PROJECT DESCRIPTION: CU22-50; Chicken N Pickle– submitted by CNP7 Real Estate, LLC for

FROM: ALBERT L. TRIPLETT, JR, PLANNER II DATE: NOVEMBER 3, 2022 SUBJECT: CONDITIONAL USE APPLICATION CU22-50, CHICKEN N PICKLE RECOMMENDATION Staff recommends the Site Plan Review Committee (SPRC) consider proposed changes to conditional use request CU21-26 (Ord. 2021-62), specifically to allow for the addition of removable shade structures and modifications to ground surface materials for the dog park and food truck parking area. The property is zoned “CC”, Community Commercial District and owned by CNP7 Real Estate, LLC. REQUEST The applicant proposes to revise the previously approved site plan for the addition of three removable shade sail structures to be placed over a synthetic turf area intended for yard games such as cornhole. These shade sails will cover approximately 2,700 square feet in total area. Additionally, the applicant proposes to revise the ground surface material for the dog park from grasscrete to engineered wood mulch and the food truck parking area from decomposed granite to brick landscape pavers. No additional changes are proposed with this request. BACKGROUND INFORMATION: The subject site and properties to the north, south and east were rezoned in the 1984 City-wide Rezoning from "C-2", Community Business District to "HCO”, Hotel/Corporate Office District, "CC", Community Commercial District, "R-MF-2", Multifamily District, and "CN", Neighborhood Commercial District.
• On December 17, 1991, City Council approved Z1991-12 (Ord.1991-90) to allow a portion of the subject site and the sites adjacent to the north property line to be rezoned from "CN", Neighborhood Commercial District and "HCO", Hotel/Corporate Office District area to "CC", Community Commercial District.
• On November 17, 1992, City Council approved Z1992-08 to allow a portion of the subject site to be rezoned from "CC", Community Commercial District to "GU", Governmental Use District for the development of a fire station.
• On August 16, 1994 City Council approved CU94-16/Z94-11 (Ord.1994-65) to allow

a portion of the subject site to be rezoned from "HCO", Hotel/Corporate Office District to "GV", Grapevine Vintage District for the development of the Delaney Vineyard Wine Production Building.
• On November, 16, 2021, City Council approved CU21-26/Z21-06 (Ord. 2021-62) to allow the subject site to be rezoned from “HCO”, Hotel Corporate Office District to “CC”, Community Commercial District for the development of a planned commercial center with possession, storage, retail sale, and of- and off-premise consumption of alcoholic beverages (beer, wine, and mixed beverages), outdoor entertainment, outdoor dining, outdoor speakers, and an entry gate sign in conjunction with a 19,296 square foot restaurant (Chicken N Pickle). /mz
