TRIPLETT JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA22-06 323 WEST NORTHWEST HIGHWAY MEETING DATE: MONDAY, MARCH 7, 2022 BACKGROUND INFORMATION: The City Council at their January 18, 2022 meeting approved on the first reading of an ordinance, conditional use permit CU22-05 and planned development PD22-02 on the subject site to allow for a 20-foot pole sign and a five-foot landscape setback adjacent to the east property line of the subject site. The application was submitted by Gary Skotnicki on behalf of property owners, Bob and Norma Duane. REQUEST: The applicant intends to expand the existing Dalton Oil Building into a 2,694 sq. ft. single-story office building for Mi Mutual Mortgage Company. The required front-yard setback for the “HC” Highway Commercial District is 25 feet. The existing attached service canopy at 323 West Northwest Highway encroaches 15 feet within the required front-yard setback. The current proposal desires to stay within the existing front-yard setback adjacent to the north property line and the expansion to the proposed professional office will not increase or decrease the existing front-yard setback. The following special exception is requested: Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant is requesting a special exception to allow the existing service canopy structure to remain as developed within the front yard as shown on the plot plan. SPECIAL CONDITION: Staff finds that a special condition exists for the requested special exception. Specifically, the subject lot is an existing developed lot and the existing non-residential structure’s service canopy is original and remains integral to the former service station. Demolition of the service canopy reduces the historical significance of the structure on the property. RECOMMENDATION: Staff recommends the Board of Zoning Adjustment approve a special exception to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses and Structures to allow for the service canopy to remain along with an expansion as shown on the plot plan.
