The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, June 4, 2007, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd
Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the
following members present to wit:
Carl Hecht
Dennis Luers
Ron Cook
Debbie Holt
Chairman
Vice -Chairman
Secretary
Member
constituting a quorum. Also present were the following City Staff:
Ron Stombaugh Development Manager
Albert Triplett Planner II
Connie Cook Development Services Assistant
CALL TO ORDER
Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to
order at approximately 6:05 P.M.
ROLL CALL
Chairman Hecht held roll call and announced that all were present except Alternates,
Richard Adams and Scott Baker. He also announced that Member Kip Bruner had
resigned.
NEW BUSINESS
Mr. Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to be
heard in the regular public hearing.
STAFF REPORTS
Mr. Stombaugh informed the Board on upcoming construction projects throughout the
city.

With no further discussion, Dennis Luers made a motion to adjourn. Debbie Holt
seconded the motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Holt
Nays: None
Absent: Adams, Baker
The Briefing Session was adjourned at approximately 6:19 P.M.

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, June 4, 2007, at 6:15 P.M., in the Council Chambers, 200
South Main Street, Grapevine, Texas with the following members present:

CALL TO ORDER
Chairman Carl Hecht called the Public Hearing Session of the Board of Zoning
Adjustment to order at approximately 6:21 P.M.
ROLL CALL
Chairman Hecht held roll call and announced that all were present except Alternates,
Richard Adams and Scott Baker.
NEW BUSINESS
BOARD OF ZONING ADJUSTMENT CASE BZA07-04, SCOTT NORTON, 706 EAST
WALL STREET
The first item for the Board of Zoning Adjustment to consider was BZA07-04, submitted
by Scott Norton, for property located at 706 East Wall Street, legally described as Lot 9,
Block 101, College Heights Addition. The following request was from Grapevine
Comprehensive Zoning Ordinance 82-73:
Section 16.G.3., "R-5.0" Zero -Lot -Line District Area Regulations requires a
minimum side yard setback of six feet (6').
The applicant requested a variance to this requirement and if approved by the Board
would allow for a side yard setback along the eastern property line of four feet (4') for
the proposed structure.
Section 42.D., Supplemental District Regulations requires a minimum side yard
setback of 15-feet for corner lots which are not reverse frontage lots.
The applicant requested a variance to this requirement and if approved by the Board
would allow for a side yard setback along the western property line of ten feet (10') for
the proposed structure.
Mr. Triplett explained that Staff found a special condition existed for the requested
variances. Specifically, the subject lot was originally platted in 1909 predating the City's
first zoning ordinance adopted in 1955.
With no further questions for Mr. Triplett, Scott Norton, of 432 Ball Street, Grapevine,
Texas took the Oath of Truth and requested favorable consideration of his request and
offered to answer any questions of the Board.
With no further questions for Mr. Triplett, and no additional speakers, Dennis Luers
made a motion to close the public hearing. Debbie Holt seconded the motion which
prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Holt
Nays: None
Absent: Adams, Baker
Debbie Holt made a motion that a special condition existed. Specifically, the subject lot
was originally platted in 1909 predating the City's first zoning ordinance adopted in
1955. Dennis Luers seconded the motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Holt
Nays: None
Absent: Adams, Baker
Debbie Holt then made a motion to grant the following variances to "R-5.0" Zero -Lot -
Line District Area Regulations: Section 42.D., Supplemental District Regulations
allowing a side yard setback along the eastern property line of four feet (4'), and a side
yard setback along the western property line of ten feet (10') for the proposed structure
as shown on the plot plan. Dennis Luers seconded the motion which prevailed by the
following vote:

BOARD OF ZONING ADJUSTMENT CASE BZA07-05, KENNETH AND TOBI
MOONEY, 2330 BLUEBIRD COURT
The next item for the Board of Zoning Adjustment to consider was BZA07-05 submitted
by Kenneth and Tobi Mooney, for property located at 2330 Bluebird Court, legally

described as Lot 37, Block 2, Russwood Estates. The following request was from
Grapevine Comprehensive Zoning Ordinance 82-73:
Section 42.C., Supplemental District Regulations requires the same side yard
setback as the principal structure for swimming pools.
The applicant requested a variance to this requirement and if approved by the Board
would allow a side yard setback along the southern property line of three feet (3') for a
proposed swimming pool.
Mr. Triplett explained that Staff found a special condition existed for the requested
variance. Specifically, four (4) mature trees with diameters ranging from eight inches
(8") to 15 inches (15") along with a five foot (5') wide utility easement spanning the
entire width of the rear yard with overhead utilities that precluded placement of the pool
in this area.
With no further questions for Mr. Triplett, Kenneth Mooney, of 2330 Bluebird Court,
Grapevine, Texas took the Oath of Truth and requested favorable consideration of his
request and offered to answer any questions of the Board.
Mr. Luers asked Mr. Mooney if his neighbor closest to the pool was aware of what was
being proposed. He stated that he was.
Mr. Cook asked Mr. Mooney about the concrete pad that was shown on the site plan
and whether it was possible to remove the pad and place the pool in the rear yard. Mr.
Mooney stated that the concrete pad was actually part of the residence; he further
stated that there were smaller trees that would have to be removed.
Mr. Luers asked Mr. Stombaugh to explain the correlation between an accessory
structure and swimming pool.
With no further questions for Mr. Triplett, and no additional speakers, Debbie Holt made
a motion to close the public hearing. Ron Cook seconded the motion which prevailed
by the following vote:
Ayes: Hecht, Luers, Cook, Holt
Nays: None
Absent: Adams, Baker
Dennis Luers made a motion to table Case Number BZA07-05 until the July 2007 Board
of Zoning Adjustment meeting. Debbie Holt seconded the motion which prevailed by
the following vote:

BOARD OF ZONING ADJUSTMENT _CASE BZA07-06, LARRY WOJTASZEK, 2639
EVINRUDE DRIVE
The next item for the Board of Zoning Adjustment to consider was BZA07-06 submitted
by Larry Wojtaszek, for property located at 2639 Evinrude Drive, legally described as
Lot 1, Block 10, Placid Peninsula Addition. The following request was from Grapevine
Comprehensive Zoning Ordinance 82-73:
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use.
The applicant requested a special exception and if approved by the Board, would allow
the existing residential structure to remain as developed as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception. Specifically, this site was an existing developed lot; the existing
residential structure was built in 1961 predating the City annexing this area on May 3,
1966. The site received the "R-7.5" Single Family District designation during the 1984
City Rezoning.
With no further questions for Mr. Triplett, Windy Melton with Coldwell Banker,
representing potential property owner Larry Wojtaszek, took the Oath of Truth and
requested favorable consideration of his request and offered to answer any questions of
the Board.
With no further questions for Mr. Triplett, and no additional speakers, Dennis Luers
made a motion to close the public hearing. Debbie Holt seconded the motion which
prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Holt
Nays: None

Debbie Holt made a motion that a special condition existed for the requested special
exception. Specifically, the site was an existing developed lot, and the existing

Ron Cook made a motion to accept the minutes of the March 5, 2007 Briefing Session.

Nays: None
