All Conditional Use and Special Use Applications are assumed to be complete
when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period

all fixture details shall be submitted as part of the site plan review process.
Applications will not be accepted without this requirement.

DFW HONDA — SHADE STRUCTURE
1. Please add case number CU09-13, the address to the signature
block and provide a revised letter.
2. Please label the sidewalk adjacent to William D. Tate Avenue as
future and label the location and size of the monument sign.
3. Please note that the site plan must be sealed by a registered
surveyor, registered architect, or registered engineer.
4. Please provide a graphic scale and dimension the distance of the shade
structure to the nearest property line.
5. Please note the site/landscape plan should reflect the existing sidewalk,
reduction of shrubs and wood railing adjacent to Grayson Drive as well as
the loss of one parking space due to the sidewalk access.
6. Please add the following note to the site plan: The shade structure shall
be designed to withstand 1-90 wind speeds and shall be non
combustible/flame retardant.
7. Please add the following note to each sheet:
Conditional use request, CU09-13 is a request to amend the
previously approved site plan of CU07-16 SPRC, CU03-04 SPRC,
CU02-18 (Ord. 02-38) for a motorcycle dealership with sales and
service of new and used power generators, lawn equipment,
scooters, ATV's and motorcycles with outdoor display, specifically
to allow an additional shade structure on four (4) parking spaces.
The above comments must be reflected in the revised submittal, which is
due by Thursday, May 21 at 12:00 a.m. for the May 27th public hearing.
Please submit the revised documents to the Department of Development
Services at 200 South Main Street.
The revised submittal shall include:
four (4) folded blackline copies of each sheet, (minimum size 24" x 36")
four (4) reduced copies at 11" x 17" stapled and z -folded (fold the right edge
to the left edge and then fold the right edge in half to form a z -fold)
If these revisions are made and submitted at the correct time, you will be scheduled for
the next available agenda.

Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU02-18 (Ord. 02-38) approved at the May 21, 2002 meeting
for a motorcycle dealership with sales and service of new and used motorcycles, power
generators, lawn equipment, scooters, ATV's, and personal watercraft along with
outside display, specifically for the addition of a motorcycle ramp, shade structures on 4
parking spaces and take any other action necessary.
Conditional use request CU99-77 approved by Council at the February 1, 2000 meeting
approved the establishment of the D/rW Honda dealership and allowed for the sales
and service of new and used motorcycles, generators, lawn equipment, ATV's and
personal watercraft. A subsequent revision was considered and approved by the Site
Plan Review Committee (CU01-09) at their February 21, 2001 meeting which allowed
for a re-routing of the fire lane, enlargement of the plaza area in front of the building and
allowed the addition of a monument sign. The subject site was considered again by
Council at their May 21, 2002 meeting and was approved for outside display in the
plaza area and covered front porch. On March 5, 2003 the Site Plan Review Committee
considered and approved a request on the subject site to allow for a shade structure to
be erected over eight parking spaces located along the western edge of the property.
On September 26, 2007 the Site Plan Review Committee considered and approved a
request on the subject site to add 1,848 square feet to the existing structure, including
662 square feet to the entry and 1,186 square feet to the south elevation which included
second floor storage. The approval also included minor front elevation changes as well
as changes to the shape of the monument sign.
With this request the applicant proposes to add a shade structure to be erected over
four parking spaces located along the western edge of the property. For customer
convenience a motorcycle loading/unloading ramp is planned along that same western
edge of the site. Two -parking spaces are being relocated to the northeast corner of the
site as a result of existing parking being displaced due to the proposed motorcycle
ramp. Parking for this type of use is based on the square footage of the site rather than
building square footage therefore the number of parking spaces shown meets the
parking requirement. Please see the attached letter.

This letter is to verify that your request to amend the previously approved site plan of
Conditional Use Request CU02-18 (Ord. 02-38) approved at the May 21, 2002 meeting for a
motorcycle dealership with sales and service of new and used motorcycles, power generators,
lawn equipment, scooters, ATV's, and personal watercraft along with outside display,
specifically for the addition of a motorcycle ramp, shade structures on 4 parking spaces
located at 2350 William D Tate Avenue and platted as Lot 2, Block 1, Grayson Addition was
approved by the Site Plan Review Committee on May 27, 2009. A copy of the approved site
plan is enclosed.
Any changes to a site plan approved with a conditional use ora special use (no matter
how minor or major) can only be approved by city council through the public hearing
process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.

Enclosed are four copies of the DFW Honda site plan. In an effort to offer more convenience for
their customers, Mark Lamb and David Dendy want to install a ramp. The ramp would assist
customers in off-loading motorcycles from their trucks and trailers. Also, the curb line next to the
ramp would be saw -cut and pulled back to allow for "sold" motorcycles to be displayed while
awaiting owner pick-up.
A location in the parking lot has been chosen that will require the least grade change. Two
parking spaces would be used to accomplish this. We have compensated for the loss of spaces by
adding two along the north side of the property. Any landscaping that is disturbed will be
replanted or replaced. No trees are affected.
We also request that a new shade structure be approved as shown on the drawing. It will match
the existing shade structure that was approved previously. In an effort to streamline the process
we have added their request to ours for the sake of time. Please see the attached Conditional Use
Application forms.

Previously, the owner filled in an open area to the right side of the dumpster. The area is
now concrete. We have checked the open space calculations, and you will see that we
still have room. This work was done inadvertently without prior permission and is now a
part of the submission.
Also, the owner has requested the addition of two (2) 8' gates as shown on the north side
of the building. This area will be used to secure their "licensed" trailers and hauling
equipment.
