The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Tuesday
evening, October 9, 2007, at 6:00 P.M. in the Planning and Zoning Conference Room,
2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the
following members present to wit:

CALL TO ORDER
Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to
order at approximately 6:00 P.M.
ROLL CALL
Chairman Hecht held roll call and announced that all were present except Secretary,
Ron Cook.
NEW BUSINESS
Mr. Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to be
heard in the regular public hearing.
STAFF REPORTS
Scott Williams informed the Board on upcoming construction projects throughout the
city.

With no further discussion, Dennis Luers made a motion to adjourn. Richard Adams
seconded the motion which prevailed by the following vote:

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Tuesday evening, October 9, 2007, at 6:15 P.M., in the Council Chambers, 200

Adjustment to order at approximately 6:33 P.M.

BOARD OF ZONING ADJUSTMENT CASE BZA07-16. JUSTIN POWERS, 904 WEST
SUNSET STREET
The first item for the Board of Zoning Adjustment to consider was BZA07-16, submitted
by Justin Powers for property located at 904 West Sunset Street, legally described as
Tract 9R03K1, Heirs of A. Foster Survey, Abstract 518. The following request was from
Grapevine Comprehensive Zoning Ordinance 82-73:
Section 15.F.2., "R-7.5" Single Family District, Density Regulations, requires a
minimum lot size of 7,500 square feet. The applicant requested a variance and if
approved by the Board would allow a lot size of 5,378 square feet for an existing lot.
Section 15.G.1., "R-7.5" Single Family District, Area Regulations requires a
(W minimum front yard setback of thirty -feet (30'). The applicant requested a variance
and if approved by the Board would allow a front yard setback of 20-feet (20') for an
existing lot.
Section 15.G.4., "R-7.5" Single Family District, Area Regulations requires a
minimum lot width of 65-feet. The applicant requested a variance and if approved by
the Board would allow a lot width of sixty -feet (60') for an existing lot.
Section 15.G.5., "R-7.5" Single Family District, Density Regulations, requires a
minimum lot depth of 100-feet. The applicant requested a variance and if approved by
the Board would allow a lot depth of 89-feet for an existing lot.
Mr. Triplett explained that Staff found special conditions existed for all of the requested
variances. Specifically, the subject lot was not platted; the existing dwelling was built in
1950 according to Tarrant Appraisal District records, which predated the City's first
zoning ordinance adopted in 1955. Platted developed property existed to the north,
east, and west, eliminating the possibility of expanding the lot to meet the lot depth,
width, and area requirements.
Mr. Triplett stated that requiring a 30-foot front yard setback coupled with the required
25-foot rear yard setback would leave 34-feet of buildable depth for a structure, severely
limiting the type of product that could be built on the property. Mr. Triplett further
(W explained that the property owners would demolish the existing residence and build a 2-
story, 2,021 square foot residence.
With no further questions for Mr. Triplett, the applicants, Justin and Bethany Powers, of
908 West Sunset Street, Grapevine, Texas, took the Oath of Truth; and requested
favorable consideration of their request and offered to answer any questions of the
Board.
With no further questions for Mr. Triplett, and no additional speakers, Dennis Luers
made a motion to close the public hearing. Debbie Holt seconded the motion which
prevailed by the following vote:

Richard Adams made a motion that special conditions existed for the requested
variances. Specifically, the subject lot was not platted; the existing dwelling was built in
1950 according to Tarrant Appraisal District records, which predated the City's first
zoning ordinance adopted in 1955. Platted developed property existed to the north,
east, and west, eliminating the possibility of expanding the lot to meet the lot depth,

BOARD OF ZONING ADJUSTMENT CASE BZA07-17, RICHARD PEMBERTON,
1115 AIRLINE DRIVE
The next item for the Board of Zoning Adjustment to consider was BZA07-17 submitted
by Richard Pemberton, for property located at 1115 Airline Drive, legally described as
Lot 3, Block 4, J.J. Daniel Addition. The following request was from Grapevine
Comprehensive Zoning Ordinance 82-73:
Section 15.H, "R-7.5" Single Family District, Buffer Area Regulations, requires a
minimum buffer distance forty -feet (40') whenever an R-7.5 Single Family
development is located adjacent to a non-residential district. The applicant
requested a variance and if approved by the Board would allow a buffer distance of six -
feet (6) and thirty-three feet (33') adjacent to the north and east property lines
respectively.
Mr. Triplett explained that Staff found a special condition existed for the requested
variance. Specifically, the subject lot in its current configuration was platted in 1947 as
part of the original plat of the J. J. Daniel Addition predating the City's first zoning
ordinance adopted in 1955. Strict adherence to the buffer requirement to the north and
east would render the property unbuildable.
Mr. Triplett stated that the property to the immediate north of the subject property was at
one time zoned for residential purposes ("R-1" Single Family District) but was rezoned
in 1980 to "SP" Specific Use Permit to accommodate the development of a parking lot.
The subject site was previously used for residential purposes and contained a dwelling,
which had since been demolished. All setback requirements relative to the "R-7.5"
Single Family District i.e. front, rear, and both side yard setbacks, would be met. During
the 1984 City rezoning the properties to the immediate north and east of the subject site
were rezoned to "PO" Professional Office District. The owner intended to build a single
story home of approximately 3,200 square feet on the subject property.

With no further questions for Mr. Triplett, the applicant, Richard Pemberton, of 1701
(bw Dunn Street, Grapevine, Texas, took the Oath of Truth; and requested favorable
consideration of his request and offered to answer any questions of the Board.
With no further questions for Mr. Triplett, and no additional speakers, Dennis Luers
made a motion to close the public hearing. Debbie Holt seconded the motion which
prevailed by the following vote:

Debbie Holt then made a motion to grant the following variance to Section 15.H, "R-7.5"
Single Family District, Buffer Area Regulations, that a variance of thirty-four feet (34')
and seven -feet (7) adjacent to the north and east property lines respectively, allowing a
buffer distance of six -feet (6') and thirty-three feet (33') adjacent to the north and east
property lines respectively. Dennis Luers seconded the motion which prevailed by the
following vote:

BOARD OF ZONING ADJUSTMENT TO CONSIDER AMENDMENTS TO THE RULES
OF PROCEDURE.
Next the Board considered the amendments to the Rules of Procedure.
Mr. Williams presented the following amendments to be incorporated in the Rules of
Procedure.
Article I, Section 6: All references to the Building Official shall mean the "sin
Director of Development Services/Building Official or his designated representative.
Article VI, Section 6: Not less than 30 days prior to the pubic hearing, the applicant shall
file with the °sin Director of Development Services/Building Official or his

designated representative, fifteen (1o) twenty-eight (28) copies of all reports,
tw memoranda and exhibits that the applicant expects to present at the public hearing. In
the case of large exhibits, photographic reductions not less than eight inches by ten
inches in size may be filed in lieu of the original exhibits.
Article Vill, Section 2:..... Not less than seventy-two (72) hours prior to the hearing,
objectors shall file with the Building Official fifteen 04) twenty-eight (28) copies of all
reports, memoranda and exhibits that such objectors expect to present at the hearing.
Article XI: The foregoing rules and regulations are hereby adopted by the Board of
Adjustment of the City of Grapevine, Texas, on , 2001 2007.
After discussion, Richard Adams made a motion to accept changes to the Amendments
to the Board of Adjustment Rules of Procedure, Dennis Luers seconded the motion
which prevailed by the following vote:
