Any application for a change in zoning or for an amendment to the zoning ordinance shall have, from the date of submittal, a period of four months to request and be scheduled on an agenda before the Planning and Zoning Commission and City Council. If after said period of four months an application has not been scheduled before the Commission and Council said application shall be considered withdrawn, with forfeiture of all filing fees. The application, along with the required filing fee may be resubmitted any time thereafter for reconsideration. Delays in scheduling applications before the Planning and Zoning Commission and City Council created by city staff shall not be considered a part of the four month period. BACKGROUND INFORMATION On July 19, 1994 Council approved an amendment to the subject site for development of the 2,304 square foot drive through restaurant (Taco Bell). With this request the applicant proposes to upgrade the subject site by adding a new concrete sidewalk, new menu boards and new landscaping features. The applicant proposes to increase accessibility to the subject site by connecting to a new sidewalk to the existing sidewalk which is adjacent to William D. Tate Avenue. The new menu boards are referred to as the "Drive Thru of the Future". The proposed changes to the landscaping includes but is not limited to replacement of hedges which are in close proximity to the drive through lane with a new masonry wall less than five feet high.
