The request, BZA23-01, is for the following special exception to the Grapevine

Structures, which allows the Board of Zoning Adjustment to approve the remodeling
and/or enlargement of a nonconforming use. The applicant is requesting a special
exception to allow a residential dwelling to remain as developed with an existing front yard
encroachment adjacent to the south property line and an expansion and a rear yard
encroachment adjacent to the north property line.

SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA23-01

BACKGROUND INFORMATION:
The subject property is developed with a two-story, 1,674 square foot single-family
detached residence on a 9,291 square foot (0.21 acre) lot. The lot was developed in 1970
and is proposed to be platted as Block 1, Lot 3, Lakeshore Estates. The zoning district for
the subject property at the time of development was “R-1”, Single-family Dwelling District
and the property was rezoned to “R-7.5”, Single-Family District in the 1984 City-wide
rezoning.
The application was submitted by Patrick Monahon, property owner.
REQUEST:
The applicant intends to expand the existing single-family detached residence by 429
square feet on the west side of the of the existing building. BZA23-01 is a request for a
special exception to allow the residential dwelling to remain as developed with an
approximately 29.8-foot front yard to the south property line and an approximately 13.3-foot
rear yard to the north property line.
The subject site does not meet the front yard requirement for “R-7.5”, Single Family District
Regulations, Subsection 15.G.1, Front Yard Requirements of Section 15.G, Area
Regulations, of Section 15, “R-7.5”, Single Family District Regulations requires that every
lot have a front yard of 30-feet. The existing residential structure is approximately 29.8-feet
from the south property line and encroaches approximately 4-inches into the required front
yard setback.
The subject site does not meet the rear yard requirement for “R-7.5”, Single Family District
Regulations, Subsection 15.G.2, Rear Yard Requirements of Section 15.G, Area
Regulations, of Section 15, “R-7.5”, Single Family District Regulations requires that every
lot have a rear yard of 25-feet. The existing residential structure is approximately 13.3 feet
from the north property line and encroaches approximately 11.7-feet into the required rear
yard setback.

The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing residential structure to
remain as developed along with an expansion as shown on the plot plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically,
the subject lot is an existing developed lot and the dwelling was built in 1970 prior to the
rezoning of the property in the 1984 City-wide Rezoning to an “R-7.5”, Single-Family
District. Currently and as proposed, the site is not compliant with Zoning Ordinance (82-73)
relative to the required 30-foot front yard setback and relative to the required 25-foot rear
yard setback and adjacent to the south and north property lines respectively. The
proposed expansion of the dwelling does not exacerbate the rear yard setback adjacent to
the north property line of approximately 13.3-feet.
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve a special exception to the
Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses
and Structures to allow for the residential property to remain as developed with a 429-
square foot primary building addition as shown on the plot plan, subject to the following
conditions:
1. A final plat is approved by the City Council and filed with Tarrant County;
2. An access easement is provided to the yacht club to the north/northwest and shown
on the approved and filed final plat; and
3. No building permit is issued for a building expansion without the final plat being filed
with Tarrant County.
