To Whom It May Concern,
This letter is to verify that your request for a conditional use permit located at 129 South Main
Street, Suite 155 and platted as Block 1, Lot 1, Hazelwood Commercial Building Addition to amend
the previously approved site plan CU14-26 (Ordinance 2014-39), specifically to allow the
possession, storage, retail sales of on- and off -premise consumption of alcoholic beverages (beer,
wine, and mixed beverages), outdoor dining, and outdoor speakers in conjunction with a restaurant
was approved by City Council on November 15, 2022. A copy of the approved exhibits are
enclosed.
Any changes to a site plan, landscape plan, building elevations, or any other sheets
approved with a conditional use or a special use (no matter how minor or major) can only be
approved by City Council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.
Your next milestone in the development review process are to obtain building permit approval with
the Building Services Department. For questions related to these processes, please reach out to

Building Permit applications will be accepted at any point in the development review process but will
not be released until any associated zoning cases or site plans are approved, civil engineering plans
are approved, and any required plats are approved and filed.

Because you are a property owner within 200 feet of the subject tract of land as shown by the
last City-approved tax rolls, you received this notice. If you cannot or do not wish to attend
the hearing, the attached form is provided for your convenience. If owners of more than 20%

The applicant is requesting a conditional use permit to amend the previously approved site plan CU14-26 (Ord. 2014-39), specifically to allow the possession, storage, retail sales of on- and off-premise consumption of alcoholic beverages (beer, wine, and mixed beverages), outdoor dining, and outdoor speakers in conjunction with a restaurant. The property is currently zoned “CBD”, Central Business District and owned by Chateau Group 1, Ltd.
PLANNING SERVICES
Metes and Bounds Description
1. Provide a metes and bounds description per the CUP checklist for the property. This can be taken from the plat or replat of the lot.
All Sheets
1. Add title blocks and approval blocks to al sheets in the plan set. Examples provided below. Ensure that within the approval block (2nd example) that it reads, “Planning Services Department.” The title block must be in the lower-right hand corner of the sheet. The approval block must be located near the title block (e.g., above or to the left of the title block).
• Include the following information in the approval block
o Case Name: Mister 01 Pizza
o Case Number: CU22-51
o Location: 129 South Main Street, Suite 155
• Revise zoning within the title block to read “CBD”, Central Business District.

2. Include the case number on all sheets in the approval signature blocks as CU22-51.
3. Add the following purpose statement to all sheets, “Conditional Use request CU22-51 is a request to amend the previously approved site plan CU14-26 (Ord. 2014-39), specifically to allow the possession, storage, retail sales of on- and off-premise consumption of alcoholic beverages (beer, wine, and mixed beverages), outdoor dining, and outdoor speakers in conjunction with a restaurant. 4. All sheets must state the following:
• “The entire site is the premise.”
• “A minimum four (4) feet clearance between the public walking space and the tables shall be maintained by the owner/operator at all time.”
5. Add the following standard notes:
• Refuse disposal areas shall be landscaped and screened from view in accordance with the Zoning Ordinance.
• Mechanical and electrical equipment including air conditioning units, shall be designed, installed, and operated to minimize noise impact on surrounding property. All such equipment shall be screened from public view in accordance with the Zoning Ordinance.
• Open storage, where permitted, shall be screened in accordance with the Zoning Ordinance.
• The masonry requirements of Section 54 of the Zoning Ordinance shall be met.
• Illuminated signage was included in the determination of the site illumination levels.
• Outdoor lighting shall comply with illumination standards within Section 55 of the Zoning Ordinance unless specifically excepted.
• Proposed ground signage shall meet the minimum requirements of Section 60 of the Zoning Ordinance and is contingent upon approval of a separate building permit with Building Services.
• All onsite electrical conductors associated with new construction shall be located underground.
• Uses shall conform in operation, location, and construction to the following performance standards in Section 55 of the Zoning Ordinance: noise, smoke and particulate matter, odorous matter, fire or explosive hazard material, toxic and noxious matter, vibration, and/or other performance standards.

Show and label the location of the pedestrian sidewalk easement adjacent to the east property line. See attached plat for your reference. 4. Show, dimension, and label 20 x 20 Corner Clip adjacent to the southwest corner of the lot. See attached plat for your reference. 5. Use a bold line to denote the property line. 6. Remove Site Plan title at bottom left hand corner. This information is requested in the title block that is to be placed in the lower right-hand corner of the plan sheet. 7. Provide a site data summary table on the plan sheet, utilize the table format link provided. Provide required and proposed total lot areas in square feet and acres, open space, impervious area in square feet and percentages. 8. Label on plan drawing over building: Total building area, total building height in stories and feet, total lot area; subdivision name, lot and block; and address. Label building as existing building. 9. Label and dimension width of existing driveways. 10. Label and dimension typical parking space and accessible space. 11. Show and label outdoor dining seat layout and area. Notate the number of seats. 12. Label and dimension refuse storage area. 13. Clearly denote suite space for Mister 01 using hatching. 14. 1. Remove sheet labeled as Floor Plan from the plan set and utilize the Furniture Plan as the Floor Plan.

