Also present were City Council Representative Roy Stewart and the following City Staff: Ron Stombaugh Planning and Development Manager (W Albert Triplett Planner II Connie Cook Development Services Assistant CALL TO ORDER Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:00 P.M. ROLL CALL Chairman Hecht held roll call and announced that all were present. NEW BUSINESS Mr. Triplett and Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the items scheduled to be heard in the regular public hearing. STAFF REPORTS Ron Stombaugh informed the Board on upcoming construction projects throughout the city. ADJOURNMENT With no further discussion, Dennis Luers made a motion to adjourn. Richard Adams seconded the motion which prevailed by the following vote: Ayes: Hecht, Cook, Luers, Holt, Adams, VanTil Nays: None Absent: None The Briefing Session was adjourned at approximately 6:11 P.M. Randolph, for property located at 3526 Lakeridge Drive, and consideration of same. B. Board of Zoning Adjustment to conduct a public hearing relative to Board of Zoning Adjustment Case BZA08-05, submitted by Kirk Howard, for property located at 3433 Lakeview Drive, and consideration of same. ROLL CALL Chairman Hecht held roll call and announced that all were present. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA08-04, ROBERT MART, 3526 LAKERIDGE ROAD The first item for the Board of Zoning Adjustment to consider was BZA08-04 submitted by Robert Mart, for property located at 3526 Lakeridge Road, legally described as Lot 31, Lake Forest Addition. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1., "R-7.5" Single Family District, Area Regulations, requires a minimum front yard setback of 30-feet. The applicant requested a variance and if approved by the Board would allow a front yard setback of 16-feet along Lake Forest Road. Mr. Triplett explained that Staff found a special condition existed for the requested variance. Specifically, this was an existing single family home built in 1963. When built it was not located within the city limits of the City of Grapevine. The property was later annexed into the City of Grapevine in May 1966. Mr. Triplett stated that the subject property was zoned "R-7.5" Single Family District. The owner intended to build an 88 square foot utility room addition on the north side of the home; a 785-square foot second floor addition above the existing master bedroom; enclosing and enlarging the existing carport and converting it into a garage. He further stated that none of the proposed additions would increase the level of non -conformity to the site. With no further questions for Mr. Triplett, the applicant, Robert Mart, of 707 Timber Lake Circle, Southlake, Texas, took the Oath of Truth; and explained to the Board that he had purchased 3526 Lakeridge Road, and wanted to make improvements. When his building contractor had the property surveyed, it showed the existing residence was over the required front yard building line setback. When he approached the city about building permits he was informed that a variance would be required before any permits could be issued. He further stated that they had no intentions to increase the level of non -conformity to the site, and requested favorable consideration of his request and offered to answer any questions of the Board. With no further questions for Mr. Triplett, and no additional speakers, Dennis Luers made a motion to close the public hearing. Debbie Holt seconded the motion which (W prevailed by the following vote: Ayes: Hecht, Cook, Luers, Holt, Adams Nays: None Absent: None Dennis Luers made a motion to re -open the public hearing. Debbie Holt seconded the motion which prevailed by the following vote: Ayes: Hecht, Cook, Luers, Holt, Adams Nays: None Absent: None Charlene Perry, of 2104 Lake Forest Road, Grapevine, Texas, took the Oath of Truth; and explained to the Board that she was a neighbor to the applicant and did not have any objections to the improvements. With no further questions for Mr. Triplett, and no additional speakers, Dennis Luers made a motion to close the public hearing. Debbie Holt seconded the motion which prevailed by the following vote: Ayes: Hecht, Cook, Luers, Holt, Adams Nays: None Absent: None 2 Board of Zoning Adjustment 5/5/2008 Richard Adams made a motion that a special condition existed for the requested variance. KIRK HOWARD. 3433 LAKEVIEW DRIVE The next item for the Board of Zoning Adjustment to consider was BZA08-05 submitted by Kirk and Christina Howard, for property located at 3433 Lakeview Drive, legally described as Lot 7, Block 6, Grapevine Lake Estates. Mr. Stombaugh explained that Staff was recommending BZA08-05 be Tabled until the June 2, 2008 Board of Zoning Adjustment meeting, allowing the variances requested to be properly advertised. With no questions for Mr. Stombaugh, and no additional speakers, Debbie Holt made a motion to Table BZA08-05. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Cook, Luers, Holt, Adams Nays: None Absent: None MINUTES Next the Board of Zoning Adjustment considered the minutes of the April 7, 2008, Briefing Session and Public Hearing. Ron Cook made a motion to accept the minutes of the April 7, 2008 Briefing Session. (W Dennis Luers seconded the motion. 3 Board of Zoning Adjustment 5/5/2008 Ayes: Hecht, Cook, Luers, Holt, Adams Nays: None Absent: None Ron Cook made a motion to accept the minutes of the April 7, 2008 Public Hearing. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Cook, Luers, Holt, Adams Nays: None Absent: None ADJOURNMENT With no further discussion, Dennis Luers made a motion to adjourn.
