This letter confirms that on October 3, 2022 the Board of Zoning Adjustment approved the
following request for the property located at 1237 Airline Drive:
A special exception to the Grapevine Comprehensive Zoning Ordinance 82-73, Section
43.E.3, Nonconforming Uses and Structures to allow for the residential property to remain as
developed with a rear primary building addition as shown on the plot plan.

BACKGROUND INFORMATION: The subject property is developed with a one-story, 2,118 square foot single-family detached residence on a 9,729 square foot (0.22 acre) lot. The lot was developed in 1955 and is platted as Block 3, Lot 7, Sky Harbor Addition. The zoning district for the subject property at the time of development was “R-1”, Single-family Dwelling District and the property was rezoned to “R-7.5”, Single-Family District in the 1984 City-wide rezoning. The application was submitted by Randall Garret, property owner.
REQUEST:
The applicant intends to expand the existing single-family detached residence by 637 square feet for an owner’s retreat (e.g., master bedroom, bathroom, and utility room) to the rear of the existing building. BZA22-16 is a request for a special exception to allow the residential dwelling to remain as developed with an approximately 4.5- foot side yard to the east and west property line. The applicant intends to step back the owner’s retreat addition to the east slightly to meet the required 6-foot side-yard setback required of the “R-7.5” district. The subject site does not meet the side yard requirement for “R-7.5”, Single Family Residential District. Subsection 15.G.3, Side Yard Requirements of Section 26.G Area Regulations, Of Section 26 “R-7.5” Single Family Residential requires that every lot have a side yard on each side of 6-feet, the existing residential structure is approximately 4.5 feet from the east and west property line and encroaches approximately 1.5 feet into the required side yard setbacks. The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant is requesting a special exception to allow the existing residential structure to remain as developed along with an expansion as shown on the plot plan.

SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically, the subject lot is an existing developed lot and the dwelling was built in 1955 prior to the rezoning of the property in the 1984 City-wide Rezoning to an “R-7.5”, Single-Family District. Currently and as proposed, the site is not compliant with Zoning Ordinance (82-73) relative to the required 6-foot side yard setback adjacent to the east and west property lines. The proposed expansion of the dwelling does not exacerbate the existing side yard setback adjacent to the east and west property line of approximately 4.5 feet.
RECOMMENDATION: Staff recommends the Board of Zoning Adjustment approve a special exception to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses
and Structures to allow for the residential property to remain as developed with a rear primary building addition as shown on the plot plan.

Hi,
Thank you for sharing the plan documents to be presented at tonight's meeting. I own 1243 Airline Drive, the home immediately south of 1237 Airline.
As you can see from the email note below, I have been in touch with James Adams of Grapevine Code Enforcement about 1237 Airline several times over the last year, due to my observations of the 1237 owner's lack of responsibility for the care and safety of his house and our neighborhood. James Adams told me he was going to issue the owner a citation in September, but I am unclear whether that actually happened last month.
Prior to approving this construction plan, I would like to understand:
1. The timeline for completing this project?
2. Proof that the owner is solvent enough to execute this plan on that timeline?
3. How the City of Grapevine will mandate that the owner safely and cleanly maintain the construction site?
4. Can this review board visit this site today - the front and back yard, before making their decision tonight, for insight on the owner's current standard of care for the property?
5. Does the owner plan to live in the house when it is complete?
This owner did work on the foundation and stripped out the inside close to a year ago. Since then, I have observed the house empty, with the front door wide open for days. I have called Grapevine Code Enforcement several times to request the yard be mowed, and the response was the owner has mowed once in six months, and the front yard only. The front yard remains unsightly and the backyard is worse. I have attached pictures of the current backyard, where you can see that the back doors and windows have remained wide open for months, inviting families of possums, rabbits, roaches and other critters to breed. The backyard is a breeding ground for mosquitos and bugs, and is often used by nearby neighbors as a dog park. I have asked James Adams to visit the property at least three times and been told he cannot go into the backyard, thus I took these pictures last month.
I do plan to attend the meeting tonight. See you then.
