HomeMy WebLinkAboutORD 2009-021 ORDINANCE NO. 2009-21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES CHAPTER 7 BUILDINGS AND CONSTRUCTION, ARTICLE I; CHAPTER 21 TAXATION, ARTICLE II CONVENTION & VISITORS BUREAU AND APPENDIX G HISTORIC PRESERVATION RELATIVE TO THE APPOINTMENT OF ALTERNATE POSITIONS AND TERMS OF SAID ALTERNATES; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, there currently exists numerous boards, commissions and committees within the City of Grapevine, Texas, handling a variety of affairs for the City; and WHEREAS, Section 3.07 (f) of the Charter of the City of Grapevine empowers the City council to provide for appointment to such boards and committees; and WHEREAS, the City Council deems it in the best interest of the City to amend the structure of certain boards and committees to provide for additional member positions. NOW, THERFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all of the above premises are found to be true and correct and are incorporated in to the body of this ordinance as if copied herein in their entirety. Section 2. That the Grapevine Code of Ordinances Chapter 7, Article I, Section 7-4 Paragraph 6 relating to the Grapevine Building Board of Appeals and length of terms is hereby amended to read as follows: "Each of the seven citizen members shall occupy a place on the building board of appeals, such places being numbered 1, 2, 3, 4, 5, 6, and 7. Upon approval and adoption of Ordinance No. 99-85 amending this section, places 1, 2 and 3 as appointed June 7, 1994, including any subsequent appointments, shall continue to serve a term of two years. Places 4 and 5, as appointed June 7, 1994 (for a one-year term), including any subsequent appointments, shall continue to serve a term of two years. Places 6 and 7 and the alternate are to be appointed June 1999, and shall serve for a term of two years. Subsequent appointments to places 6 and 7 shall be for a period of two years. The alternate appointment shall be for a period of one year beginning in June, 2009. Terms of the board members shall be staggered two-year terms and all other duties and responsibilities shall be as required by the codes." Section 3. That the Grapevine Code of Ordinances Chapter 21 Taxation, Section 21-28 (b) relating to the creation of the Grapevine Convention & Visitors Bureau Board and appointment of officers is hereby amended to read as follows: "(b) There is hereby established the position of one alternate member of the bureau who shall meet with the bureau and serve in the place and with the full power of a member in the absence of a member." Section 4. That the Grapevine Code of Ordinances Chapter 21 Taxation, Section 21-29 relating to the appointment of the members, term of office and removal from office of members; and filling vacancies is hereby amended to read as follows: "The members of the board shall be appointed by the City Council, and shall serve for a period of two (2) years unless sooner removed; provided, beginning in June, 1994, that three (3) members shall serve two years, and four (4) members shall serve for one year, so that annually thereafter there will be four (4) members appointed in one year for two year terms and three (3) members appointed in the next year for two year terms. The alternate member shall be appointed by the City Council and shall serve for a period of one year beginning in June, 2009. Regular appointments shall be made on the date of the first official City Council meeting in June. The expiration date of each term of office shall fall on the date of the first official City Council meeting in June during the year in which the term shall expire. Any member or alternate member of the board may be removed from office by the City Council for any cause deemed by the City Council sufficient in the interest of the public service. Any vacancy in the membership of the board or the alternate membership shall be filled by the City council for the unexpired term of the member or alternate member whose place has, by removal or otherwise, become vacant. Ex-officio members shall not vote." Section 5. That the Grapevine Code of Ordinances Appendix G, Historic Preservation, Section 3 (c) is hereby amended to read as follows: "(c) Commission members shall serve for a period of two years, their terms to be staggered (four members appointed one year and three members appointed the next year. Initial appointments shall be four for two-year terms and three for one- year terms. The alternate members shall serve for a period of one year beginning in June, 2009." Section 6. That the fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall ORD. NO. 2009-21 2 become effective from and after the date of its passage, and it is accordingly so ordained.
