CO T WILLIAMS CT G DEVELOPMENT SERVICES DIRECTOR/ B6 DING OFFICIAL STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday evening, December 4, 2006, at 6:00 P.M. in the Planning and Zoning Conference Room, 2"d Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the following members present to wit: Carl Hecht Dennis Luers Ron Cook Kip Bruner Debbie Holt Richard Adams Chairman Vice -Chairman Secretary Member Member Alternate constituting a quorum. Also present were the following City Staff: Scott Williams Acting Development Services Director/ Building Official Albert Triplett Planner II Connie Cook Development Services Assistant CALL TO ORDER Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:03 P.M. ROLL CALL Chairman Hecht held roll call and announced that all were present, except Alternate Scott Baker. NEW BUSINESS Mr. Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to be heard in the regular public hearing. ADJOURNMENT With no further discussion, Kip Bruner made a motion to adjourn. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Bruner, Cook, Holt, Adams Nays: None Absent: Baker The Briefing Session was adjourned at approximately 6:24 P.M. ROLL CALL Chairman Hecht held roll call and announced that all were present, except Alternate Scott Baker. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA06-14, 416 WEST COLLEGE STREET The first item for the Board of Zoning Adjustment to consider was BZA06-14, submitted by Harold and Patsy Heitz, for property located at 416 West College Street, legally described as Lot 4A & 46, Block 5-7, City of Grapevine Addition. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3., Nonconforming Uses and Structures allows The Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant requested a special exception and if approved by the Board would allow the existing single family detached residential structure to remain as developed and would allow a 444-square foot addition, as well as the construction of an approximate 800-square foot detached accessory structure to replace an existing accessory structure within an "R-TH" Zoning District. Mr. Triplett explained that Staff found a special condition for the requested special exception. Specifically, this was an existing residential structure built in 1920 predating the City's first zoning ordinance adopted in 1955. This property was also a legally existing single family residential detached use prior to the citywide rezoning in 1984 which placed "R-TH" Zoning on the property. He further stated that the single family detached dwelling and accessory structure were a nonconforming use within this zoning district. Based upon the primary use on the site, the proposed accessory structure would retain its nonconforming status. The site was within the boundaries established for the College Street Historic Landmark Overlay (Ord. 93-58) approved on November 16, 1993. The overlay was intended to preserve the historical significance of existing structures along this section of College Street. The attached plans were approved by the Historic Preservation Committee on October 25, 2006. Any future proposed changes to structures within this District would be required to meet the preservation criteria established for this overlay. With no further questions for Ms. Triplett, and no additional speakers, Kip Bruner made a motion to close the public hearing. Debbie Holt seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Bruner, Cook, Holt Nays: None Absent: Baker Kip Bruner made a motion that a special condition existed. Specifically, this was an existing residential structure built in 1920 predating the City's first zoning ordinance adopted in 1955. Debbie Holt seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Bruner, Cook, Holt Nays: None Absent: Baker Kip Bruner then made a motion to grant the following special exception to "R-TH" Townhouse District, Nonconforming Uses and Structures: Section 43.E.3., allowing the construction of a 444-square foot addition, as well as the construction of an approximate 800-square foot detached accessory structure to replace an existing accessory structure within an "R-TH" Zoning District. Ron Cook made a motion to accept the minutes of the November 6, 2006 Briefing Session. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Bruner, Cook, Holt Nays: None Absent: Baker Ron Cook made a motion to accept the minutes of the November 6, 2006 Public Hearing.
