The addition contains 2.441 LJ-- 0acres and has approximately 340 feet of frontage ID Glade Rd along Hall Johnson Road. 0 REQUESTED CONDITIONAL USE, PLANNED DEVELOPMENT OVERLAY AND COMMENTS - The applicant is requesting a conditional use permit to amend the previously approved site plan of CU 14-24 (Ord. 2014-34) to allow the possession, storage, retail sale, and on- and off -premise consumption of alcoholic beverages (beer, wine, and mixed -beverages) and a planned development overlav to allow deviation from parking requirements in coniunction with a restaurant. The subject site was developed in 2001 as a 22,614 square foot single -story multi -tenant building. The applicant intends to revise the floor plan of a 2,800-square-foot restaurant (Balkan Garden Bistro) to include a kitchen, bakery, dining room, and bar. At the time of the approval for CU14-24; SoCal Tacos (Ord. 2014-34), the multi -tenant building's suites were not fully occupied and staff identified that once the building was fully occupied, parking requirements would not be met. To that end, staff required a note to be included on the site plan that stated, "Vacant lease space will be adjusted to accommodate the existing parking." At this time all suites are occupied, except for the subject suite, Suite 118, which based on the tenant schedule of suites, uses, and required parking indicates that the subject site is six parking spaces short. A previous application was submitted, CU22-35, and subsequently withdrawn for a conditional use request to add seven additional parking spaces by relocating the existing retaining wall at the rear (north property line) of the property in order to meet off-street parking requirements for the shopping center. As part of this planned development overlay request, the applicant is requesting that the existing 134 parking spaces remain as provided without adding additional parking elsewhere onsite. The purpose of this request is to acknowledge and leave the existing vegetative growth and mature trees that exist and act as a buffer and habitat for wildlife between the shopping center and the adjacent residential neighborhood to the northwest. Parking History • On June 7, 2000, site plan application SP2000-06 was approved by Development Services staff for a 22,449 square foot retail center. Required parking was determined at one parking space per 200 square feet plus five additional spaces for the whole center, for a total required of 118 parking spaces, 134 parking spaces were provided. • On January 16, 2001, City Council approved C000-74 (Ord. No. 2001-06) to allow the possession, storage, retail sale, and on -premise consumption of alcoholic beverages (beer, wine, and mixed drinks) in conjunction with a Zuroma's restaurant in Suite 118. The required parking for the restaurant was 34 parking spaces for a 2,800 square foot (or 107-person occupancy) restaurant space. The rest of the retail center was shown as retail, 19,649 square feet which requires 98 parking spaces. Therefore, 132 parking spaces were required with one restaurant on site. • On July 19, 2011, City Council approved CU11-15 (Ord. 2011-30) to allow revisions to the previously approved floor plan in conjunction with The Flats restaurant located in Suite 118 which accommodated 93 seats and 31 parking spaces were required, 134 were provided on site. • On July 16, 2013, City Council approved CU 13-17 (Ord. 2013-35) to allow revisions to the previously approved floor plan and outdoor dining in conjunction with SoCal Tacos restaurant, Suite 118. The remodel of the suite resulted in a 76-seat restaurant (66 seats indoors, 10 seats outdoors), requiring 26 parking spaces. On June 17, 2014, City Council approved CU14-24 (Ord. 2014-34) to allow the possession, storage, retail sale, and on -premise consumption of alcoholic beverages (beer, wine, and mixed beverages), outdoor dining, and outdoor speakers in conjunction with SoCal Tacos restaurant, Suite 118. The required parking for the restaurant was 25 parking spaces for a 74-seat restaurant (both indoor and outdoor seating). These requirements establish standards for the functional design of efficient parking facilities and reduce congestion and minimizes external effects on neighboring properties. However, a parking supply designed directly from the City code does not comprehensively consider shared parking opportunities inherent to mixed -use developments. There was always sufficient available parking in the various areas; in fact the area defined as "Zone D" was always vacant during our observations. Shown in Tables 2 and 3 below are the observed hourly totals of parked vehicles on Friday and Saturday indicating the actual parking demand for the Center. During the peak parking demand hours on both Friday and Saturday, the lot was projected to occupy not more than 47% of the total parking supply, or 63 spaces. and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this planned development overlay, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this planned development overlay and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this planned development overlay for the particular piece of property is needed, is called for, and is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community.
