COTT ILLIAMS EVELO MENT SERVICES DIRECTOR/ B ILDIN OFFICIAL � � STATE OF TEXAS GOUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the Gity ofi Grapevine, Texas, met on Monday evening, July 6, 2009, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd Floor, 20Q Sauth Main Street, Grapevine, Texas, for a Briefing Session with the following members present to wit: Carl Hecht Chairman Dennis �uers Vice-Chairman Ron Cook Secretary Debbie Holt Member Jahn VanTil Alternate Ken White Alterna#e canstituting a quorum. Also present were City Council Representative Roy Stewart and the following City Staff: Ron Stombaugh Planning and Development Manager Albert Triplett Planner II � Connie Coak Development Services Assistant CALL TO ORDER Ghairman Carl Hecht called the Briefing Session of the Board of Zaning Adjustment to arder at approximately 6:00 P.M. ROLL CALL Chairman Hecht held roll call and announced that all were present, except Member Richard Adams. NEW BUSINESS Mr. Triplett briefed the Baard of Zoning Adjustment regarding the item scheduled to be heard in the regular public hearing. ADJCIURNMENT Wi#h no further discussion, C}ennis Luers made a mo#ion to adjourn. John VanTil seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Halt, VanTil, White � Nays: None Absent: Adams MINUTES � Next the Board of Zoning Adjustment considered the minutes of the June 1, 2009, Briefing Session and Public Hearing. Ron Cook made a motion to accept the minutes of the June 1, 2009, Briefing Session. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Holt, VanTil Nays: None Absent: Adams, Ron Cook made a motion to accept the minutes of the June 1, 2009, Public Hearing, clarifying the wording pertaining to the motion to grant the variance. John VanTil seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Holt, VanTil Nays: None Absent: Adams ADJOURNMENT With no further discussion, Dennis Luers made a motion to adjourn. OATH OF OFFICE Connie Cook administered the Oath of Office to reappointed Secretary, Ron Cook, reappointed 1St Alternate John VanTil, and reappointed 2"d Alternate Ken White. ELECTION OF OFFICERS For office of Chairman, Dennis Luers re-nominated Carl Hecht. Debbie Holt seconded the motion which prevailed by the following vote: Ayes: Luers, Cook, Holt, VanTil Nays: None Abstain: Hecht Absent: Adams �, Carl Hecht was re-elected as Chairman. For office of Vice-Chairman, Debbie Holt re-nominated Dennis Luers. John VanTil seconded the motion which prevailed by the following vote: Ayes: Hecht, Cook, Holt, VanTil � Nays: None Abstain: Luers Absent: Adams Dennis Luers was re-elected as Vice-Chairman. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA09-06, JUSTIN POWERS, 901 WEST SUNSET STREET The first item for the Board of Zoning Adjustment to consider was BZA09-06 submitted � by Justin Powers, for property located at 901 West Sunset Street, legally described as the Heirs of A. Foster, Survey, Abstract 518, Tract 9R03C, and proposed to be platted as Lot 1, Block 2, J. Powers Addition. Section 15.G.1., "R-7.5" Single Family District, Area Regulations requires a minimum front yard setback of 30-feet. The applicant requested a variance and if approved by the Board would allow a front yard setback of finrenty-feet (20') for an existing lot. Mr. Triplett explained that Staff found no special condition existed for the variance requested. Specifically, this was a self imposed hardship and the subject site met the depth, width and area requirements of the zoning district. Mr. Tiplett stated that the owner intended to build a two-story, single family residence of approximately 2,500 square feet along with a 521 square foot detached garage on the subject property. With no questions for Mr. Triplett, Bethany Powers of 428 Ball Street, Grapevine, Texas, took the Oath of Truth; and explained to the Board her finro main reasons for the variance request. First, to maintain the streetscape on Sunset, she stated that this front yard setback would not be the closest house on the street. There were a large variety of front yard setbacks and house styles on this street, and wanted to maintain a look to a Historic Neighborhood. Although this area was not part of the Historic Township it was a �, Historic Neighborhood developed mostly in the 1940's and 1950's. Secondly, she wanted to maintain the integrity of the previous house that had been developed on the property. The original home was approximately 21-feet measured from the six and one- half feet (6'/2') right-of-way dedication. It was their intent to maintain the historic look and Board of Zoning Adjustment 2 �rsizoos feel of the neighborhood. She requested favorable consideration of her request and offered to answer any questions of the Board. � John VanTil asked the applican#, if she knew what the setbacks were on the home to the west of the subject property. She stated that it was approximately fifteen-feet (15'). Chairman Hecht announced that (7) letters of approval had been received. With no further questions far Ms. Powers, Ross Bannister of 424 Ball Street, Grapevine, Texas, took the Oath of Truth; and explained to the Baard that he owned the home directly behind the subject property. He explained his position with the city as Director of Heritage Programs and Preservation, and its interest in preserving the historical perspective on some of its important neighborhoods. He stated that this particular neighborhood was a unique small neighbarhood, with some of the properties built in #he early 1940's, and as recently as 2008-2009, there were a variety of setbacks throughout the neighborhood. From a historical preservation point of view they considered this neighborhood important to the growth af the City of Grapevine. It's proximity to the Nistoric District se# it up ta be a pedestrian neighborhood. Retaining or honoring a 20' setback would be consistent with what has been established in the neighborhaod. With no questions for Mr. Bannister, and no additional speakers, Dennis Luers made a motion to close the public hearing. Debbie Holt seconded the motion which prevailed by the follawing vote: � Ayes: Hecht, Luers, Cook, Holt, VanTil Nays: None Absent: Adams Dennis Luers made a motion that a special condition existed for the requested variances. Specificaily, the subject lot was developed prior to the Ci#y's first zoning ordinance adopted in 1955. Also the placement of the structure in the position shown on the site plan maintained alignment with #he structures of the properties immediately adjacent to the eas# and west and provided a uniform appearance along this porkion of West Sunset Street. John VanTil seconded the mo#ion which prevaiied by the following vote: Ayes: Hecht, Luers, Coak, Holt, VanTil Nays: None Absent: Adams Dennis Luers then made a motion to grant the following variances ta "R-7.5" Single Famiiy District, Area Regulations: Section 15.G.1., allowing a front yard setback of twenty-feet (20'} for an existing lot.
