Committee on October 6, 2022.
A waiting period of one (1) year between the date an application for amendment to the zoning
ordinance, or a requested change in zoning, is denied by the City Council and a new application for
such a change or amendment is accepted, is hereby established. The one-yearwaiting period shall
be applicable to all requested amendments and changes for the same zoning district, or districts, on

when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.

This property was approved for a CUP on March 3, 2021 (CU21-05). This project is under
construction. The purpose of this letter is to request a few minor changes to CU21-05. The changes are
as follows:
Pages A1.1 and A1.2 of CU21-05 indicates a new 6' wood fence to be built in a heavily wooded flood
plain/way area along the creek and pond to the east of the subject building. This was an oversite on my
part which I did not catch before submitting the original CUP application. Only a small portion of this
proposed new fence shares a boarder with a residential property which is over 400 feet away of heavily
wooded area. Most of the proposed fence shares a border with PO zoning. The ultimate plan is to
develop the balance of my property with small office buildings that would be surrounded by trees and a
view of the pond. A fence would destroy this, and I am sure my neighbors at Lake View Plaza would not
appreciate looking at a fence backing up to their pond feature. They would have to change their building
name to Lake and Fence view Plaza. Many parts of this fence would be in the floodway and floodplain
area and subject to washing away. I would have to take down several trees to build the fence. (see
photos 1-5). This fence requirement has been removed on the attached A1.1 and A1.2.
The approved Building Elevations of CU21-05 show the Southeast elevation (back of the building) as a
22' tall CMU block. When we drew the initial plans over 18 months ago, we planned on using structural
steel and metal roof decking. Due to numerous external forces, we were not able to secure these
building materials and had to use wood. As a result, we needed to reduce the weight of the rear wall by
finishing the remaining 47' with a lighter material. This 47' of wall serves as screening for the RTU's.
We are proposing to use metal 'R' Panels just like Tom Thumb is using next door. (see photo 6). The new
proposed elevation is shown on A3.2 attached.

PROJECT DESCRIPTION: CU22-34; Fresenius Kidney Care – submitted by Jim Makens for property located

requesting a conditional use permit to amend the previously approved site plan of CU20-03 (Ord. 2020-
15) for the development of a 13,000 square foot retail building, specifically to allow a change to the south
building elevations to accommodate the use of an “R” panel. The property is currently zoned “CC”,
Community Commercial District and owned by Park/ Wall Office, LLC.

Ensure that within the approval block (2nd example) that it reads, “Planning Services

REQUEST
The applicant proposes changes to the south building elevation to accommodate the
use of an “R” panel. The proposed changes include an “R” panel along the southeast
elevation and a change of exterior building materials from brick and concrete masonry
unit to stucco on the southeast and northeast building elevations.
BACKGROUND INFORMATION
On September 20, 1988 City Council approved CU88-06 (Ord. 1988-74) for
development of a planned commercial center, a 40-foot pole sign to be located at the
corner of Park Boulevard, State Highway 114 and Wall Street, and to allow the Tom
Thumb grocery store (Lot 4) off-premise alcoholic beverage sales. The property is
currently developed with a 1,260 square foot convenience store with four gasoline
pumps, two 20 foot tall pole signs, a 2,500 square foot dry cleaner, an 11,238 square
foot multi-tenant, single story office center, a 60,243 square foot Tom Thumb grocery
store, a 40-foot pole sign, and a 21,118 square foot multi-tenant shopping center.

The subject site was zoned “R-1”, Single Family District prior to the 1984 City-wide
rezoning at which time the subject site was rezoned to “PO”, Professional Office. The
subject property was rezoned to “CC”, Community Commercial with (Z87-02) on
October 17, 1995.
• On July 17, 1990, City Council approved CU90-10 (Ord. 1990-41) with
amendments to allow Tom Thumb on Lot 4 a 3,480 square foot addition to the
entry vestibule, amend the area for beer and wine storage, add temporary
promotional display areas for beer and wine, relocate both store entries and the
handicapped parking spaces to provide several cart storage areas in the parking
islands, and revise the exterior building facades.
• On November 20, 1990, City Council approved CU90-14 (Ord. 1990-76) to allow
gasoline sales, a convenience store with off-premise consumption of alcoholic
beverages, and a car wash at Chevron located on Lot 1.
• On November 19, 1991, City Council approved CU91-20 (Ord. 1991-82) to allow
Tom Thumb on Lot 4 to enlarge the vestibule area by 496 square foot.
• On December 20, 1994, City Council approved CU94-34 (Ord. 1994-108) to
allow on-premise consumption of alcoholic beverages in conjunction with Zuzu’s
Mexican Restaurant located on Lot 5.
• On April 4, 1995, City Council approved CU95-09 (Ord. 1995-24) to allow a
11,238 square foot strip office center on Lot 3.
• On May 21, 1996, City Council approved CU96-11 (Ord. 1996-34) to allow
outdoor storage of wood in conjunction with a restaurant, Sonny Bryans
Smokehouse on Lot 5.
• On June 3, 1997, City Council approved CU97-20 (Ord. 1997-54) to allow a
3,600 square foot building for personal service and retail development on Lot 2.

• On May 17, 2016, City Council approved SU16-01 (Ord. 2016-38) to allow for
massage services on Lot 3R.
• On May 17, 2020, City Council approved CU20-03 (Ord. 2020-16) to allow for
rebranding of the existing Chevron gas station into a Tom Thumb convenience
store and to allow vehicular access between Lots 1 and 2 by creating two new
drive aisles.
• On July 7, 2022, the Site Plan Review Committee approved CU22-27 to allow for
the addition of a standby generator and screening enclosure to the southeast
rear of a planned dialysis clinic.
