The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, October 4, 2010, at 6:00 P.M. in the Planning and Zoning Conference Room,
2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the
following members present to wit:
Debbie Holt Member
John VanTil Alternate
Ken White Alternate
not constituting a quorum. Also present were City Council Representative Roy Stewart
and the following City Staff:
Ron Stombaugh Planning and Development Manager
Albert Triplett Planner II
Connie Cook Development Services Assistant
The meeting was not called to order due to lack of a quorum, with Chairman, Carl Hecht
�, Vice-Chairman, Dennis Luers, Secretary, Ron Cook, and Member, Richard Adams
absent.
There was no formal action discussed or taken by the Board of Zoning Adjustment.
The Briefing Session was adjourned at approximately 6:13P.M.

Adjustment to order at approximately 6:00 P.M.
ROLL CALL
Vice-Chairman Luers held roll call and announced that all were present, Chairman Carl
Hecht , Member Richard Adams and Alternate John VanTil.
NEW BUSINESS
Mr. Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to be
heard in the regular public hearing.

With no further discussion, Ken White made a motion to adjourn. Debbie Holt seconded
the motion which prevailed by the following vote:

Vice-Chairman Dennis Luers called the Public Hearing Session of the Board of Zoning
Adjustment to order at approximately 6:34 P.M.

Vice-Chairman Luers held roll call and announced that all were present, Chairman Carl
Hecht , Member Richard Adams and Alternate John VanTil.
PUBLIC HEARING
BOARD OF ZONING ADJUSTMENT CASE BZA10-12, DAVID CANIS, 911 WEST
SUNSET STREET
The first item far the Board of Zoning Adjustment to consider was BZA10-12 submitted
by David Canis, for property located a# 811 West Sunset Street, legally described as
Abstract 518, Tract 9R03E, A Heirs Foster Survey.
Sec#ion 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargernent of a nonconforming
use. The applicant requested a special exception allowing the construction of a �36-
square foot porch additian to a nonconforming structure as shawn on the site plan.
Mr. Triplett explained that Staff did not find a special condition exist for the requested
special exception. Specifically, the proposed encraachment would be the result of a self
� imposed hardship and would increase the leve! of nonconformance to the subject site.
He stated that the existing home was approximately twenty-eight (28) feet fram the front
property line, with an existing 4'x 8' front porch approximately twenty-four feet from the
front property line. The applicant was proposing to construct an 8'x17" front porch that
would replace the existing structure.
� With na questions for Mr. Triplett, David Canis, of 911 West Sunset Street, Grapevine,
Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested
favorable consideration af his request and offered ta answer any questions of the
Board.
Vice-Chairman Luers announced that nine (9) letter of approval had been received.
With no questic,ns for Mr. Canis, and no additional speakers, Debbie Holt made a
mo#ion to close the public hearing. Ken White seconded the motion which prevailed by
the following vote:
Ayes: Luers, Cook, Holt, White
Nays: None
Absent: Hecht, Adams, VanTil
Debbie Holt made a motion that a special condition existed for the requested special
exception. Specificaliy, this existing developed lot, and the existing structure was built in
1948 pre-dating the current city ordinance. Ken White seconded the motion which
prevailed by the foilowing vote:

Debbie Halt then made a motion to grant the fo{iowing speciai exception to Section
43.E.3., Nonconforming Uses and Structures, a!lowing a front yard setback of 2Q-feet
for the canstruction of a 136-square foot front poreh addition to a nonconforming
structure on the subject site. Ken White seconded the motion which prevailed by the
foilowing vote:

The r�ext item for the Board of Zoning Adjustment to consider was BZR10-13 submitted
by Jeff Avery representing property owner Ms. Laurie Verver for property located at 617
East Worth Street, platted as Lo# 5, Block 109, College Heights Addition. The following
request was from Grapevine Comprehensive Zoning Ordinance 82-73:
Section 15.F.2., "R-7.5" Single Famity Dis#ric#, Density Regulations, requires a
� minimum lot size of 7,504 square feet. The applicant requested a variance allowing a
lot size of 7,000 square feet for an existing lot.

