CO T WILLIAMS A,CTI1JG DEVELOPMENT SERVICES DIRECTOR/ B ING OFFICIAL 26.4 STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday evening, February 5, 2007, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the following members present to wit: Carl Hecht Chairman Dennis Luers Vice -Chairman Ron Cook Secretary Debbie Holt Member Richard Adams Alternate Scott Baker Alternate constituting a quorum. Also present were City Council Representative Roy Stewart, and the following City Staff: Ron Stombaugh Development Manager Albert Triplett Planner II Connie Cook Development Services Assistant CALL TO ORDER Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:03 P.M. ROLL CALL Chairman Hecht held roll call and announced that all were present except Member, Kip Bruner. NEW BUSINESS Mr. Stombaugh and Mr. Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to be heard in the regular public hearing. Iq ADJOURNMENT With no further discussion, Dennis Luers made a motion to adjourn. Ron Cook seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Holt, Adams, Baker Nays: None Absent: Bruner The Briefing Session was adjourned at approximately 6:27 P.M. Board of Zoning Adjustment to conduct a public hearing relative to Board of Zoning Adjustment Case BZA07-02, submitted by David Drennan for property located at 1585 South Gravel Circle, and consideration of same. rr IV. ROLL CALL Chairman Hecht held roll call and announced that all were present except Member Kip Bruner. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA07-01, 3900 GRAPEVINE MILLS PARKWAY The first item for the Board of Zoning Adjustment to consider was BZA07-01, submitted by Kris Kashata representing Verde Apartment Communities Development, LP for property located at 3900 Grapevine Mills Parkway, legally described as Lot 2, Block 1, Riverwalk Addition. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 60.F.1., Sign Standards, Functional/Structural Types Permitted 4W establishes the type of signs permitted in the "R-MF-1" Multifamily District. The applicant requested a variance to this requirement and if approved by the Board would allow for a sign 60 feet in length and four feet (4') in height (240 square feet) to a temporary screening fence that would be removed by September 15, 2007. Mr. Stombaugh explained that Staff recommended the Board of Zoning Adjustment table BZA07-01; allowing Staff time to consult with city attorney's office for direction in whether or not case met the special condition criteria. With no further questions for Mr. Stombaugh, Kris Kashata, of 4313 Greenbriar Drive, Dallas, Texas representing property owner Verde Apartment Communities, Development LP took the Oath of Truth and requested the Board table his request until the March 2007 Board of Zoning Adjustment meeting. With no further questions for Mr. Stombaugh, and no additional speakers, Richard Adams made a motion to table Case Number BZA07-01 until the March 2007 Board of Zoning Adjustment meeting. Debbie Holt seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Holt, Adams Nays: None Absent: Bruner BOARD OF ZONING ADJUSTMENT CASE BZA06-02, DAVID T. DRENNAN, 1585 SOUTH GRAVEL CIRCLE The next item for the Board of Zoning Adjustment to consider was BZA07-02 submitted by David T. Drennan, representing Miss Bobbie Drennan, for property located at 1585 South Gravel Circle, and proposed to be platted as Lot 2, Block 1, Drennan Addition. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant requested a special exception and if approved by the Board, would allow the existing residential structure to remain as developed as shown on the plot plan. Mr. Triplett explained that Staff found a special condition for the requested special exception. Specifically, this was an existing residential structure built in 1945 predating the City's first zoning ordinance adopted in 1955. This property was annexed into the City of Grapevine as part of an approximate 300 acre annexation from the City of Southlake and the Corps of Engineers which was approved by Council on November 2, (W 1993. The site received the "R-20" Single Family District designation upon annexation. 2 Board of Zoning Adjustment 2/5/2007 With no further questions for Mr. Triplett, David Drennan, of 1589 South Gravel Circle, Grapevine, Texas representing property owner Miss Bobbie Drennan, took the Oath of Truth and explained that he was in the process of tearing down his existing residence to rebuild and in the process of platting three (3) properties, when it was discovered that one of the properties exceeded the front building line. Mr. Drennan further stated that it would be time consuming and would hinder his plans to rebuild on his property if he had to remove one of the properties from the platting process. Mr. Drennan requested favorable consideration of his request and offered to answer any questions of the Board. With no questions for Mr. Drennan, and no additional speakers, Dennis Luers made a motion to close the public hearing. Debbie Holt seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Holt, Adams Nays: None Absent: Bruner Dennis Luers made a motion that a special condition existed. Specifically, this was an existing residential structure built in 1945 predating the City's first zoning ordinance adopted in 1955. Debbie Holt seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Holt, Adams Nays: None Absent: Bruner Dennis Luers then made a motion to grant the following special exception to "R-7.5" Single Family District, Nonconforming Uses and Structures: Section 43.E.3., allowing the existing residential structure to remain as developed as shown on the plot plan. Debbie Holt seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Holt, Adams Nays: None Absent: Bruner MINUTES Next the Board of Zoning Adjustment considered the minutes of the December 4, 2006 Briefing Session and Public Hearing. Ron Cook made a motion to accept the minutes of the December 4, 2006 Briefing Session. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Holt, Adams (W Nays: None Absent: Bruner 3 Board of Zoning Adjustment 2/5/2007 Ron Cook made a motion to accept the minutes of the December 4, 2006 Public Hearing. Richard Adams seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Holt, Adams Nays: None Absent: Bruner ADJOURNMENT With no further discussion, Richard Adams made a motion to adjourn.
