This letter is to verify that your request for a conditional use permit located at 401 East State
Highway 114, platted as Trinity Industries Addition, Block A, Lot 3 for the possession, storage, retail
sale and on-premise consumption of alcoholic beverages (beer, wine, and mixed beverages) in
conjunction with a restaurant and to make modifications to the existing floor plan was approved by
the Site Plan Review Committee on May 4, 2023. A copy of the approved site plan is enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.

RECOMMENDATION
Staff recommends the Site Plan Review Committee (SPRC) consider the proposed
changes the previously approved site plan CU2008-19 (Ord. 2008-49) for the
possession, storage, retail sale and on-premise consumption of alcoholic beverages
(beer, wine, and mixed beverages) in conjunction with a restaurant. This request is
specifically to make modifications to the existing floor plan. The property is zoned “CC”,
Community Commercial and is owned by 401 Highway 114, LLC.
REQUEST
The applicant proposes to make modifications to the floor plan to the existing restaurant
by adding a sushi bar and two points of sale for alcohol. No additional revisions or
changes are proposed to the building elevations or site plan. Required parking for the
Oishii restaurant is 47 parking spaces and 47 parking spaces are provided.
BACKGROUND INFORMATION
The subject site was zoned “C-2”, Community Business District prior to the 1984 City-
wide Rezoning at which time the subject site was rezoned to “PCD”, Planned
Commerce Development District.
• On September 15, 1987, City Council approved Z87-17 (Ord. 1987-57) to rezone
4.5941 acres from “PCD”, Planned Commerce Development District to “CC”,
Community Commercial District.
• On March 18, 1997, City Council approved CU97-02 (Ord. 1997-25) to allow the
development of a Burger King restaurant with drive through and a 40-foot pole
sign along the frontage road of State Highway 114. This expired.
• On February 15, 2000, City Council approved CU99-76 (Ord. 2000-11) to allow
the development of a Burger King restaurant with drive through with a 40-foot
pole sign along the frontage road of State Highway 114 and 20-foot pole sign
along Capitol Street.
• On September 26, 2000, the Site Plan Review Committee (SPRC) approved
CU00-40 to relocate the 20-foot pole sign along Capitol Street approximately 50-
feet to the west.
• On September 16, 2008, City Council approved CU08-19 (Ord. 2008-49) to
eliminate the drive through window and allow possession, storage, retail sales

beverages) in conjunction with Lava Lounge restaurant.
• On May 6, 2009, the Site Plan Review Committee (SPRC) approved CU09-12 to
revise the floor plan and exterior elevations to the existing Lava Lounge
restaurant.
• On October 28, 2009, the Site Plan Review Committee (SPRC) approved CU09-
12 to revise the floor plan to the existing Lava 10 restaurant.
