TRIPLETT JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA22-18A and #BZA22-18B 301 EAST WALL STEET MEETING DATE: MONDAY, NOVEMBER 7, 2022 BACKGROUND INFORMATION: The City Council at their October 18, 2022 meeting approved on the first reading of an ordinance, zone change request Z22-04 to allow 0.284 acre of land to be rezoned from “HC”, Highway Commercial District to “R-7.5”, Single-Family District, the applicant intends to use the existing single-family residence developed. The subject property is developed with a one-story, 1,603 square foot single-family detached residence on a 12,366 square foot (0.284 acre) property. The property was developed in 1960 and is proposed to be platted as Block 1, Lot 1, Kennimer Addition. The zoning district for the subject property at the time of development was “C-2”, Community Business District and the property was rezoned to “HC”, Highway Commercial District in the 1984 City-wide Rezoning. The application was submitted by Neal Cooper of Tin Barn LLC., on behalf of the property owner Charlie Kennimer. REQUEST: The applicant intends to utilize the property as a single-family residence and allow for a future addition. The following special exception is requested for BZA22-18A: Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant is requesting a special exception to allow the existing residential dwelling to remain as developed with a side yard encroachment of 1 foot, 2 inches along the east property line as shown on the plot plan. The following variance is requested for BZA22-18B: Subsection 15.G.4, Area Regulations of Section “R-7.5”, Single Family District, requires a minimum lot width of 65-feet. A variance of approximately 2-feet is proposed for the existing parcel width which is approximately 63 feet. Specifically, the dwelling was built in 1960 prior to the rezoning of the property in the 1984 City-wide Rezoning to “HC”, Highway Commercial District. Developed, platted property and right-of-way exist adjacent to the subject site, on the east, west and south property lines eliminating the possibility to expand the site to meet minimum lot width requirements. Currently and as proposed, the site is not compliant with Zoning Ordinance 82-73 relative to the required minimum lot width and side yard setback adjacent to the east property line. The proposed rezoning and replating of the property do not exacerbate the existing parcel width and side yard setback adjacent to the east property line. The applicant understands that any future additions would have to comply with the requirements of the Zoning Ordinance 82-73. RECOMMENDATION: Staff recommends the Board of Zoning Adjustment: 1. Approve a special exception (BZA22-18A) to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses and Structures to allow a residential dwelling to remain as developed with a side yard encroachment of 1 foot, 2 inches along the east property line; and 2.
