On December 12, 2022, the Building Board of Appeals approved Building Board of
Appeals Case BBA22-04 for 2900 W. Kimball Avenue, legally described as Lot 1, Block 2A
& 213, Finholt Addition:
The following request was to Grapevine Code of Ordinances, Chapter 7, Article IV:
Section 7-127, Fences, prohibits the erection of a fence exceeding thirty-six (36) inches in
height in the required and established front yard area, whichever area is greater in depth,
on a lot.
The Board approved the request to allow a five-foot (5) tall spiked iron fence in the
required and established front yard.
A copy of the minutes will be available after they have been approved at the next regular
Building Board of Appeals meeting. If you need a copy for your records, please contact

RECOMMENDATION:
Staff recommends the Building Board of Appeals Deny the request to City of Grapevine Code of
Ordinances, Chapter 7, Article IV, Fences, Section 7-127 for property addressed as 2900 West
Kimball Ave. platted as Lot 2A and 2B, Block 1, Finholt Additions, Grapevine, Texas as follows:
Section 7-127 prohibits the erection of a fence exceeding thirty-six (36) inches in height in the
required or established front yard area, whichever area is greater in depth, on any lot.
The applicant is requesting to construct a (5) foot tall, spiked iron fence in the required and
established front yard.
SPECIAL CONDITION:
There is no special condition for this request. The fence was constructed illegally, by
unregistered contractors, without permits.
BACKGROUND INFORMATION:
This application was submitted by David and Amanda Howard. There is not a unique condition to
the property. Most importantly, a complying fence could be constructed legally on the property,
or the existing illegal fence could be easily modified to comply with the ordinance. Staff became
aware of the illegal construction by visual observation. Code Enforcement Officers have issued
notices to the owner and to the contractor who performed the illegal construction.
Among the many other reasons noted, it is important that the request be denied so that the
contractor is not rewarded for intentional and knowing violation of the ordinance. While staff has
no desire to punish the homeowner, economic hardship cannot be a factor in how the code is
enforced (or how the Board makes its decision). However, it can only be hoped that the
homeowner will seek recourse from the contractor who performed the illegal construction.

Sec. 7-127. - Front yard requirements.
(a) Corner lots: It shall be unlawful to erect a fence in the required front yard
building setback area or the established front yard area, whichever area is
greater in depth, on any corner lot, except along the interior lot line in
accordance with subsection (b).
(b) Interior lots:
(1) It shall be unlawful to erect a fence, hedge or vines over 36 inches in height
in the required front yard area or the established front yard area, whichever
area is greater in depth, on any interior lot. Fences in a required or
established front yard on properties zoned R-20 single family district with a
lot size in excess of 50,000 square feet may be a maximum of 48 inches in
height.
(2) It shall be unlawful to erect a fence, hedge or vines in the required front yard
area or the established front yard area, whichever area is greater in depth,
on any interior lot that does not have at least 50 percent through vision.
(3) It shall be unlawful to maintain a fence, hedge or vines in the required front
yard area or an established front yard area, whichever area is greater in
depth, of an interior lot in a manner that does not permit at least 50 percent
through vision.
(4) For the purpose of this section, "established front yard area" shall mean an
open, unoccupied space on a lot facing a street and extending across the
front of a lot between the side yard lines and extending from the abutting
street to a principal building or structure. The phrase "required front yard"
shall have the meaning ascribed to it in the Grapevine Zoning Ordinance No.
82-73.
(5) Fences within a required or established front yard area shall not be
constructed of "chain-link" material.
(6) Gates erected across driveways adjacent to streets shall be set back a
minimum of 20 feet from the property line adjacent to the street.

NEW BUSINESS
6. Building Board of Appeals to conduct a public hearing relative to Case
BBA22-02 for the consideration of the adoption of amendments to Chapter 7 of
the Grapevine Code of Ordinances, Buildings and Construction, relating to the
adoption of the 2021 International Building Code, the 2020 National Electric
Code, the 2021 International Residential Code, the 2021 International
Mechanical Code, the 2021 International Plumbing Code, the 2021 International
Fuel Gas Code, adopting by reference the 2018 International Swimming Pool
and Spa Code adopted by the State of Texas.
Assistant Building Official Larry Gray addressed the Board; he stated that they were
requesting the Board forward to City Council a recommendation for the adoption of
amendments to Chapter 7 of the Grapevine Code of Ordinances, Buildings and
Construction, relating to the adoption of the 2021 International Building Code, the 2020
National Electric Code, the 2021 International Residential Code, the 2021 International
Mechanical Code, the 2021 International Plumbing Code, the 2021 International Fuel
Gas Code, adopting by reference the 2018 International Swimming Pool and Spa Code
adopted by the State of Texas.
Robert Rainwater asked Mr. Gray if City Council were able to amend portions of the
proposed code changes and fee schedule, Council Representative Leon Leal stated
that City Council were allowed to approve one or the other as a whole or partial.
With no further questions for Assistant Building Official, Larry Gray or Council
Representative Leon Leal and no additional speakers, Gabe Griess made a motion to
close the public hearing. Robert Rainwater seconded the motion which prevailed by the
following vote:

Robert Rainwater made a motion to forward to the City Council a recommendation for
the adoption of Chapter 7 of the Grapevine Code of Ordinances, Buildings and
Construction, relating to the adoption of the 2021 International Building Code, the 2020

Mechanical Code, the 2021 International Plumbing Code, the 2021 International Fuel

adopted by the State of Texas. Gary Kemp seconded the motion, which prevailed by
the following vote:

meeting and take any necessary action.

Shea Kirkman made a motion to accept the minutes of the October 10, 2022, Briefing
Session and Public Hearing. Gabe Griess seconded the motion which prevailed by the
following vote:
