RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the following special
exception to Grapevine Comprehensive Zoning Ordinance 82-73 for property located at
1720 Sagebrush Trail, legally described as Lot 9, Block 1, Hood Ridge Estates as follows:
Section 42.C.3, Supplementary District Regulations, Accessory Buildings requires
accessory buildings in a residential district be located on the rear one-half of the lot
and at least 10 -feet from any dwelling or building.
The applicant is requesting a special exception to allow construction of an accessory
structure to be used as a garage to be located in the front one-half of the lot and if
approved by the Board would allow a detached garage in the front one-half of the lot.
SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically,
requiring placement of a detached garage in the rear yard is impractical because of the
location of the dwelling on the subject site, the existence of a swimming pool in the rear
yard and the lot is not a typical cul-de-sac configured lot.
BACKGROUND INFORMATION:
The existing dwelling was built in 1979 and the carport and swimming pool were built in
2004 and 2009 respectively. The available required front yard far exceeds the minimum
required setback of 30 -feet. The 1,440 square foot detached garage will meet all other
ordinance requirements. The application was submitted by the property owner Joji Sauer.

C. ACCESSORY BUILDINGS:
An accessory building not exceeding one story in height may occupy not
more than sixty (60) percent of a minimum required rear yard.
2. An accessory building exceeding one story or more in height may occupy not
more than forty (40) percent of a minimum required rear yard.
3. An accessory building attached to the main building shall be made
structurally a part and have a common wall with the main building and shall
comply in all respects with the requirements of this Ordinance applicable to
the main building. Unless so attached, an accessory building in a residential
district shall be located on the rear one-half of the lot and at least ten (10)
feet from any dwelling or building existing or under construction on the same
lot or any adjacent lot. In all residential districts, a building or structure
attached to the principal building or structure by only a breezeway having a
maximum width of six (6) feet shall be considered as being a detached
accessory building or structure. No accessory building shall be located
nearer than three (3) feet to any side or rear lot line. In the case of a corner
lot, no accessory building shall be located within any side yard required on
the street side. A garage, detached from the main building, may be located
no nearer than six (6) feet to any rear lot line and shall be subject to the
same side yard requirements as the principal structure.
4. No swimming pool shall be located nearer than six (6) feet to any rear lot line
and shall be subject to the same side yard requirements as the principal
structure. Below ground swimming pools may be located no nearer than six
(6) feet to the side lot line adjacent to the street. On corner lots that require a
side yard to be the same as required for the front yard, pools shall be located
no nearer than fifteen (15) feet to the side lot line adjacent to the street.
Swimming pools may be located nearer than ten (10) feet from any dwelling
or building existing as long as the excavation of the swimming pool does not
in any way harm or endanger the existing building or dwelling.
D. CORNER LOTS: On corner lots, the side yard on the street side shall be the same
as required for the front, except on corner lots adjacent to a segment of a side street
upon which no property fronts, said segment being defined as that portion of a
street between one street intersection and the next, the minimum side yard shall be
fifteen (15) feet. This regulation shall not be so interpreted as to reduce the
buildable width of a corner lot of twenty-eight (28) feet, nor to prohibit the erection of
an accessory building on such lot where the regulation cannot be reasonably
complied with.

To whom it may concern,
Hello, my name is Joji Sauer and I am writing this letter to ask leniency on this garage
addition. It all started about 7 years ago with remodeling on the property. My wife,
Regina Sauer, worked at home and needed an extra work room as her office, so she
decided to convert the garage into an extra room and took a small bed room as her office.
Meanwhile she planned to install a garage in the front yard, there for she was asking
many questions from the city inspectors. She was told that building the garage in her front
yard would be no problem as long as it was just a garage. Well, three years ago she found
out that her cancer has returned and was in her brain. She was told she had a year to
live..... From kindness of her loving heart, she decided to install a pool in the back yard
for the kids and at the same time leveled the front yard for the garage. She survived two
years and got to see us swim in the new pool, but she was: worried that she did not have
enough time to finish the garage addition. I told her to leave the garage to me and that I
would finish it for her. She then passed away two weeks later. It has been almost a year
since she passed and I have done most of her to do list but, I still have not finished her
last request, which is to install the garage. Please help me put a closer to her dream so that
the our family could cherish and enjoy her love filled house for the remainder of our
lives.

