The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, March 7, 2005, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd
Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the
following members present to wit:
Carl Hecht Chairman

constituting a quorum with alternate member Scott Baker absent. Also present were

Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to
order at approximately 6:00 P.M.
ROLL CALL
Chairman Hecht held roll call and announced that all were present except Alternate
Member Scott Baker and Member Debbie Holt. Ms. Holt arrived at approximately 6:05
P.M.
NEW BUSINESS
Mr. Stombaugh and Mr. Williams briefed the Board of Zoning Adjustment regarding the
items scheduled to be heard in the regular public hearing.

With no further discussion, Kip Bruner made a motion to adjourn. Debbie Holt seconded
the motion which prevailed by the following vote:

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular

CALL TO ORDER
� Chairman Carl Hecht called the public hearing to order at approximately 6:23 P.M.

Chairman Hecht held roll call and announced that all were present except Alternate
Member Scott Baker.
NEW BUSINESS
BOARD OF ZONING ADJUSTMENT CASE BZA05-03, KAREN A. BALLARD, 308
RUTH STREET
The first item for the Board of Zoning Adjustment to consider was BZA05-03, submitted
by Karen Ballard, for property located at 308 Ruth Street and legally described as Lot 1,
Block 6, D.E. Box Addition. The following request was from Grapevine Comprehensive
Zoning Ordinance 82-73:
Section 15.G.4 Area Regulations, requires a reverse frontage lot to have a minimum lot
width of 95-feet.
� The applicant requested a variance of 25-feet to this requirement and if approved by the
Board would allow a lot width of 70-feet.

Section 42.D Supplementary District Regulations, Corner Lots, requires that the side
� yard on the street side of a corner lot shall be the same as that required for the front
yard.
The applicant requested a variance of 15-feet to this requirement and if approved by the
Board would allow a side yard setback along Texas Street of 15-feet.
Mr. Stombaugh explained that Staff found a special condition existed for the requested
variances. Specifically, the subject lot was originally platted in 1948 predating the City's
first Zoning Ordinance which was adopted in 1955. He added that platted developed
property existed to the south and west of the lot, and a right-of-way existed on both
sides of the lot, eliminating the possibility of expanding the lot. He stated that requiring
a 30-foot setback along East Texas Street would reduce the buildable width of the lot to
34-feet, severely limiting the type of product that could be built on the property. Mr.
Stombaugh remarked that the applicant intended to have an 1,800 square foot single
family residence built on the property.
Jay Thomas, President of Jay Thomas Custom Homes, took the Oath of Truth and
offered to answer any questions of the Board on behalf of the applicant.
Mr. Luers asked about the tree shown on the plot plan.
� Mr. Thomas indicated that the structure would most likely be moved back from a 10-foot
side setback as originally shown on the plot plan, to a 15-foot side setback as
requested, allowing the tree to remain.
With no further questions and no additional speakers, Dennis Luers made a motion to
close the public hearing. Kip Bruner seconded the motion which prevailed by the
following vote:
Ayes: Hecht, Luers, Cook, Bruner, and Holt
Nays: None
Absent: None
Dennis Luers made a motion that a special condition existed with regard to Section
15.G.4 and Section 42.D. Specifically, the subject lot was platted prior to the City's first
Zoning Ordinance, which was adopted in 1955, and there was no possibility of
expansion of the subject site to meet the lot width and side yard setback requirements.
Kip Bruner seconded the motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Bruner, and Holt

� Dennis Luers then made a motion to grant a variance of 25-feet to Section 15.G.4,
allowing a lot width of 70-feet, and a variance of 15-feet to Section 42.D, allowing a side
yard setback along Texas Street of 15-feet. Kip Bruner seconded the motion which
prevailed by the following vote:

BOARD OF ZONING ADJUSTMENT CASE BZA05-04, KIMBERLY SCHULD. 320
SOUTH CHURCH STREET
The next item for the Board of Zoning Adjustment to consider was BZA05-04, submitted
by Kimberly Schuld, for property located at 320 South Church Street and legally
described as Lot 1B, Block 11, City of Grapevine, pending submittal of a replat of the
subject property. The following request was from Grapevine Comprehensive Zoning
Ordinance 82-73:
Section 20.G.5 Area Regulations requires a minimum lot depth of 100-feet.
The applicant requested a variance of 12-feet to this requirement and if approved by the
Board would allow a lot depth of 88-feet.
Section 43.E.3 Non-conforming Uses and Structures, allows the Board to approve the
remodeling and/or enlargement of a non-conforming use.
� If approved by the Board, the existing residential structure would be allowed to remain
as developed and would also allow the expansion of the residential structure to include
the attachment of what was previously an accessory structure for use as additional
living space.
Mr. Stombaugh explained that Staff recommended the Board of Zoning Adjustment
table this request, because the applicant was in the process of determining the
ownership of a portion of property immediately adjacent to the subject property to the
west. A replatting of the subject property to include this additional piece would reduce
the extent that the property was non-conforming.
With no speakers present, Dennis Luers made a motion to close the public hearing. Kip
Bruner seconded the motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Bruner, and Holt
Nays: None

Mr. Bruner then made a motion to table Case Number BZA05-04. Debbie Holt
seconded the motion which prevailed by the following vote:

