The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, August 26, 2013 at 6:00 P.M. in the Planning and Zoning Conference Room,
2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the
following members present to wit:
Debbie Holt Chairman
Robert Rainwater Vice-Chairman
Ken White Secretary
George Dalton Member
Salvatore DeAngelo Alternate
constituting a quorum. Also present were City Council Representative Roy Stewart, and
the following City Staff:
Ron Stombaugh Planning and Development Manager

CALL TO ORDER
� Chairman Debbie Holt called the Briefing Session of the Board of Zoning Adjustment to
order at approximately 6:00 P.M.
ROLL CALL
Chairman Holt held roll call and announced that all were present.
NEW BUSINESS
Mr. Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to be
heard in the regular public hearing.
ADJOURNMENT
With no further discussion, Robert Rainwater made a motion to adjourn. George Dalton
seconded the motion which prevailed by the following vote:
Ayes: Holt, Rainwater, White, Dalton, DeAngelo
Nays: None
Absent: None

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, August 26, 2013 at 6:15 P.M., in the Council Chambers, 200
South Main Street, Grapevine, Texas with the following members present:

Chairman Debbie Holt called the Public Hearing Session of the Board of Zoning
� Adjustment to order at approximately 6:17 P.M.

Chairman Holt held roll call and announced that all were present.
PUBLIC HEARING
BOARD OF ZONING ADJUSTMENT CASE BZA13-08. TONY DIEROLF, 205 SOUTH
DOOLEY STREET
The first item for the Board of Zoning Adjustment to consider was BZA13-08 submitted
by Tony Dierolf, for property located at 205 South Dooley Street, legally described as
Lots 1 & 2, Block 100, College Heights Addition.
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use.
The applicant requested a special exception allowing the existing residential structure to
remain as developed along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
�, special exception. Specifically, the lots were part of the College Heights addition,
originally platted in 1909 predating the City's first zoning ordinance adopted in 1955.
Developed property and right-of-way existed to the east and west eliminating the
possibility of expanding the site to meet the depth requirement, and the proposed
expansion would not exacerbate the existing nonconforming condition.
� Mr. Triplett stated that the residential structure on the subject site was constructed in
1925 and the applicant intended to expand the existing residence into a two (2) story,
3,540 square foot dwelling including an attached garage.
He went on to explain that the applicant had applied for a Certificate of Appropriateness
for the subject site and was scheduled to be heard by the Historic Preservation
Commission on August 28, 2013.
With no questions for Mr. Triplett, property owner Tony Dierolf of 205 South Dooley
Street, Grapevine, Texas, took the Oath of Truth; and requested favorable consideration
of his request and offered to answer any questions of the Board.
Debbie Holt asked Mr. Dierolf if a portion of the detached garage going to be
demolished. He stated that was correct.
Chairman Holt announced that one letter of approval had been received.
With no further questions for Mr. Dierolf and no additional speakers, Robert Rainwater
made a motion to close the public hearing. Sal DeAngelo seconded the motion which
prevailed by the following vote:

Nays: None
Absent: None
Ken White made a motion that a special condition existed for the requested special

BRANCHWOOD DRIVE
� The next item for the Board of Zoning Adjustment to consider was BZA13-11 submitted
by Patricia Jefferson for property located at 2136 Branchwood Drive, legally described
as Lot 6, Block 1, Winding Creek Estates.
Section 42.C.3, Supplementary District Regulations, Accessory Buildings
requires accessory buildings in a residential district be located on the rear one-
half of the lot and at least 10-feet from any dwelling or building.
Mr. Triplett explained that during the review process Staff determined that the variance
requested for the subject site was not needed and therefore had been withdrawn.
Ken White made a motion to accept Staff's recommendation to withdraw the variance
requested. Robert Rainwater seconded the motion which prevailed by the following
vote:

BOARD OF ZONING ADJUSTMENT CASE BZA13-12, RICHARD PEMBERTON,
1725 SILVERSIDE DRIVE
� The next item for the Board of Zoning Adjustment to consider was BZA13-12 submitted
by Richard Pemberton representing property owner John Perrault for property located at
1725 Silverside Drive, legally described Lot 59, Shorecrest Acres.
Section 15.G.1, "R-7.5" Single Family District, Area Regulations requires a
minimum front yard setback of 30-feet. The applicant requested a variance of 10-feet
(10') allowing a front yard depth of 20-feet (20') for an existing lot.
Section 15,G.2, "R-7.5" Single Family District, Area Regulations requires a
minimum rear yard setback of 25-feet. The applicant requested a variance of three-
feet (3') allowing a rear yard setback of 22-feet (22') for an existing lot.
Section 15.G.5., "R-7.5" Single Family District, Area Regulations, requires a
minimum lot depth of 100-feet. The applicant requested a variance of fifteen-feet (15')
allowing a lot depth of 85-feet (85') for an existing lot.
Mr. Triplett explained that Staff found special conditions existed for the requested
variances. Specifically, the subdivision was platted in 1951, predating the City's first
zoning ordinance adopted in 1955. Developed property existed to the west that
eliminated the possibility of expanding the lot to meet the lot depth.
He explained that a required 30-foot front yard setback combined with the required 25-
� foot rear yard setback would leave 30-feet of buildable depth for a structure, limiting
what could be constructed on the property. The applicant intended to construct an
approximate 4,080 square foot single-story dwelling as shown on the plot plan

Mr. Triplett presented several examples to the Board of similar variances requested that
the Board had granted to accommodate reduced lot depth, as well as encroachments
� into the front and rear yard setbacks of properties in the immediate vicinity; he also
explained to the Board that a 15-foot drainage easement existed adjacent to the south
property line, the applicant and property owner were aware that they would be required
to relocate the storm drain pipe or reduce the proposed dwelling footprint outside of the
easement.
With no questions for Mr. Triplett, applicant Richard Pemberton, representing property
owner John Perrault, of 1701 Dunn Street, Grapevine, Texas, took the Oath of Truth; he
gave a brief presentation to the Board and requested favorable consideration of his
request and offered to answer any questions of the Board.
Chairman Holt announced that two (2) letters of opposition had been received.
With no questions for Mr. Pemberton and no additional speakers, Sal DeAngelo made a
motion to close the public hearing. George Dalton seconded the motion which prevailed
by the following vote:

existing lot; and a motion with regard to "R-7.5" Single Family District, Area Regulations:
Section 15.G.5., allowing a lot depth of 85-feet (85') for an existing lot. Robert Rainwater
seconded the motion which prevailed by the following vote:
