All Conditional Use and Special Use Applications are assumed to be complete
when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

1. Please include the site layout plan sheet as the cover sheet which shows
the full extent of the lot (as it extends to the State Highway 114 Service
Road and to Main Street).
2. Please number sheets in consecutive order and add case number CL109-
27 to the lower right hand corner of all sheets.
3. Please revise the site date table from Lot 14 to Lot 14R and the
proposed use to existing.
4. Please add the following note to the site layout sheet:
a) Conditional use request CU09-26 is a request to amend
the previously approved site plan of CU04-40 (Ord. 2004-
85) for a planned commercial center to allow the
development of a hotel and to allow the possession,
storage, retail sale and on -premise consumption of
alcoholic beverages (beer wine and mixed drinks) in
conjunction with a restaurant, specifically to add outdoor
speakers.
5. Please provide a signed letter which states the purpose of the conditional
use request.
The above comments must be reflected in the revised submittal,
which is due by Thursday, August 20 by 5:00 p.m. for the August 26
public hearing. Please submit the revised documents to the Department
of Development Services at 200 South Main Street.
The revised submittal shall include:
four (4) folded blackline copies of each sheet, (minimum size 22" x 34")
six (6) reduced sorted (collated sets) copies at 11" x 17" stapled and z -
folded (fold the right edge to the left edge and then fold the right
edge in half to form a z -fold).

RECOMMENDATION
Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU04-40 (Ord. 04-85) approved at the December 21, 2004
meeting for a planned commercial center to allow the development of a hotel and to
allow the possession, storage, retail sale and on -premise consumption of alcoholic
beverages (beer, wine, and mixed drinks) in conjunction with a restaurant specifically to
add outdoor speakers, and take any other action necessary.
BACKGROUND INFORMATION
The subject site was approved for a 20,505 square foot, 110 room hotel and restaurant
(Hilton Garden Inn) with on -premise alcohol beverage sales and consumption.
The Site Plan Review Committee at their December 21, 2006 meeting approved CU06-
60 which included modifications to the building elevations and a reduction to the overall
height by increasing the amount of stucco, decreasing the amount of brick and reducing
the overall height four feet.
With this request the applicant proposes to install eight outdoor speakers onto the
exterior of the hotel. Please see the attached letter and plans.

This letter is to verity that your request to amend the previously approved site plan of
Conditional Use Request CU0440 (Ord. 04-85) for a planned commercial center to allow the
development of a hotel and to allow the possession, storage, retail sale and on -premise
consumption of alcoholic beverages (beer, wine, and mixed drinks) in conjunction with a
restaurant specifically to add outdoor speakers located at 205 W State Highway 114 and
platted as Lot 14, Block 1, Metroplace 2nd Installment Addition was approved bythe Site Plan
Review Committee on August 26, 2009. A copy of the approved site plan is enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter
how minor or major) can only be approved by city council through the public hearing
process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
