ACKNOWLEDGEMENT
All Conditional Use and Special Use Applications are assumed to be complete
when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all riling fees. The application, along
with the required riling fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

LAVA RESTAURANT
1. The signature may be removed. Please replace case number CU09-12
with case number CU09-36 and include the restaurant name and number
in the lower right hand corner of the each sheet.
2. Please provide a sealed set of plans.
3. Please add the following notes to the site plan:
a) Conditional use request CU09-36 is a request to amend the
previously approved site plan of CU08-19 (Ord. 08-49) to allow
the possession, storage, retail sale and on -premise
consumption of alcoholic beverages (beer, wine and mixed
beverages) in conjunction with a restaurant, specifically to
revise the floor plan..
b) The entire site is the premises.
4. The maximum height for the small sign adjacent to the north property line
may not exceed forty-two (42) inches. Please revise the height of the sign
on the site plan (sheet 1 of 4) accordingly.
5. Please change the label for the proposed 5,510 square footage building to
existing, the note for the existing 3,500 square foot building can be deleted
and the note referring to existing pavement to be removed can be deleted.
The above comments must be reflected in the revised submittal,
which is due by Thursday, October 22nd at 12:00 p.m. for the next
available public hearing. Please submit the revised documents to the
Department of Development Services at 200 South Main Street.
The revised submittal shall include:
four (4) folded blackline copies of each sheet, (minimum size 22" x 34")
six (6) reduced sorted (collated sets) copies at 11" x 17" stapled and z -
folded (fold the right edge to the left edge and then fold the right
edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

RECOMMENDATION
Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU8-19 (Ord. 2008-49) approved at the September 16, 2008
meeting for the possession, storage, retail sale and on -premise consumption of
alcoholic beverages (beer, wine, and mixed beverages) in conjunction with a restaurant,
specifically to revise the floor plan, and take any other action necessary.
On September 16, 2008, Council approved an amendment to the subject site for the
expansion of an unoccupied former Burger King restaurant. The approval eliminated
the drive-through and expanded the previous 3,500 square foot structure into a 110
seat, 5,510 square foot restaurant (Lava Restaurant), with on -premise alcohol beverage
sales and consumption. Two on-site signs utilizing existing poles were also approved.
On May 6, 2009 the Site Plan Review Committee approved Conditional Use Request
CU09-12, specifically to revise the floor plan and make some minor changes to the
exterior elevations.
With this request the applicant proposes to revise the floor plan by adding a partition
wall to the sushi bar area along with some other minor interior changes. The proposed
change will result in a reduction of seating from 110 to 108. Please see the attached
letter and plans.

This letter is to verify that your request to amend the previously approved site plan of
Conditional Use Request CU08-19 (Ord. 2008-49) for the possession, storage, retail sale and
on -premise consumption of alcoholic beverages (beer, wine, and mixed beverages) in
conjunction with a restaurant, specifically to revise the floor plan located at 401 East State
Highway 114 and platted as Lot 3, Block A, Trinity Industries Addition was approved by the
Site Plan Review Committee on October 28, 2009. A copy of the approved site plan is
enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter
how minor or major) can only be approved by city council through the public hearing
process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.

WHEREAS, Wood Golden, Ltd. is the owner of a 0.9280 acre tract of land located in the William
Bradford Survey, Abstract No. 131, in the City of Grapevine, Tarrant County, Texas and being part
of that certain tract of land conveyed to Trinity Industries, inc., by deed recorded in Volume 9720,
Page 1557, Deed Recorded, Tarrant County Texas, and being more particularly described as
follows:
BEGINNING, at a 5/8 -inch iron rod found for corner, said point being located on the north right-
of-way line of State Highway 114 (S.H. 114 - variable width R.O.W.) and also being the southeast
corner of Lot 1, Block 1, of Grandys of Grapevine, an addition to the City of Grapevine according
to plat recorded in Volume 388-214, page 33, P.R.T.C.T.;
THENCE, North 00 degree 05 minute 17 second West, leaving the north line of S.H. 114, and
with the east line of the Grandy's of Grapevine tract, passing at 266.27 feet a 5/8 -Inch iron rod
found for the northeast corner of same, continuing, in all, a distance of 275.05 feet to a 5/8 -inch
Iron rod with "Gonzalez & Schneeberg" cap found for corner, said point being the beginning of a
non -tangent curve to the left having a radius of 835.00 feet;
THENCE, with said curve to the left, through a central angle of 00 degree 38 minute 24 second, an
arc distance of 9.33 feet (chord bears South 84 degree 37 minute 57 second East, 9.33 feet) to a
