following request for the property located at 211 East Wall Street:
A special exception to the Grapevine Comprehensive Zoning Ordinance 82-73, Section
43.E.3, Nonconforming Uses and Structures to allow the existing dwelling to remain as
developed with a front yard encroachment of 3 feet along the southern property line, along
with an expansion and addition as shown on the plot plan.

BACKGROUND INFORMATION:
The City Council at their October 18, 2022 meeting approved on the first reading of an ordinance, zone change request Z22-05 to allow 0.686 acre of land to be rezoned from “HC”, Highway Commercial District to “R-7.5”, Single-Family District. The applicant intends to plat the property into two single-family detached lots, allow for expansion of the existing residence, and construction of a detached garage with workshop on 211 East Wall Street. On 215 East Wall Street, the applicant intends to construct a new residence and detached garage. The subject property at 211 East Wall Street is developed with a one-story, 2,404 square foot single-family detached residence on a proposed 16,952 square foot (0.389 acre) lot. The property was developed in 1950 and is proposed to be platted as Block 1, Lot 1, Green Park Addition. The zoning district for the subject property at the time of development was “C-2”, Multiple-Family Dwelling District and the property was rezoned to “HC”, Highway Commercial District in the 1984 City-wide Rezoning. A master bedroom addition was built on the east side of the house and a metal carport was added to the front of the house in 1963. A small storage building was added in the rear yard in the 1990s. The application was submitted by Ronny Park and Bob Green, on behalf of the property owner The Rylor Group, LLC.
REQUEST:
The applicant intends to restore the existing one-story single-family detached residence and update it for modern living, construct a new addition to the primary structure, and construct a detached two-car garage with workshop to the rear. The following special exception is requested for BZA22-17:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant is requesting a special exception to allow a residential dwelling to remain as developed with a front yard encroachment of 3 feet along the southern property line as

shown on the plot plan.
SPECIAL CONDITION:
Staff finds that special conditions exist for the requested special exception. Specifically, the dwelling was built in 1950 prior to the rezoning of the property in the 1984 City-wide Rezoning to “HC”, Highway Commercial District. The subject site is an existing developed parcel predating the City’s first zoning ordinance adopted in 1955. Currently and as proposed, the existing single-family detached dwelling is not compliant with Zoning Ordinance (82-73) relative to the required front yard setback adjacent to the south property line. Per Subsection G.1, Area Regulations of Section 15, “R-7.5”, Single-Family District Regulations, the minimum depth of a front yard is 30-feet however, the existing dwelling is developed with a 27-foot front yard setback. The applicant is requesting a special exception to allow an encroachment of 3-feet within the required front yard. The proposed expansion of the dwelling and the proposed garage addition does not exacerbate the front yard setback adjacent to the south property line.
RECOMMENDATION: Staff recommends the Board of Zoning Adjustment approve a special exception to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses
and Structures to allow for the existing dwelling to remain as developed with a front yard encroachment of 3 feet along the southern property line, along with an expansion and addition as shown on the plot plan.
