remain as developed along with pavement expansion to the rear of the building adjacent to
the north property line and landscaping improvements adjacent to William D. Tate Avenue as
shown on the plot plan.

PROJECT DESCRIPTION: CU22-38; Harbor Freight– submitted by Beall Grapevine Center for property located at 1250 William D. Tate Ave. and platted as Block 1, Lot 2, Towne Center Addition. The applicant is requesting a conditional use permit to amend the previously approved site plan of CU17-22 (Ord. 2017-75) for retail sales of secondhand goods in an enclosed building where the size of the space exceeds 3,000 square feet and a 20-foot pole sign, specifically to allow expansion of pavement area to the rear of the suite space and the addition of a roll up door and dock. This property is currently zoned “CC”, Community Commercial and is owned by Beall Grapevine Center, LLC.
Section 43.E.3, Nonconforming Uses and Structure allows was the Board of Zoning Adjustment
to approve the remodeling and/or enlargement off a nonconforming use. The applicant s ubmitted BZA application for several variances to allow an increase of impervious surface area, a decrease in landscaping, and a decrease in rear yard setback.

MEMORANDUM PLANNING SERVICES MEMO TO: BOARD OF ZONING ADJUSTMENT FROM: ERICA MAROHNIC, DIRECTOR PLANNING SERVICES ALBERT L. TRIPLETT JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA22-11 1250 WILLIAM D TATE AVENUE MEETING DATE: MONDAY, OCTOBER 3, 2022
BACKGROUND INFORMATION: The Site Plan Review Committee at their August 18, 2022 meeting approved Conditional Use Permit CU22-38 on the subject site to allow for expansion of pavement area adjacent to the north elevation and the addition of a roll up door and dock to an existing commercial multitenant building. The approval was conditioned to remove existing parking spaces along William D Tate Avenue frontage and replacing with a landscaped front yard to create a landscape set back area. The application was submitted by Robert Beall on behalf of property owners, Beall Grapevine Center, LLC.
REQUEST:
The applicant intends to remove 2,280 square feet of landscaping to expand pavement adjacent to the north property line. The expanded pavement is to allow delivery space to the rear of the existing multi-tenant structure specifically for the proposed Harbor Freight suite. In addition to the expanded pavement, the applicant is revising the north elevation to add an 8’x10’ roll up door and 3-foot-wide door. Furthermore, the applicant is proposing landscaping improvements along the south property line adjacent to William D. Tate Avenue. Landscape improvements include 2 new trees, replacement of 51 bushes, and converting existing parking spaces into a landscape set back area. Total required parking is 271 parking spaces; 324 parking spaces are provided. The subject site requires approval of a special exception by the Board of Zoning Adjustment to allow deviation from minimum open space; maximum impervious surface area; side yard setback; and minimum landscaping requirements per Section 53 of the zoning ordinance on the subject site. The subject site does not meet the following requirements:
• Subsection 25.F.2 Minimum Open Space, of Section 25.F Density Requirements, of Section 25, “CC”, Community Commercial District stipulates that at least 20% of the total lot area shall be devoted to open space. The subject site is proposed to have approximately 19,866 square feet of open space including the landscaping in the rear, side, and front yard which equals 7% of the total lot area.
• Subsection 25.F.4 Maximum Impervious Surface, of Section 25.F Density

Requirements, of Section 25, “CC”, Community Commercial District stipulates the combined area occupied by all main and accessory structures, parking, storage, loading, and all other paved areas shall not exceed 80% of the total lot area. The subject site is proposed to have approximately 268,528 square feet of impervious area or 93% of the total lot area.
• Subsection 25.G.4 Side Yard, of Section 25.G Area Regulations, of Section 25,
“CC”, Community Commercial District requires that every lot shall have two (2) side yards, each of which shall be not less than 20 feet in width. The existing multi-tenant building is developed along the west property line and encroaches 20 feet within the required side-yard setback.
• The existing subject site with the proposed changes does not meet all landscaping requirements of Sections 53.H.1 Interior Landscaping, 53.H.2 Perimeter
Landscaping, and 53.I Non-Vehicular Open Space. The current proposal desires to stay within the existing side-yard setback adjacent to the west property line, and deviate from the required minimum open space, maximum impervious surface area, and landscaping regulations of section 53.H.1, 53.H.2 and 53.I. The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant is requesting a special exception to allow the existing multi-tenant building to remain as developed with proposed improvements as shown on the plot plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically, the existing non-residential structure on the subject lot was developed in 1980 prior to the rezoning of the subject site in the 1984 city-wide rezoning to the “CC”, Community Commercial District.
RECOMMENDATION: Staff recommends the Board of Zoning Adjustment approve a special exception to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses
and Structures to allow for the existing multi-tenant building to remain as developed along with pavement expansion to the rear of the building adjacent to the north property line and landscaping improvements adjacent to William D. Tate Avenue as shown on the plot plan.

The next Board of Zoning adjustment is on Monday, October 3, 2022.
To determine the required parking space count, we will need additional information. Provide the
square footage of each suite space along with a breakdown of the square footage that is publicly
accessible and the amount of space that is used for office space and/or back storage. Also, include a
tenant schedule for hours of operation for each business.
I am happy to schedule a meeting for us to sit down and discuss the parking count and what items
we will need to move forward. Please let me know a time that works for you.
Please respond to this email with confirmation that you understand BZA22-11 will not be moving
forward for the September 12, 2022 hearing as revised plans are needed. BZA22-11 will be noticed
for the next BZA meeting on October 3, 2022.

I am not sure that I will have the ability to get the engineering firm to update those plans by noon
this coming Monday.
Also, besides the landscaping, it would seem that the plans now need to indicate that the site plan
no longer meets the City of Grapevine ordinance on parking. Thus, do the tables and Notes on the
plans now need to reflect that the CU will be a variance to that Parking Ordinance (I am not sure of
that Code Number)? If so, I need the engineering firm to update the tables, the exceptions to
current ordinances that are not being met by these new conditions, along with redrawing the
landscape area along William D. Tate.
If all of that can’t be drawn up and submitted by noon on Monday, would this just move to the
following BZA meeting? If so, when would that meeting be held?

At this point in time, I would say that we need to stay on that schedule for September
12. There is going to have to be a lot of discussion about this between now and then
as the requirements the conditions required by the city violates the conditions of the
leases.
I am currently out of the country and do not have an efficient way to get all of the
parties to understand the problems with this until I return.
I think we just have to stay on the schedule for September, and we’ll have to let you
know later if we need more time or have to withdraw the request.
The tenant’s requirements are for an adequate loading/ unloading area, and for
adequate parking. The city conditions to solve one issue violates the terms of the other.

As I think about this more, I was only thinking about what the Harbor
Freight Tools lease has to say about parking requirements. As I think
about this more, every tenant is going to have to agree to amend their
lease regarding parking as it will be below the retail standard of 4 per
1000 square feet.
So, even if Harbor Freight Tools decides to move forward, we are going to
have to find out if JoAnn, Dollar Tree and Petco are willing to allow that
parking space reduction.

Conditional Use request CU22-38 for Harbor Freight suite at
1250 William D. Tate Avenue was approved with conditions
this morning at the Site Plan Review Committee meeting.
The approval is with the condition that 25 parking spaces
adjacent to William D. Tate Avenue would be converted into
a parking island with landscaping. We will need to review
and discuss parking counts and what changes will need to be
made to the plan set. I would like to set up a meeting at
your earliest convenience to discuss next steps in moving
