Cox, am a Property Owner within 200 feet of the subject property. I PROTEST Conditional Use Application CU22-35, Balkan Garden Bistro, and have the following comments: The Large Engineered Retaining Wall and Loss of Protected Trees. The general description of the proposed use given by the Applicant and Property Owner in Part 2 of their Site Plan Application Form "B" is: "We would like to MOVE a retaining wall at the rear of the property in order to add more parking to the retail center." (capitalization added) This is inconsistent with the draft Ordinance 2022-063, the Site Plan sealed by Opeyemi Durosawo dated September 9, 2022 (the "Site Plan"), the Code Compliance Plan sealed by David Contreras AIA dated October 29, 2021(the "Compliance Plan"), the Photometric Plan dated July 22, 2022 (the "Light Plan"), the Proposed Landscape Plan sealed by Jeremy Roach dated September 9, 2022 (the "Landscape Plan"), which all provide: "TO REMOVE THE RETAINING WALL AT THE REAR OF THE PROPERTY, PROVIDE ADDITIONAL PARKING" I have attached a photo of the section of the retaining wall at the rear of the property. It is an engineered retaining wall that is between 4 feet tall on the west end and 12 to 14 feet tall on the east end. I object to the movement or removal of this retaining wall as violative of the standards that may be considered in determining whether a Conditional Use may be granted under Subsection F, Parts 2, 3, and 9 of Section 48 of Grapevine's Zoning Ordinance as the movement or removal or the retaining wall will have a substantial and undue adverse effect on the adjacent residential properties whose properties are elevated between six (6) and fourteen (14) feet above the proposed parking spaces, which increase parking in the subject property by only six (6) spaces. With no engineered retaining wall plans or temporary construction and permanent easement being provided with the site plan to establish how this proposed CUP would avoid risking public safety and the general welfare, interfering with the use of neighboring residential property owners whose lots are substantially supported and maintained by the existing retaining wall, and destroying twenty-eight (28) protected trees (see Chapter 52 of Grapevine's Zoning Ordinance) with an average caliper size of seven (7) inches and heights over twenty-five (25) feet, Conditional Use Application CU22-35 MUST BE DENIED. The large, mature grouping of protected trees on top of the existing large retaining wall provides the Belfort Estate subdivision (especially the adjacent lots, including mine) with a substantial and beautiful natural buffer against light and sound pollution from the nearby commercial developments, including the subject property. Even if replacement trees are planted, the existing canopy, shade and noise protection will be lost. Increasing the number of parking spaces will increase traffic behind the commercial area and adjacent to our property. Increased traffic will produce unacceptable noise levels and the secluded parking spaces will create public safety issues. Previous tenant's employees would have after-hours get togethers to listen to loud music, consume alcoholic beverages and smoke marijuana (smell drifts into our backyard). • Approval of the conditional use permit will also have negative impact on property values within the neighborhood due to the previously stated issues. What is the fix for this? 2.The removal of 29 trees that are a part of the current retaining wall, will certainly have an environmental impact to the homes directly behind the retaining wall. These trees provide both a noise abatement and visual beautification benefit to the homes directly behind the retaining wall. What will be the fix for this?
