5. Revise purpose statement to say: “The purpose of BZA23-05 is a request for a special
exception to allow the residential dwelling to remain as developed with an

BACKGROUND INFORMATION:
The subject property is developed as a one-story, 1,536 square foot single-family detached
residence on a 12,548 square foot (0.288 acre) lot. The lot was developed in 1960 and is
platted as Lot 73, Shorecrest Acres Subdivision. The zoning district for the subject property
at the time of development was “R-1”, Single-family Dwelling District and the property was
rezoned to “R-7.5”, Single-Family District in the 1984 City-wide Rezoning.
The application was submitted by Robert Feille, property owner.
REQUEST:
The applicant intends to expand the existing single-family detached residence by 225
square feet on the west side of the existing building, enclose the existing carport, and
propose 506 square feet of new paving to the existing driveway for parking. BZA23-05 is a
request for a special exception to allow the residential dwelling to remain as developed with
a 5-foot encroachment into the required rear yard setback and a building expansion along
the west elevation.
The subject site does not meet the rear yard requirement found in Subsection 15.G.2, Rear
Yard Requirements of Section 15.G, Area Regulations, of Section 15, “R-7.5”, Single
Family District Regulations requires of the Zoning Ordinance that every lot have a rear yard
of 25-feet. The existing residential structure is approximately 20.6-feet from the east
property line and encroaches approximately 4.4-feet into the required rear yard setback.
The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing residential structure to
remain as developed along with an expansion as shown on the plot plan.

SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically,
the subject lot is an existing developed lot and the dwelling was built in 1960 prior to the
rezoning of the property in the 1984 City-wide Rezoning to an “R-7.5”, Single-Family
District. Currently and as proposed, the site is not compliant with Zoning Ordinance (82-73)
relative to the required 25-foot rear yard setback adjacent to the east property line. The
proposed expansion of the dwelling does not exacerbate the rear yard setback adjacent to
the east property line of approximately 20.6-square feet, enclose the existing carport,
expand with a 225-square feet building addition along the west building elevation, and add
506 square feet of new paving to the existing driveway for parking.
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve a special exception to the
Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses
and Structures to allow for the residential property to remain as developed with a 225-
square foot primary building addition as shown on the plot plan.

Special circumstances: The existing home was built in 1960. The rear edge of the house currently sits
approximately 20’ from the rear property line. In 1984, Zoning Ordinance 43 E3 was established to create
a Building Line at 25’ from the rear property line, thereby creating a scenario where the existing home did
not comply with the new Zoning Ordinance. This BZA requests a variance from this section of the Zoning
Ordinance.
The reason for the request is to continue with obtaining a building permit and commence the construction
project. The request is justified due to the unique nature of the existing property. This particular property
is a unique circumstance because the house existing in this position before the Zoning Ordinance was
established. The Ordinance was established/amended after the home was constructed.
