The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, May 5, 2014 at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd
Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the
following members present to wit:

constituting a quorum. Also present were City Council Representative Roy Stewart, and

CALL TO ORDER
Chairman Holt called the Briefing Session of the Board of Zoning Adjustment to order at
approximately 6:00 P.M.
ROLL CALL
Chairman Holt held roll call and announced that all were present.
NEW BUSINESS
Mr. Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to be
heard in the regular public hearing.

With no further discussion, Robert Rainwater made a motion to adjourn. George Dalton
seconded the motion which prevailed by the following vote:

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, May 5, 2014 at 6:15 P.M., in the Council Chambers, 200
South Main Street, Grapevine, Texas with the following members present:

� Chairman Debbie Holt called the Public Hearing Session of the Board of Zoning
Adjustment to order at approximately 6:19 P.M.

Chairman Holt held roll call and announced that all were present.
PUBLIC HEARING
BOARD OF ZONING ADJUSTMENT CASE BZA14-10, THOMAS O'MALLEY, 218
AUSTIN STREET
The first item for the Board of Zoning Adjustment to consider was BZA14-10 submitted
by Thomas O'Malley, for property located at 218 Austin Street, platted as N1/2 of Lots 7
& 8, Block 102, College Heights Addition.
Section 15.F.2, "R-7.5" Single Family District, Density Requirements, requires a
minimum lot size of 7,500 square feet. The applicant requested a variance of 500-
square feet, allowing a lot area of 7,000 square feet for an existing lot.
Section 15.G.1, "R-7.5" Single Family District, Area Regulations, requires a
minimum front yard setback of thirty (30') feet. The applicant requested a variance
�,,. of sixteen (16') feet, allowing a front yard setback of fourteen (14') feet for an existing
lot.
Section 15.G.4., "R-7.5" Single Family District, Area Regulations requires a
minimum lot width of 95-feet. The applicant requested a variance of twenty five (25')
� feet allowing a lot width of seventy (70') feet for an existing lot.
Section 42.D., Supplementary District, Corner Lots, requires the side yard setback
on a street to be the same as the required minimum front yard setback. The
applicant requested a variance of fifteen (15') feet allowing a side yard setback on a
street side of fifteen (15') feet for an existing lot.
Mr. Triplett explained that Staff found a special condition existed for the variances
requested. Specifically, original Lots 7 and 8, Block 102 of College Heights Addition
were originally platted in 1909, predating the City's first zoning ordinance adopted in
1955. The site was an existing developed lot, and the existing structure was built in
1958 prior to the rezoning of the subject site in the 1984 City Rezoning to "R-7.5" Single
Family District. An alley, right-of-way and developed platted property exist adjacent to
the subject site, eliminating the possibility to expand the site.
He went on to explain to the Board that existing dwellings south of the subject site were
setback at various depths ranging from approximately eight (8') feet to finrenty-two (22')
feet and front yard encroachments were not inconsistent with what currently existed
along this portion of Austin Street. He stated that the owner intended to construct a
1,216 square foot addition, as well as a 650 square foot detached garage that Historic
Preservation Commission had approved a Certificate of Appropriateness for on March
26, 2014.
� With no questions for Mr. Triplett, applicant Thomas O'Malley, of 231 Austin Street,
Grapevine, Texas, took the Oath of Truth; he gave a brief presentation to the Board and
requested favorable consideration of his request and offered to answer any questions of
the Board.
With no questions for Mr. O'Malley and no additional speakers, Robert Rainwater made
a motion to close the public hearing. Sal DeAngelo seconded the motion which
prevailed by the following vote:
Ayes: Holt, Rainwater, White, DeAngelo, Dalton, Morris
Nays: None
Absent: None
Ken White made a motion that a special condition existed for the requested variances.
Specifically, original Lots 7 and 8, Block 102 of College Heights Addition were originally

Ken White then made a motion to grant the following variances to "R-7.5" Single Family
� District, Density Requirements: Section 15.F.2., allowing a lot area of 7,000 square feet
for an existing lot; and a motion with regard to R-7.5" Single Family District, Area
Regulations: Section 15.G.1., allowing a front yard setback of fourteen (14') feet for an
existing lot. Section 15.G.4., allowing a lot width of seventy (70') feet for an existing lot;
and a motion with regard to Section 42.D. allowing a side yard setback of fifteen (15')
feet for an existing lot. Robert Rainwater seconded the motion which prevailed by the
following vote:

BOARD OF ZONING ADJUSTMENT CASE BZA14-11, AUDREA WEIMER, 710 EAST
WALL STREET
The next item for the Board of Zoning Adjustment to consider was BZA14-11 submitted
by Audrea Weimer, for property located at 710 East Wall Street, platted as Lot 10, Block
101, College Heights Addition.
Section 15.G.4., "R-7.5" Single Family District, Area Regulations requires a
minimum lot width of 95-feet. The applicant requested a variance of four-feet (4') feet
allowing a lot width of sixty-one (61') feet for an existing lot.
� Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and /or enlargement of a nonconforming
use. The applicant requested a special exception allowing the existing residential
structure and carport to remain as developed along with an expansion as shown on the
plot plan.
Mr. Triplett explained that Staff found a special condition existed for the variance and
special exception requested. Specifically, Lot 10, Block 101 of College Heights Addition
was originally platted in 1949, predating the City's first zoning ordinance adopted in
1955. Developed platted property existed adjacent to the subject site, eliminating the
possibility to expand the site to meet the width requirement.
He explained that the existing residential structure was constructed in 1930 and the
homeowner intended to construct an addition of approximately 230 square feet,
expanding the dwelling to approximately 1,264 square feet, and construct an
approximate 1,407 square foot detached garage and cabana on the subject property.
The proposed expansion, accessory structures and pavement shown on the plot plan
would not exceed maximum building coverage and maximum impervious area of 40%
or 3,681-square feet and 60% or 5,522-square feet respectively.
Mr. Triplett stated that the Historic Preservation Commission approved a Certificate of
� Appropriateness on December 18, 2013.

With no questions for Mr. Triplett, applicant Audrea Weimer, of 710 East Wall Street,
Grapevine, Texas, took the Oath of Truth; she gave a brief presentation to the Board
� and requested favorable consideration of her request and offered to answer any
questions of the Board.
Chairman Holt announced that one (1) letter of approval and one (1) letter of protest
had been received.
With no questions for Ms. Weimer and no additional speakers, Robert Rainwater made
a motion to close the public hearing. George Dalton seconded the motion which
prevailed by the following vote:

Discussion was held regarding clarification of special condition and variance requested.
Sal DeAngelo made a motion that a special condition existed for the variance and
special exception requested. Specifically, the existing platted lot was originally platted
in 1909, predating the city's first zoning ordinance adopted in 1955. Developed platted
property existed adjacent to the subject site, eliminating the possibility to expand the
site to meet the width requirement. George Dalton seconded the motion which prevailed
by the following vote:

Sal DeAngelo then made a motion to grant the following variance to "R-7.5" Single
Family District, Area Regulations: Section 15.G.4., allowing a lot width of sixty-one (61')
feet for an existing lot; and a motion to grant a special exception with regard to Section
43.E.3., Nonconforming Uses and Structures allowing the existing residential structure
and carport to remain as developed along with an expansion as shown on the plot plan.

Ken White made a motion to accept the minutes of the April 7, 2014, Briefing and Public
