Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to
order at approximately 6:00 P.M.

Chairman Hecht held roll call and announced that all were present, except Gity Council
Representative Roy Stewart.
NEW BUSINESS
Mr. Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to be
heard in the regular public hearing.

With no further discussian, Dennis Luers made a motion to adjourn. Richard Rdams
seconded the motion which prevailed by the following vote:

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, August 2, 2010, at 6:15 P.M., in the Council Chambers, 200
South Main Street, Grapevine, Texas with the following members present:
Carl Hecht Chairman

CALL TO ORDER
� Chairman Carl Hecht called the Public Hearing Session of the Board of Zoning
Adjustment to order at approximately 6:25 P.M.
ROLL CALL
Chairman Hecht held roll call and announced that all were present, except City Council
Representative Roy Stewart.
OATH OF OFFICE
Connie Cook administered the Oath of Office to reappointed Chairman, Carl Hecht,
reappointed Vice-Chairman, Dennis Luers, reappointed Member, Debbie Holt, and
reappointed Member Richard Adams.
ELECTION OF OFFICERS
For office of Chairman, Dennis Luers re-nominated Carl Hecht. Ron Cook seconded the
motion which prevailed by the following vote:
Ayes: Luers, Cook, Holt, Adams
Nays: None
� Abstain: Hecht
Carl Hecht was re-elected as Chairman.
� For office of Viee-Chairman, Richard Adams re-nominated Dennis Luers. Debbie Holt
seconded the motion which prevailed by the following vote:

PUBLIC HEARING
BOARD OF ZONING ADJUSTMENT CASE BZA10-06, ROBERT BALDWIN. 3605

The first item for the Baard of Zoning Adjustment to consider was BZA10-06 submitted
by Rabert Baldwin, for property located at 36Q5 Ira E. Woods Avenue platted as Lot 1,
Block 1, Krispy Kreme Addition.
Section 43.E,3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement af a nonconforming
use. The applicant requested a special exception allowing the existing structure to
remain as developed as shown on the site plan.
Section 60.H.a., Sign Standards, requires a minimum setback of 10-feet (10'). The
applicant requested a variance allowing a setback of approximately seven-feet (7') as
shown on the site plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception and variance. Speci#ically, this existing platted and developed lot was
in complete campliance with all development criteria as stated within the zoning
ordinance, #he praposed widening of Ira E. Woods Avenue {S.H. 26) and the resulting
acquisition of approximately 31-feet of frontage from the subject property had created a
condition in which the front yard landscaping area requirement could no longer meet the
minimum requirement. He further stated that the relocated sign did not meet setback
� requirements due to the location of the existing drive aisle and in addition the right-of-
way acquisition had created other nonconformities relative to perimeter landscaping.

Chairman Hecht announced that no letters had been received for or against.
� With no furkher questions for Mr. Tripiett, Vickie Rader, representing Baldwin and
Associates of 401 Exposition Avenue, Dallas, Texas, took the Oath of Truth; and
reques#ed favorable consideration of his request and offered to answer any questions of
the Board.
With no questians for N1s. Rader, and na additianal speakers, Dennis Luers made a
motion to close the public hearing. Debbie Holt seconded the motion which prevailed by
the following vote:
Ayes: Hecht, Luers, Cook, Holt, Adams
Nays: Nane
Absent: Nane
Dennis Luers made a motion that a special candition existed for the requested special
exception. Specifically, this existing platted and developed lat was in complete
compliance with all development criteria as stated within the zoning ordinance, the
proposed widening of Ira E. Woods Avenue (S.H. 26) and the resuiting acquisition of
approximately 31-feet of frontage from the subject property had created a condition in
which the front yard landscaping area requirement could no longer meet the minimum
requirement and that the relocated sign did not meet required setbacks. Debbie Holt
seconded the motion which prevailed by the following vote:

Dennis Luers then made a mation ta grant the following special exception to Section
43.E.3., Noncanforming Uses and Structures, allowing the existing structure to remain
as developed as shown an the site plan. With regard to variance request Section
64.H.a. allowing a setback of approximately seven-feet (7'} as shown on the site plan.
Debbie Holt seconded the motion which prevailed by the following vote:

The nex# item for the Baard of Zoning Adjustmen# to cansider was BZA10-Q7 submitted
by David McGuire far property located at 157 Manor Way, platted as Lot 6, Black 3,
Manor Oaks Addition. The following request was from Grapevine Comprehensive
Zoning Ordinance 82-73:

Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
� Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception allowing the existing structure to
remain as developed as shown on the site plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception. Specifically the site was platted in 1966 and the existing structure
was built in 1969 prior to the rezoning of the site from "R-1" Single Family Dwelling
District to "R-20" Single Family District in the 1984 City Rezoning.
He went on to explain that according to Tarrant Appraisal records, the home was
constructed in 1969 when the required front yard setback was thirty-feet (30'). The
current front yard setback requirement was forty (40) feet as a result of a proposed
replat that incorporated a vacated portion of Inwood Drive into the subject site.
Chairman Hecht announced that (1) letter of protest had been received.
With no questions for Mr. Triplett, the applicant, David McGuire, of 157 Manor Way,
Grapevine, Texas, took the Oath of Truth; and requested favorable consideration of his
request and offered to answer any questions of the Board.
With no questions for Mr. McGuire, and no additional speakers, Richard Adams made a
motion to close the public hearing. Dennis Luers seconded the motion which prevailed
� by the following vote:

Richard Adams made a motion that a special condition existed for the requested special
exception. Specifically, the site was platted in 1966 and the existing structure was built
in 1969 prior to the rezoning of the site from "R-1" Single Family Dwelling District to "R-
20" Single Family District in the 1984 City Rezoning. Debbie Holt seconded the motion
which prevailed by the following vote:

The next item far the Board af Zoning Adjustment to consider was BZA1 p-09 submitted
by Mark Born for property iocated at 235 Austin Street, piatted as Lot 1, 2, 3 & 4, Block
1�5, College Heights Addition. The following reguest was from Grapevine
Comprehensive Zoning Ordinance 82-73:
Section 'i5,G.4., "R-7.5" Single Family District, Area Regulations requires a
reverse frantage lot to have a minimum lot width of ninety-five {95'). The applicant
requested a variance allowing a lot width of seventy-two (72') far a proposed (ot.
Section 42.D., Supplemental District Regulations requires a minimum side yard
setback of thirty-feet t3Q} for corner lots which are reverse frontage lots. The
applicant requested a variance to allow a side yard setback along the southern property
line of Lot 1 R af si�een-feet (16'} for the existing structure.
5ection 43.E,3., Nonconforming Uses and Structures allows the Baard af Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception to allow the existing covered porch on
Lot 1 R to remain as shown on the site plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
�` variances and special exception, Specifically, the origina! Lots 1-4, Block 105 of College
�r� Heights Additian were originally platted in 1921, predating the City's first zoning
ordinance. The site comprised of four existing lots functioned as one developed lot.
The existing residential structure which included the covered porch was constructed in
1983 prior to the 1984 City Rezaning #o "R-7.5" Single Family District. The praposed
L.ot 2R prevented the expansion of L.ot 1 R to meet required lat width and setback on a
side street for a reverse frontage lot. An alley and two street frantages adjacent to the
subject site eliminated the possibility to expand. The special exception requested
addressed the existing covered porch's encraachment of approximately two-feet into the
required thirty-foot building setback line on the west side of the lot which was a result of
the propased replat of La# 1 R.
He went on to explain that four existing lots were proposed to be replatted into three.
Three lots currently had structures, a residence and three accessory structures. At the
April 20, 2010 meeting Council appraved Historic Landmark Subdistrict H�10-01 and
HL10-02 and CA10-Q2 and CA10-03 for the Lots 3 and 4, Block 105 College Heights
Addition. The approval allawed for the relocation of an existing garage and conversion
of a frame building to serve as a garage for a future period style home. At the June 23,
2010 meeting of the Histaric Preservatiat� Cammission the current Lats 1 and 2
received approval far Historic Landmark Subdistrict HL10-07. As shown on the
proposed site plan, the proposed Lat 1 R would retain the existing residence and
garage.

Debbie Holt asked Mr. Triplett if the lots were left as four individual lots, and if there
� were any proposed changes that needed to be made to the existing lots, the applicant
would still have to come before the Board for those changes. Mr. Triplett stated that
they would.
Chairman Hecht announced that no letters had been received for or against.
With no questions for Mr. Triplett, the applicant, Josh Born, representing his father Mark
Born, of 1110 Valley Vista, Grapevine, Texas, took the Oath of Truth; and requested
favorable consideration of his request and offered to answer any questions of the
Board.
With no questions for Mr. Born, and no additional speakers, Richard Adams made a
motion to close the public hearing. Dennis Luers seconded the motion which prevailed
by the following vote:
Ayes: Hecht, Luers, Cook, Holt, Adams

Richard Adams made a motion that a special condition existed for the requested
variances and special exception. Specifically, Lots 1-4, Block 105 of College Heights
