NEW BUSINESS
BOARD OF ZONING ADJUSTMENT CASE BZA06-14, 416 WEST COLLEGE
STREET
The first item for the Board of Zoning Adjustment to consider was BZA06-14, submitted
by Harold and Patsy Heitz, for property located at 416 West College Street, legally
described as Lot 4A & 46, Block 5-7, City of Grapevine Addition. The following request
was from Grapevine Comprehensive Zoning Ordinance 82-73:
Section 43.E.3., Nonconforming Uses and Structures allows The Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception and if approved by the Board would
allow the existing single family detached residential structure to remain as developed
and would allow a 444-square foot addition, as well as the construction of an
approximate 800-square foot detached accessory structure to replace an existing
accessory structure within an "R-TH" Zoning District.
Mr. Triplett explained that Staff found a special condition for the requested special
exception. Specifically, this was an existing residential structure built in 1920 predating
the City's first zoning ordinance adopted in 1955. This property was also a legally
existing single family residential detached use prior to the citywide rezoning in 1984
which placed "R-TH" Zoning on the property.
He further stated that the single family detached dwelling and accessory structure were
a nonconforming use within this zoning district. Based upon the primary use on the site,
the proposed accessory structure would retain its nonconforming status. The site was
within the boundaries established for the College Street Historic Landmark Overlay
(Ord. 93-58) approved on November 16, 1993. The overlay was intended to preserve
the historical significance of existing structures along this section of College Street. The
attached plans were approved by the Historic Preservation Committee on October 25,
2006. Any future proposed changes to structures within this District would be required
to meet the preservation criteria established for this overlay.
With no further questions for Ms. Triplett, and no additional speakers, Kip Bruner made
a motion to close the public hearing. Debbie Holt seconded the motion which prevailed
by the following vote:
Ayes:
Hecht, Luers, Bruner, Cook, Holt