Section 15,G.4., "R-7.5" Single Family District, Area Regulations requires a
minimum lat width af fi5 feet. The applicant requested a variance allowing a lot wid#h
� of 50-feet for an existing lot.
Mr. Triplett explained that Staff found a special condition existed for the requested
variances. Specifically, the Callege Heights Addition was originally platted in 1907,
predating the City's first zoning ordinance. Platted and dev�loped lots existed adjacent
to the subjec# site, eliminating the possibility ta expand the site.
With no questions for Mr. Triplett, Jeff Avery, of 3Qfi3 Parr Lane, Grapevine, Texas, took
the Oath of Truth; he gave a brief presentation to the Board and requested favarable
considera#ion af his request and offered to answer any questians of the Board.
Vice-Chairman Luers announced that one �1} letter of protest had been received.
With no further questions for Mr. Avery, and no additional speakers, Debbie Halt made
a motion to close the public hearing. Ken White seconded the motion which prevailed by
the following vote:

� Specifically, the College Heights Addition was originally platted in 9 9Q7, predating the
City's first zoning ordinance. Platt�d and developed lots existed adjacent to the subject
site, eliminating the possibility to expand the site. Ken White seconded the motion which
prevailed by the fo(lowing vote:

Debbie Nolt then made a motion to grant the foliowing variances to "R-7.5" Single
Family Dis#rict, Density Regulations; Sec#ion 15.F.2., allowing a lot size of 7,OQ0 square
feet for an existing lot: Section 15.G.4., Area Regulations, ailowing a lot width of 50-feet
for an existing lot. Ken White seconded the motian which prevailed by the following
vote:

� The next item for the Board of Zoning Adjustment to cansider was BZA10-14 submitted
by l.auie Murillo representing property owner Compass Christian Church for property
located at 4201 Pool Raad, propased to be platted as Lot 2R, Block 1, Jemtex Additian.
The following request was from Grapevine Camprehensive Zaning Ordinanee 82-73:

Section 60.F.1.a.1., Sign �tandards, Functianal/3tructural Types Permitted,
requires graund signs. The applican# requested a variance allowing for the placement
� of two (2) monumen# signs in lieu of ground signs.
Section 60.F.5.a. Sign Standards, Required Setback, requires a minimum setback
of�fteen-feet {15}. The applicant requested a variance allowing the construction of#wo
(2) monument signs with a setback of ten-feet (10') adjacent to Hall Johnson Road and
thirteen-feet {13'} adjacent ta Pool Road.
Mr. Triplett explained that Staff found a special condition existed for the requested
variances. Specifically, prior ta a recent zone change on the subject site from "CN"
Neighborhood Commercial District to "R-7.5" Single Family Distric#, the proposed s`rgns
met the type and setback requirements, and are entirely outside of all visibility
easements.
With no questions for Mr. Triplett, Ed Cox, of 2717 Thorn Lane, Grapevine, Texas, took
the Oath of Truth; he explained to the Board that at the August 17, 2010 public hearing,
City Council approved a zane change on the subject site from "CN" Neighbarhaod
Commercial District to "R-7.5" Single Family District. He stated that they felt it was in the
best interest of the city and community to rezane the property, but also understood that
it would require an appearance before the Board of Adjustment for a variance request.
They had also been granted Conditional Use and Special Use permi#s allowing the
expansion of the parking lot and to allow other non-profit groups to use the facility under
defined parameters. He expiained the various uses of the surrounding properties. He
� stated the structure was over 32,000 square feet and the nature of the property had
every appearance of a commercial faeili#y, he stated that moncament signage was in
keeping with the intended use of the facility. He requested favorable consideration of his
request and offered to answer any questions of the Board.
Vice-Chairman Luers announced that two letters of approval and one letter of protest
had been received.
With no #urther questions for Mr. Cox, and no additional speakers, Debbie Holt made a
motion to close #he pubiic hearing. Ken White seconded the motion which prevailed by
the following vote:
Ayes: Luers, Gook, Holt, White
Nays: None
Absent; Hecht, Adams, VanTil

during this meeting and would be considered at the next Board of Zoning Adjustment
meeting December 6, 2010.