Staff recommends the Board of Zoning Adjustment approve the following special

1720 Sagebrush Trail, legally described as Lot 9, Block 1, Hood Ridge Estates as follows:

SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically,
requiring placement of a detached garage in the rear yard is impractical because of the
location of the dwelling on the subject site, the existence of a swimming pool in the rear
yard and the lot is not a typical cul-de-sac configured lot.
BACKGROUND INFORMATION:
The existing dwelling was built in 1979 and the carport and swimming pool were built in
2004 and 2009 respectively. The available required front yard far exceeds the minimum
required setback of 30 -feet. The 1,440 square foot detached garage will meet all other
ordinance requirements. The application was submitted by the property owner Joji Sauer.

On December 8, 2010, the Building Official issued a written determination that the
billboard could not be "moved, altered, or adjusted." As you affirmed during the hearing,
that determination was never challenged. Contrary to this determination, the billboard
was in fact altered through the removal of a four foot section of the billboard. No permit
was sought or obtained for the work on the billboard. The billboard previously held the
status of being legal nonconforming. As a result of the non -permitted and illegal work on
the sign, the billboard lost its legal nonconforming status and is now an illegal billboard.
By denying your request to overturn this determination, the Board affirmed the decision
of the building official.

The Board denied the following request:
Section 43.13.2., Nonconforming Uses and Structures, Termination of Nonconforming

Comprehensive Zoning Ordinance requiring a variance. The Board ruled that no special
condition existed to support the requested variance or special exception. The hardship in
question was self imposed. The variance sought to continue an illegal use, and use based
variances are not permitted by law.

RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment reconsider and approve the following

located at 1720 Sagebrush Trail, legally described as Lot 9, Block 1, Hood Ridge Estates
as follows:

The applicant is requesting a special exception to allow construction of an accessory
structure to be used as a garage to be located in the front one-half of the lot and if
approved by the Board would allow a detached garage in the front one-half of the lot.
SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically,
requiring placement of a detached garage in the rear yard is impractical because of the
location of the dwelling on the subject site, the existence of a swimming pool in the rear
yard and the lot is not a typical cul-de-sac configured lot.
BACKGROUND INFORMATION:
On August 1, 2011 the Board of Zoning Adjustment found that a special condition existed
for the special exception request on the subject site. After testimony from Mr. Bennett of
2102 Sagebrush Trail, the Board imposed an additional condition on the site plan which
required the detached garage to be 27 -feet from the west property line and meet all other
required setbacks. After a discussion with the applicant and confirmation from Mr. Bennett,
staff has concluded that the site plan which was taken to the Board on August 1, showed
the garage in the location agreed to by the applicant and Mr. Bennett and that Mr. Bennett
had no desire to see the garage moved an additional twelve feet. The existing dwelling
was built in 1979 and the carport and swimming pool were built in 2004 and 2009
respectively. The available required front yard far exceeds the minimum required setback

of 30 -feet. The 1,440 square foot detached garage will meet all other ordinance
requirements. The application was submitted by the property owner Joji Sauer.

To whom it may concern:
I am responding about the Joji Sauer Case # #BZA11-06.
I was at the Aug 1st Zoning hearing. I live in the house at 2102 Sagebrush Trl. The first house to the east of Mr.
Sauer. In the meeting I presented photos and spoke of my concerns as to the location of the proposed garage at
1720 Sagebrush TH. I explained that Mr. Sauer and I had agreed that he would move the garage 10 feet further
away from my house. In the meeting the contractor showed plans with the garage 15 feet from our property line.
The council agreed he could build the garage if he moved it 12 feet further from the property line. Making the
total 27 feet.
What we didnt realize was the 15 feet presented he had already moved the garage the 10 feet that Mr. Sauer
and I had agreed upon. I don't feel the garage need to be any further away from the property line than the 15
feet on the plan. Mr. Sauer has staked out the location with the 15 foot setback for the garage and I find the
location acceptable.
