All Conditional Use and Special Use Applications are assumed to be complete
when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

1. Please label the adjacent zoning district to the north and east as
"CC" Community Commercial and include an internal traffic
circulation plan on the site plan.
2. Please contact Cristin Turner in Public Works at (817) 410-3136 for
outstanding comments related to the plat of the subject site.
3. Please dimension the distance of the fleet sales building to the
north and west property lines and dimension a typical parking
space.
4. The lighting level at the property lines may not exceed 3.0 footcandles.
Please adjust the lighting levels accordingly along the west and north
property lines.
5. Within the parking table please include the total number of required and
provided accessible parking spaces. Required parking in excess of 501
spaces requires two percent accessible parking or 12 for 586 required
parking spaces.
6. Please add the following note:
Conditional use request, CU10-07 is a request to amend the
previously approved site plan of CU 10-01 (Ord. 2010-04) for an
automotive dealership with the sale and repair of new and used
vehicles, specifically to allow the addition of 157 parking spaces.
The above comments must be reflected in the revised submittal,
which is due by Wednesday, April 28th at 12:00 p.m. for the May 5th
public hearing. Please submit the revised documents to the Department
of Development Services at 200 South Main Street.
The revised submittal shall include:
five (5) folded blackline copies of each sheet, (minimum size 22" x 34")
fiver (5) reduced sorted (collated sets) copies at 11" x 17" stapled and z -
folded (fold the right edge to the left edge and then fold the right
edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

RECOMMENDATION
Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU10-01 (Ord. 2010-04) approved at the February 16, 2010
meeting for a planned commercial center for an automotive dealership with the sale and
repair of new and used vehicles, specifically to allow the addition of a 157 parking
spaces, and take any other action necessary.
BACKGROUND INFORMATION
Conditional Use Request CU03-34, approved at the September 16, 2003 meeting
allowed for the addition of an automotive reconditioning/detail shop to the existing
Hummer dealership. The original conditional use permit (CU01-27) establishing the
automotive dealership was approved by Council on June 19, 2001. A subsequent
amendment occurred at the February 19, 2002 meeting (CU02-03) which allowed for an
expansion of the Hummer dealership main structure and the relocation of the Classic
Chevrolet used truck operation to the site. Another amendment to the site plan was
approved by Council at their November 19, 2002 meeting (CU02-49) which allowed for
a 5.3 acre addition to the site for a lube and tune center, a vehicle washing area, and an
employee parking lot. The Site Plan Review Committee at their July 23, 2003 meeting
(CU03-25) allowed an increase from 20 -feet to a height of a 30 -foot for a pole sign on
the site for the Hummer dealership.
The Site Plan Review Committee at their September 8, 2004 meeting (CU04-30)
approved the erection of shade structures over the bulk of the vehicle display area to
reduce heat in the vehicles and protect the vehicles from hail damage.
The Site Plan Review Committee at their March 12, 2008 meeting (CU08-05) approved
the construction of an E-85 vehicle fueling station. The vehicle fueling station is open to
the public but is an alternative fuel, used by vehicles whose engines have been
modified to use the fuel. Conditional Use Request CU08-05A for a proposed expansion
was tabled and later withdrawn to allow more time to prepare a comprehensive
development plan for the site. Conditional Use Request CU08-23 (Ord. 2008-55)
approved at the October 21, 2008 joint public hearing included expansion of the site by
adding acreage, allow the development of a fleet sales building, increase the square
footage of an existing parts and distribution facility and to establish a planned

commercial center to allow a pole sign 40 -feet in height. At the October 20, 2009
meeting Council approved a one-year extension to Conditional Use Permit CU08-23.
Conditional Use Request CU10-01 (Ord. 2010-04) approved at the February 16, 2010
joint public hearing allowed for a 1,300 square foot addition to an existing parts
distribution facility totaling 23,581 square feet.
With this request the applicant proposes to allow the addition of 157 parking spaces,
revise the parking configuration and exterior elevations for the fleet sales building, and
relocate a previously approved pole sign.

This letter is to verify that your request for a conditional use permit for a planned commercial
center for an automotive dealership with the sale and repair of new and used vehicles,

Any changes to a site plan approved with a conditional use or a special use (no matter

No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.

In November 2008, the City Council approved our amendments to CU03-34 to allow for
an expansion to the existing parts warehouse and a new fleet sales facility. Due to the
economic conditions, both projects went on hold shortly thereafter. The conditional use
was extended last winter for an additional year.
Both projects have since commenced and are currently under construction.
With the DFW Connector project underway, Mr. Durant will lose a portion of the land
across the front of the fleet sales property for right-of-way. The final metes and bounds
description of the right-of-way is still being determined.
The fleet sales operation is a very large business and requires substantial inventory of
various types of vehicles. Ken Thompson, of the Ken Thompson Group, operates the
commercial fleet sales center for Mr. Durant. He is in need of parking for approximately
650 vehicles. The current facility under construction has parking for 476 vehicles. Our
submittal requests development of some additional acreage to increase the inventory
parking another 157 spaces.
As you will see, we have proposed a paved area that is the least intrusive to the natural
water course at the rear of the property. We have also left the wetlands area undisturbed.
By reducing the actual area of paving, we can avoid removing a substantial amount of
trees.

With this request, we are also revising the site plan of the fleet sales building that was
previously approved. These items have been noted on the drawings.
We believe our application will in no way cause substantial harm to the surrounding
property; nor, will it interfere or inhibit the enjoyment or use of other property in the area.

As we approach the completion of the Classic Fleet project, we need to request a revision
to the approved site plan. We now know where the new property line will be after
TxDOT takes the R.O.W. across the front of Mr. Durant's property. The attached
drawing indicates the new property line.
Mr. Durant would like to locate the approved pole sign near the new property line. The
new location is indicated on the drawing.
Any previous discussion with you regarding the security rail and front row of bushes is
no longer relevant. Mr. Durant is leaving them where presently shown on the site plan.
We respectfully request your approval of the pole sign location as soon as possible. The
sign company is prepared to install the sign, but a permit cannot be issued without the
new location being approved.

Attached is the landscape plan for the facility captioned above. We have two requests for
your consideration.
Request No. 1— Due to the overlapping canopies of the existing trees, we would like to
eliminate the required trees along the rear line. Every effort was made to keep the
existing trees, and we believe that they easily make up for the trees we are eliminating.
Also, the slopes, due to the existing wetlands area and oxbow, prohibit us from planting
new trees without interfering with these sensitive natural features.
Request No. 2 — Due to the heavy existing vegetation and trees at the rear of the
property, we are requesting that the hedge row be eliminated. The vehicles stored in this
area will easily be screened by the existing vegetation and trees from Stone -Myers Road.
