Also present were City Council Representative Sharron Spencer and the following City Staff: Ron Stombaugh Development Services Assistant Director Albert Triplett Planner II Connie Cook Development Services Assistant �, CALL TO ORDER Chairman Holt called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:00 P.M. ROLL CALL Chairman Holt held roll call and announced that all were present except Member, Sal DeAngelo. NEW BUSINESS Mr. Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to be heard in the regular public hearing. ADJOURNMENT With no further discussion, Robert Rainwater made a motion to adjourn. ROLL CALL Chairman Holt held roll call and announced that all were present except Member, Sal DeAngelo. PUBLIC HEARING BOARD OF ZONING ADJUSTMENT CASE BZA14-14, KEITH AND ELIZABETH DUPLESSIE. 527 SOUTH DOOLEY STREET The first item for the Board of Zoning Adjustment to consider was BZA14-14 submitted by Keith and Elizabeth Duplessie, for property located at 527 South Dooley Street, platted as Lot 5R, Block 117, Clifton Jones Addition. Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and /or enlargement of a nonconforming use. The applicant requested a special exception allowing the existing residential structure to remain as developed along with an expansion as shown on the site plan. � Mr. Triplett explained that Staff found a special condition existed for the special exception requested. Specifically, the existing developed lot and the existing structure was built in 1940 which predated the City's first zoning ordinance adopted in 1955. Mr. Triplett went on to explain that the residential dwelling met all required setbacks. However, the existing detached garage encroached approximately three-feet (3') into � the required six-foot side yard setback adjacent to the north property line. In 2008 a Certificate of Appropriateness (CA08-04) had been approved to restore the 240-square foot detached garage. The proposed addition along the east elevation included expanding the kitchen and a second floor master bathroom. With no questions for Mr. Triplett, and no additional speakers, Ken White made a motion to close the public hearing. Specifically the subject site was an existing developed lot and the existing structure was built in 1940 which predated the City's first zoning ordinance adopted in 1955. Robert Rainwater seconded the motion which prevailed by the following vote: Ayes: Holt, Rainwater, White, Dalton, Morris Nays: None Absent: DeAngelo BOARD OF ZONING ADJUSTMENT CASE BZA14-15, DUSTY KIRCHER, 1137 VALLEY VISTA DRIVE The next item for the Board of Zoning Adjustment to consider was BZA14-15 submitted by Dusty Kircher, for property located at 1137 Valley Vista Drive, platted as Lot 15, Block 3, Bellaire Addition. Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and /or enlargement of a nonconforming use. The applicant requested a special exception allowing the existing residential structure to remain as developed along with an expansion as shown on the site plan Mr. Triplett explained that Staff found a special condition existed for the special exception requested. Robert Rainwater seconded the motion which prevailed by the following vote: Ayes: Holt, Rainwater, White, Dalton, Morris Nays: None � Absent: DeAngelo BOARD OF ZONING ADJUSTMENT CASE BZA14-16, ZACHARY MOTLEY, 4300, 4301 4469 �AA�70 VINEYARD CREEK DRIVE The next item for the Board of Zoning Adjustment to consider was BZA14-16 submitted by Zachary Matley representing property owner D.R. Harton Custom Homes for property located at 4300, 43Q1, 4469 & 4470 Vineyard Creek Drive, platted as Tracts 1 & 2 and Lots 21 & 28, Blocks 1 & 2, Vineyard Creek Estates. Section 6p.F.4 & 5 "Sign Standards" Maximum Height and required Se#back. The applicant requested a special exception to allow the placement of faur (4} subdivision signs and eight (8) architectural features. Mr. Triplett explained that Staff found a special condition existed for the requested special exception. Specifically, the ordinance was non-specific when considering architectural features and site specific design elements assaciated with s#ylized entryway signage. Specifically, the ordinanee did not address architectural elements with significant height or mass such as the columns prnposed. The reduced setback from fifteen feet (15') to four feet �4'} for the two lots adjacent to the Ha11 Johnson Road entry was necessary due to existing topography, a creek tributary and sloped easement. The reduced setback from fifteen feet (15') to zero within the two lots adjacent to Hughes Road was necessary due to loss of buildable area within the lots if placed at the �, fifteen foot (15'} setback. 3 6oaid ot zoning Aajustmem 8/4114 With no questions for Mr. Triplett, Zachary Motley, of 6751 North Freeway, Fort Worth, Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested � favorable consideration of his request and offered to answer any questions of the Board. Mr. Rainwater asked Mr. Motley the purpose of the encroachment adjacent to Hughes Road. Mr. Motley stated that the lots would not be buildable without the encroachment. Further discussion was held regarding the excessive height of columns, self-imposed hardships, setbacks adjacent to both street frontages, materials for columns and fencing as well as topography and site development. With no further questions for Mr. Motley, Robert Rainwater made a motion to close the public hearing. Ken White seconded the motion which prevailed by the following vote: Ayes: Holt, Rainwater, White, Dalton, Morris Nays: None Absent: DeAngelo Robert Rainwater made a motion that a special condition existed for the special exception requested with regards to Lots 1 and 2 adjacent to Hall Johnson Road. Specifically, the reduced setback from fifteen feet (15') to four feet (4') for the two (2) lots adjacent to the Hall Johnson Road was necessary due to existing topography, a creek tributary and slopped easement. George Dalton seconded the motion which � prevailed by the following vote: Ayes: Holt, Rainwater, White, Dalton, Morris Nays: None Absent: DeAngelo Robert Rainwater then made a motion to grant the following special exception to Section 60.F.5, "Sign Standards" Required Setbacks, allowing a setback of four feet (4') for the two (2) lots adjacent to the Hall Johnson Road as shown on the plot plan. George Dalton seconded the motion which prevailed by the following vote: Ayes: Holt, Rainwater, White, Dalton, Morris Nays: None Absent: DeAngelo Robert Rainwater then made a motion that a special condition did not exist for the special exception requested for Tracts 1 and 2 adjacent to Hughes Road, with regards to Section 60.F.5, "Sign Standards" Required Setbacks.
