SUBJECT: ZONE CHANGE REQUEST Z08-13 AND CONDITIONAL USE
REQUEST CU08-35
RECOMMENDATION:
Staff recommends the City Council and the Planning and Zoning Commission accept the
applicant's request to table zone change request Z08-13 and conditional use request
CU08-35 to the February 17, 2009 meeting, and take any other action necessary.
BACKGROUND:
An application for a zone change to rezone 15.98 acres from "BP" Business Park District
and "CC" Community Commercial District to "MXU" Mixed Use District for a mixed use
project that includes a four-story, 368-unit apartment complex and approximately 80,000
square feet of office and retail space was submitted by Mr. Gary Hazlewood on property
located near the southwest intersection of East Wall Street and Texan Trail. In addition, a
conditional use request was also submitted to reduce the size of the existing planned
business park to accommodate that portion of the business park that is proposed to be
rezoned to"MXU" Mixed Use District. The applicant is requesting to table both requests to
the next scheduled joint public hearing date, February 17, 2009, due to changes
associated with the site plan for the mixed use project. See the attached email from Mr.
Hazlewood's associate, Chris Leighton.

TABLE PUBLIC HEARING DUE TO PLAT NON-COMPLIANCE
LOTS 1 RA & 2R, BLOCK 3,
LOTS 2R, 3, 4, 5, BLOCK 4, GRAPEVINE STATION
(BEING A REPLAT OF LOTS 1 R, 2, 4 & 5, BLOCK 3, AND LOT 2,
BLOCK 4, GRAPEVINE STATION)
RECOMMENDATION:
City Council and the Planning and Zoning Commission table the Public Hearing for the
Final Plat of Lots 1 RA& 2R, Block 3 and Lots 2R, 3,4, 5, Block 4, Grapevine Station to the
February 17, 2009 meeting, and take any necessary action.
BACKGROUND:
The applicant for the final plat has requested that its zone change request Z08-13 and
conditional use request CU08-35 be tabled to the February 17, 2009 meeting.
With this request to table the public hearing, the final plat submittal does not comply with
the City's current platting requirements and cannot be considered by the City Council and
Planning and Zoning Commission for approval.
The final plat is a replat and requires a public hearing which has already been advertised
in the Ft. Worth Star Telegram for January 20, 2009.
Since the plat is not acceptable for consideration in its current format with the existing
zoning, the requirement for action on plat submittals within 30 days of submittal is not in
effect.
Staff recommends tabling the final plat public hearing to coincide with the public hearing
date for the zone change and conditional use request.

Ron,
Per our conversation, we would like to respectfully request postponing
our scheduled City Council presentation from January 20th to the
February meeting set for Tuesday February 17th, 2009.
