The property contains Hall -Johnson Aso approximately 0.512 acre and has approximately 90 ��---- 41�° _ ' feet of frontage along North Lucas Drive and 248 I ' Glade Rd. I 1 - feet along Worthington Drive. o - REQUESTED ZONE CHANGE AND COMMENTS - The applicant is requesting to rezone 0.512 acre from "CC". Community Commercial District to "R-7.5". Single-Familv District with the intent to construct a new single-familv dwelling on Lot 1 B. The subject property consists of two lots, 1A and 1 B. Lot 1A has frontage on both Lucas Drive and Worthington Drive and is developed with a one-story, 1,958 square foot single- family detached residence constructed in 1955 on a 13,500 square foot (0.309 acre) property. Lot 1A also features an approximately 891 square foot detached garage and carport and a 96 square foot shed. Lot 1 B has frontage only along Worthington Drive, is approximately 8,820 square feet (0.203 acre) in size, and currently features an approximately 800-square-foot detached storage building. Lots 1A and 1 B have historically been treated as one parcel for property tax purposes as one owner has retained ownership of both lots. The property owner intends to develop a new residential dwelling on Lot 1 B. If approved, this will be the first reading of an ordinance for the rezoning request given the subject site requires approval of a special exception on Lot 1A to allow the existing residential dwelling and its accessory buildings to remain as developed, with a two -foot encroachment into the side yard setback for a detached garage, a two -foot encroachment into the required side yard setback for a shed, and to allow vehicle parking in the required front yard. Lot 1A requires approval to allow a 10-foot reduction in the minimum required lot depth requirement of the "R-7.5", Single -Family District. This item will be heard before the Board of Zoning Adjustment at their June 5, 2023 meeting. If approved by the Board, the second reading of the rezoning ordinance will take place at Council's June 20, 2023 meeting. PRESENT ZONING AND USE: The property is currently zoned "CC", Community Commercial District and is developed with a single-family residence, a detached garage and carport, detached storage structure, and shed between Lots 1A and 1 B. The requested zone change and associated Board of Zoning Adjustment requests depicted on the proposed plot plan will bring the subject site into compliance. HISTORY OF TRACT AND SURROUNDING AREA: The subject site was initially zoned "R-2", Two -Family Dwelling District and then rezoned on July 15, 1980 with zone change request Z1980-32 (Ord. 80-40) to C-2", Community Business District prior to the 1984 City-wide Rezoning. During the city-wide rezoning, the subject site was rezoned to "CC", Community Commercial District. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City of Grapevine Ordinance No. 82-73, being the Comprehensive Zoning Ordinance of the City of Grapevine, Texas same being also known as Appendix "D" of the City Code of Grapevine, Texas, be, and the same is hereby amended and changed by Zoning Application Z23-04 to rezone the following described property to -wit: being 0.512 acre tract proposed to be platted as Block 2, Lots 1A and 1 B, W.C. Lucas Addition, Tarrant County, Texas (226 North Lucas Drive), more fully and completely described in Exhibit "A", attached hereto and made a part hereof, which was previously zoned "CC", Community Commercial District is hereby changed to "R-7.5", Ordinance No. 2023-032 2 Z23-04 Single -Family District, all in accordance with Comprehensive Zoning Ordinance No. 82- 73, as amended. Section 2. The City Manager is hereby directed to correct the official zoning map of the City of Grapevine, Texas to reflect the herein change in zoning. Section 3. That in all other respects, the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinances and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future, to lessen congestion in the streets, to secure safety from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. This ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed two thousand dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