SOUTH DOOLEY STREET AND 513 EAST TEXAS STREET
The next item for the Board of Zoning Adjustment to consider was BZA05-06, submitted
by John Perrault, for property located at 235 South Dooley Street and proposed to be
platted as Lot 1, Block 1, Vinson Addition. The following request was from Grapevine
Comprehensive Zoning Ordinance 82-73:
Section 15.G.4 Area Regulations requires a reverse frontage lot to have a minimum lot
width of 95-feet.
The applicant requested a variance of 25-feet to this requirement and if approved by the
Board would allow a lot width of 70-feet.
Section 43.E.3 Non-conforming Uses and Structures, allows the Board to approve the
remodeling and/or enlargement of a non-conforming use.
If approved by the Board, the existing residential structure and accessory structure
would be allowed to remain as developed.
Also considered with Case Number BZA05-06, submitted by John Perrault, was
� property located at 513 East Texas Street, proposed to be platted as Lot 2, Block 1,
Vinson Addition. The following request was from Grapevine Comprehensive Zoning
Ordinance 82-73:
Section 15.F.2 Density Requirements requires a minimum lot size of 7,500 square feet.
The applicant requested a variance of 1,723 square feet to this requirement and if
approved by the Board would allow a lot size of 5,777 square feet.
Section 15.G.5 Area Regulations requires a lot depth of 100-feet.
The applicant requested a variance of 30-feet to this requirement and if approved by the
Board would allow a lot depth of 70-feet.
Section 43.E.3 Non-conforming Uses and Structures, allows the Board to approve the
remodeling and/or enlargement of a non-conforming use.
If approved by the Board, the existing residential structure would be allowed to remain
as developed and would allow the expansion of the structure as shown on the plot plan.
Mr. Stombaugh stated that Staff found a special condition existed for all of the
requested variances and special exceptions for both subject lots. Specifically, the
� College Heights Addition which the subject properties were originally a part of, was
platted in 1907, predating the City's first zoning ordinance by nearly 50 years.
Subsequent replatting coupled with the sale of property by deed had reshaped the
original boundaries of the College Heights Addition, particularly in this block. He added

� that developed platted property existed to the north and east of the subject properties,
eliminating the possibility of expansion.
Mr. Stombaugh explained that the owner of both subject lots was replatting and
remodeling the property for subsequent sale. The platting had been done in such a way
to eliminate nonconformities relative to side yard setbacks for both properties.
John Perrault, applicant, took the Oath of Truth and offered to answer any questions of
the Board.
With no questions and no additional speakers, Dennis Luers made a motion to close the
public hearing. Debbie Holt seconded the motion which prevailed by the following vote:

Kip Bruner made a motion that concerning 235 South Dooley Street, special conditions
existed with regard to Section 15.G.4 and Section 43.E.3, and concerning 513 East
Texas Street, special conditions existed with regard to Section 15.F.2, Section 15.G.5,
and Section 43.E.3. Specifically, the College Heights Addition which the subject
properties were originally a part of, was platted in 1907, predating the City's first zoning
� ordinance of 1955. Dennis Luers seconded the motion which prevailed by the following
vote:

� The next item for the Board of Zoning Adjustment to consider was BZA05-07, submitted
by the City of Grapevine, for property located at 501 Shady Brook Drive and 506 Peach
Street, platted as Block 2, Grapevine Service Center Addition, and Abstract 946, Tract
14A01, Leonard, Archibald F. Survey. The following request was from Grapevine
Comprehensive Zoning Ordinance 82-73:
Section 54 Masonry Requirements requires all principal buildings or structures in the
"GU" (Government Use) Zoning District to be constructed having at least seventy
percent of the total exterior walls of masonry.
The applicant requested a complete variance to allow an addition with metal exterior
walls to be constructed onto an existing metal wash bay.
Section 43.E.3 Non-conforming Uses and Structures, allows the Board to approve the
remodeling and/or enlargement of a non-conforming use.
If approved by the Board, the existing site would be allowed to remain as developed and
would allow the expansion of the facility as shown on the site plan.
Scott Williams explained that staff found a special condition existed for the request to
Section 54, as it would be visually inappropriate to construct a masonry addition to an
existing metal structure. Furthermore, the structure was screened from view by a
� masonry wall around the perimeter of the property.
He added that a special condition was warranted for the request to Section 43.E.3, as
this was an existing site, was legal when constructed, and all additions and
modifications (except the wash bay addition)would comply with the Zoning Ordinance.
Bob Price, Assistant Director of the City of Grapevine's Public Works Department, took
the Oath of Truth and offered to answer any questions of the Board.
With no questions and no additional speakers, Kip Bruner made a motion to close the
public hearing. Debbie Holt seconded the motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Bruner, and Holt

Absent: None
Next, Debbie Holt made a motion that a special condition existed for both requests.
Specifically, it would be visually inappropriate to construct a masonry addition to an
existing metal structure, and the structure was screened from view by a masonry wall
around the perimeter of the property. Additionally, the subject site was an existing site,
was legal when constructed, and all additions and modifications except the wash bay
addition would comply with the Zoning Ordinance. Kip Bruner seconded the motion

Ron Cook made a motion to accept the minutes of the February 7, 2005 Briefing
Session. Kip Bruner seconded the motion which prevailed by the following vote:

Ron Cook made a motion to accept the minutes of the February 7, 2005 Public Hearing,
with amendments to the votes under the Minutes section to show that Ron Cook made
a motion to accept the minutes of the January 3, 2005 Public Hearing, and Kip Bruner
seconded that motion . Kip Bruner seconded the motion which prevailed by the
following vote:
Ayes: Hecht, Luers, Cook, Bruner, and Holt
Nays: None
