existing sold waste enclosure.
Callout the enclosures height and screening material. If this existing
enclosure is partially located on the lot to the south, provide a letter from the
owner (even if it is the same owner as the subject site) authorizing its ability
to remain in place.
f) Label existing sidewalks, callout their existing width.
g) If outside speakers are proposed, label and callout each location. A
separate outdoor speaker plan sheet or exhibit will be required as part of
the plan set.
h) Label existing pavement type (e.g., asphalt or concrete) onsite.
i) Label and dimension existing driveways located on West Northwest
Highway.
j) Label all curb return radii of existing driveways.
k) If there are any existing or proposed screening walls or fences along the
property lines, show, label type and height.
l) Remove overhead powerline references from site plan drawing.
m) Relabel “State Highway No. 114” from right-of-way to the north as “West
Northwest Highway.”
n) Label existing standalone sign’s type and height on the site plan drawing.
o) The size of the subject site is labeled twice over the existing building
footprint. This is duplicative. Remove one reference to lot size and replace
with a label of the existing building’s size in square feet and add the height
of the existing building in fee.

PROPERTY LOCATION AND SIZE:
The subject property is located at 503 West
Northwest Highway and is platted as Lot 2R, Floyd
Harris Addition. The property contains 0.230 acres
and has 100 feet of frontage along West Northwest
Highway.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to allow a motorcycle dealership with
sales and service of new and used motorcycles, scooters, and other equipment and a 17
foot, 6-inch-tall pole sign
The subject site was developed in 1971 as a 2,842 square foot single story standalone
commercial building. The property owner intends to revise the floor plan to include a
showroom, service area, storage area, and office space and reface the existing 17-foot, 6-
inch-tall pole sign. Eight (8) parking spaces are required and eight (8) parking spaces are
provided.
If approved, this will be the first reading of an ordinance given the subject site requires
approval of a special exception, due to the existing minimum open space, maximum
impervious area, uninterrupted 25-foot landscaped front yard, landscape requirements,
minimum off-street parking requirements (stall size), and minimum sign setback
requirements. These items will be heard before the Board of Zoning Adjustments at their

the promotion of health and the general welfare; effect on light and air; the effect on the
overcrowding of the land; the effect on the concentration of population; the effect on the
transportation, water, sewerage, schools, parks and other facilities; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council of the City of Grapevine, Texas, did consider the following factors
in making a determination as to whether this requested conditional use permit should be
granted or denied; effect on the congestion of the streets, the fire hazards, panics and
other dangers possibly present in the securing of safety from same, the effect on the
promotion of health and the general welfare, effect on adequate light and air, the effect on
the overcrowding of the land, the effect on the concentration of population, the effect on
the transportation, water, sewerage, schools, parks and other public facilities; and
WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been
satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among otherthings the character of
the existing zoning district and its peculiar suitability for particular uses and with the view to
conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is
a public necessity for the granting of this conditional use permit, that the public demands it,
that the public interest clearly requires the amendment, that the zoning changes do not
unreasonably invade the rights of those who bought or improved property with reference to
the classification which existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
conditional use permit lessens the congestion in the streets, helps secure safety from fire,
panic and other dangers, prevents the overcrowding of land, avoids undue concentration of
population, facilitates the adequate provisions of transportation, water, sewerage, schools,
parks and other public requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas, has determined that
there is a necessity and need for this conditional use permit and has also found and
determined that there has been a change in the conditions of the property surrounding and
in close proximity to the property requested for a change since this property was originally
classified and, therefore, feels that the issuance of this conditional use permit for the
particular piece of property is needed, is called for, and is in the best interest of the public
at large, the citizens of the City of Grapevine, Texas, and helps promote the general health,
safety and welfare of this community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the City does hereby issue a conditional use permit in
accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance
Ordinance No. 2022-064 2
of the City of Grapevine, Texas, same being also known as Appendix "D" of the City Code,
by granting Conditional Use Permit CU22-41 to allow for a scooter dealership (Moxie
Scooters) with sales and service of new and used scooters and other equipment, and a 17
foot, 6-inch-tall pole sign in a district zoned "HC", Highway Commercial District within the
following described property: Lot 2R, Floyd Harris Addition (503 West Northwest Highway)
all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73,
attached hereto and made a part hereof as Exhibit "A", and all other conditions,
restrictions, and safeguards imposed herein, including but not limited to the following: New
and used scooter sales and service only.
Section 2. That the City Manager is hereby directed to amend the official zoning
map of the City of Grapevine, Texas, to reflect the herein conditional use permit.
Section 3. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City of
Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of
Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the normal business, commercial
needs and development of the community. They have been made with reasonable
consideration, among other things, of the character of the district, and its peculiar suitability
for the particular uses and with a view of conserving the value of buildings and encouraging
the most appropriate use of land throughout the community.
Section 5. That this ordinance shall be cumulative of all other ordinances of the
City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those ordinances which are in
direct conflict with the provisions of this ordinance.
Section 6. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of the zoning affecting any portion of the tract or tracts of
land described herein shall be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the tract or tracts of land described herein.
Section 7. That any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum
not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.

Section 8. That this ordinance shall become effective from and after the date of
its final passage.
