A special exception to the Grapevine Comprehensive Zoning Ordinance 82-73, Section
43.E.3, Nonconforming Uses and Structures to allow for the commercial structure and site to
remain as developed as shown on the plot plan.

MEMORANDUM PLANNING SERVICES MEMO TO: BOARD OF ZONING ADJUSTMENT FROM: ERICA MAROHNIC, DIRECTOR PLANNING SERVICES ALBERT L. TRIPLETT JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA22-14 503 WEST NORTHWEST HIGHWAY MEETING DATE: MONDAY, OCTOBER 3, 2022
BACKGROUND INFORMATION: The City Council at their September 20, 2022 meeting approved on the first reading of an ordinance, conditional use permit CU22-41 on the subject site to allow for the sale and service of new and used scooters and a 17-foot, 6-inch-tall pole sign. The subject property is developed with a one-story, 2,842 square foot single story commercial building on a 10,000 square foot (0.230 acre) lot. The lot was developed in 1971 and is platted as Lot 2R, Floyd Harris Addition. The zoning district for the subject property at the time of development was “C-2”, Community Business District, and the property was rezoned to “HC”, Highway Commercial District in the 1984 City-wide rezoning. The most recent occupant of the building was Gourmet Apples & More, Inc. The application was submitted by Jason Kilpatrick, Ridinger Associates, Inc., the representative for the property owner Wright Century Oak Properties, LLC.
REQUEST: The applicant does not intend to make any exterior changes to the existing building or the site layout as it currently exists today, except to reface the existing 17-foot, 6-inch-tall pole sign. A special exception is needed to memorialize the location of the existing building and other site improvements as they exist today with deviations from Section 26, “HC”, Highway Commercial District, Section 53, Landscaping Requirements, Section 54, Masonry Requirements, Section 56, Off-Street Parking Requirements, and Section 60, Sign Standards. The subject site does not meet the following requirements:
• Subsection 26.F.3, Minimum Open Space, of Section 26.F, Density Requirements, of Section 26, “HC”, Highway Commercial District stipulates that at least 15% of the total lot area shall be devoted to open space. The existing development includes approximately 20 square feet of open space which equals 0.2% of the total lot area.

• Subsection 26.F.4, Maximum Impervious Surface, of Section 26.F, Density
Requirements, of Section 26, “HC”, Highway Commercial District stipulates the combined area occupied by all main and accessory structures, parking, storage, loading, and other paved areas shall not exceed 85% of the total lot area. Almost the entirety of the site is covered with building area or other impervious surface area, approximately 9,980 square feet or 99.8% of the total lot area.
• Subsection 26.G.3, Front Yard, of Section 26.G, Area Regulations, of Section 26,
“HC”, Highway Commercial District requires that every lot shall have a front yard of not less than 25 feet and be used as a landscaped area consisting of grass, shrubbery, vines or trees except for minimum access for driveways and sidewalks. The entirety of the 25-foot front yard setback consists of paved area.
• Subsection 53.H.1, 53.H.2, and 53H.I, of section 53, Landscaping
Requirements enumerates multiple requirements for the minimum landscaped area within the parking and vehicular use areas, perimeter landscaping, and non-vehicular open space. None of these standards are met with the current development as it consists primarily of paved area throughout the lot.
• Section 54, Masonry Requirements requires that all buildings within the “HC”, Highway Commercial District shall be of exterior fire-resistant construction having at least 70% of the total exterior walls, excluding doors and windows, constructed of a masonry material or exterior wall insulation and finish system product in accordance with the City’s Building and Fire Codes. Although three sides of the existing structure meet this requirement, the south-facing elevation is completely comprised of Metal R-Panel, resulting in a total façade of 63% brick and 37% Metal R-Panel, excluding doors and windows.
• Subsection 56.A.2, Minimum Off-Street Parking Requirements of Section 56, Off-
Street Parking Requirements, stipulates that each parking space shall have a minimum size of 9 feet wide by 18 feet deep for each angular head-in parking space. The typical angular head-in parking space that exists onsite is 8.8 feet wide by 18 feet deep.
• Subsection 60.J.5, Required Setback, of Section 60.J, HC Highway Commercial
District, of Section 60, Sign Standards requires that on-premise (pole) signs maintain a minimum setback from all property lines of 10 feet. The existing 17-foot, 6-inch-tall pole sign is 8.8 feet from the front (northern) property line and 2.24 feet from the side (eastern) property line. The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant is requesting a special exception to allow the existing commercial structure and site to remain as developed as shown on the plot plan.

SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically, the subject site is an existing developed lot and the structure was built in 1971 prior to the rezoning of the property in the 1984 City-wide rezoning to an “HC”, Highway Commercial District. Currently and as proposed, the site is not compliant with Zoning Ordinance (82-73) relative to the existing minimum open space, maximum impervious area, uninterrupted 25-foot landscaped front yard, landscape requirements, minimum off-street parking requirements (stall size), masonry standards, and minimum sign setback requirements.
RECOMMENDATION: Staff recommends the Board of Zoning Adjustment approve a special exception to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses
and Structures to allow for the commercial structure and site to remain as developed as shown on the plot plan. /em
