The a 1 addition contains 0.711 acre and has approximately sti DAirport 3 l 321 feet of frontage along South Main Street, 230 Hall -Johnson 060 a I ro feet along Jenkins Street, and 147 feet along East 1 T-----� o _ 1 Wall Street. °' Glade Rd I H _ 0 REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the previously approved site plan of CU14-26 (Ord. 2014-39), specifically to allow the possession, storage, retail sales of on- and off -premise consumption of alcoholic beverages (beer, wine, and mixed beverages), outdoor dining, and outdoor speakers in coniunction with a restaurant. On July 15, 2014, City Council approved CU14-26 (Ord. 2014-39) to establish Cotton Patch Cafe on the subject site. On July 6, 2016, the Site Plan Review Committee approved CU16-16 to allow outdoor seating and one outdoor speaker in conjunction with Cotton Patch Cafe. The applicant proposes establishing a new 3,595 square foot restaurant, Mister 01 Pizza within the same suite space. The proposed seating layout will accommodate 52 patrons; 44 indoors and 8 outdoors. The outdoor seats and two outdoor speakers are proposed along the south building elevation adjacent to West Wall Street and one outdoor speaker is proposed at the restaurant's entrance adjacent to South Main Street. The outdoor speakers' hours of use will coincide with the operating hours of the restaurant and are slated to provide ambient background music for the patrons. Twenty- seven (27) parking spaces are required for the restaurant; 198 parking spaces for the multi -tenant structure. Relative to the building layout, there are 15 parking spaces partially located on the site on the eastern side of the building along Jenkins Street; there are five parallel on -street spaces along the eastern side of Jenkins Street. The applicant intends to utilize the public parking lot at the northeastern corner of Jenkins Street and East Wall Street which contains 141 spaces. Along with another 253 off -site spaces within the immediate vicinity of the subject site, there a total of 414 parking spaces available. Access to the site is provided by public sidewalks adjacent to Jenkins Street, East Wall Street and South Main Street. PRESENT ZONING AND USE: The property is currently zoned "CBD", Central Business District and is developed with a two story 45,958 square foot multi -tenant building. HISTORY OF TRACT AND SURROUNDING AREA: The subject site was rezoned in the 1984 City-wide Rezoning from "C-2", Community Business District to "HC", Highway Commercial District. • On February 19, 2013, City Council approved Z12-11 (Ord. 2013-06) to rezone the subject site from "HC", Highway Commercial District to "CBD", Central Business District for the development of a multi/tenant office/retail building. • On July 15, 2014, City Council approved CU14-26 (Ord. 2014-39) to allow for the sale, storage, retail sales, and on -premise consumption of alcoholic beverages in conjunction with the development of Cotton Patch Cafe within Suite 155. • On July 6, 2016, the Site Plan Review Committee approved CU16-16 to allow outside dining and one outdoor speaker in conjunction with Cotton Patch Cafe within Suite 155. • On March 21, 2017, City Council approved CU17-02 (Ord. 2017-17) to allowforthe possession, storage, retail sales, and on -premise consumption of alcoholic beverages, outside dining and outdoor speakers in conjunction with the development of a restaurant (San Daniele) within Suite 200. and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of Ordinance No. 2022-085 3 CU22-51 said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues.