2. Address all comments found under the All Sheets section above. 3. Rename sheet as the Floor Plan. 4. Show and label primary entrance and exit and any other entrances/exits. 5. Provide perimeter dimensions. 6. Remove furniture legend and labels from the floor plan drawing and note the number of seats for each table. 7. Show indoor and outdoor seating layout and the number of seats. 8. Show and label alcohol point of sale. 9. Show and label alcohol storage areas. 10. Include a table with occupant load calculations based on 2006 IBC. 11. Provide a graphical depiction of the type of outdoor tables and chairs that are proposed. 12. Remove note regarding indoor plant type. 13. Show and label outdoor speakers and include a note in the legend.
Parking Plan – Not Provided 1. A parking plan is required with a request in the “CBD”, Central Business District. Denote available parking as noted on the site plan. See attached parking plan for your reference. 2. Address all comments found under the All-Sheets section above.
Reflected Ceiling Plan – Sheet Number A-121
1. Review and revise the reflected ceiling plan to include details and information relevant to the speaker plan. Remove all ceiling details. 2. Rename sheet as the Speaker Plan. 3. Address all comments found under the All Sheets section above. 4. Review and revise graphic depiction of outdoor speakers as the one provided is not sufficient. 5. Add a statement that highlights the purpose of the outdoor speakers. 6. Add hours of outdoor speaker use. 7. Review and revise the decibel level as it should not exceed 59 dBA 7AM-10PM and 52 dBA 10PM-7AM

CONDITIONAL USE APPLICATION CU22-51, MISTER 01 PIZZA

PROPERTY LOCATION AND SIZE:
The subject property is located at 129 South Main
Street, Suite 155 and is platted as Block 1, Lot 1,
Hazlewood Commercial Building Addition. The
addition contains 0.711 acre and has approximately
321 feet of frontage along South Main Street, 230
feet along Jenkins Street, and 147 feet along East
Wall Street.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU14-26 (Ord. 2014-39), specifically to allow the possession, storage, retail sales
of on- and off-premise consumption of alcoholic beverages (beer, wine, and mixed
beverages), outdoor dining, and outdoor speakers in conjunction with a restaurant.
On July 15, 2014, City Council approved CU14-26 (Ord. 2014-39) to establish Cotton
Patch Cafe on the subject site. On July 6, 2016, the Site Plan Review Committee
approved CU16-16 to allow outdoor seating and one outdoor speaker in conjunction with
Cotton Patch Cafe. The applicant proposes establishing a new 3,595 square foot
restaurant, Mister 01 Pizza within the same suite space. The proposed seating layout will
accommodate 52 patrons; 44 indoors and 8 outdoors. The outdoor seats and two outdoor
speakers are proposed along the south building elevation adjacent to West Wall Street and
one outdoor speaker is proposed at the restaurant’s entrance adjacent to South Main
Street. The outdoor speakers’ hours of use will coincide with the operating hours of the
restaurant and are slated to provide ambient background music for the patrons. Twenty-

seven (27) parking spaces are required for the restaurant; 198 parking spaces for the multi-
tenant structure. Relative to the building layout, there are 15 parking spaces partially
located on the site on the eastern side of the building along Jenkins Street; there are five
parallel on-street spaces along the eastern side of Jenkins Street. The applicant intends to
utilize the public parking lot at the northeastern corner of Jenkins Street and East Wall
Street which contains 141 spaces. Along with another 253 off-site spaces within the
immediate vicinity of the subject site, there a total of 414 parking spaces available.
Access to the site is provided by public sidewalks adjacent to Jenkins Street, East Wall
Street and South Main Street.
PRESENT ZONING AND USE:
The property is currently zoned “CBD”, Central Business District and is developed with a
two story 45,958 square foot multi-tenant building.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject site was rezoned in the 1984 City-wide Rezoning from “C-2”, Community
Business District to “HC”, Highway Commercial District.
• On February 19, 2013, City Council approved Z12-11 (Ord. 2013-06) to rezone the
subject site from “HC”, Highway Commercial District to “CBD”, Central Business
District for the development of a multi/tenant office/retail building.
• On July 15, 2014, City Council approved CU14-26 (Ord. 2014-39) to allow for the
sale, storage, retail sales, and on-premise consumption of alcoholic beverages in
conjunction with the development of Cotton Patch Cafe within Suite 155.
• On July 6, 2016, the Site Plan Review Committee approved CU16-16 to allow
outside dining and one outdoor speaker in conjunction with Cotton Patch Cafe
within Suite 155.
• On March 21, 2017, City Council approved CU17-02 (Ord. 2017-17) to allow for the
possession, storage, retail sales, and on-premise consumption of alcoholic
beverages, outside dining and outdoor speakers in conjunction with the
development of a restaurant (San Daniele) within Suite 200.

AIRPORT IMPACT:
The subject tract is located within “Zone A” Zone of Minimal Effect as defined on the
“Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs Map. Few activities
will be affected by aircraft sounds in “Zone A” except for sound sensitive activities such as
auditoriums, churches, schools, hospitals, and theaters. The applicant’s proposal is an
appropriate use in this noise zone.
MASTER PLAN APPLICATION:
Map 2: Land Use Plan of the Comprehensive Master Plan designates the subject property
as Commercial land use. The request is compliant with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The City of Grapevine Thoroughfare Plan designates Main Street as a Type F, Collector
with a minimum 60-foot right-of-way developed as 2 lanes. East Wall Street is designated
as a Type F, Collector with a minimum 60-foot right-of-way developed as two lanes.
