(Tommy) Hardy Doug Eberhart Joy Welch Director of Public City Planner Building Official Engineer Secretary Chairman Spencer called the meting to order at 7:00 P.M. and explained the procedures and purpose of the meeting. Juser-amaraw) 2MI The first item for the Commission to consider and make a recommendation to the City Council was the final plat of the Wetzel Addition. Chairman Spencer advised those present that the plat had been reviewed at the Meeting of May 31, and at that time had been tabled to provide time for legal council concerning the subject tract. Referencing the discussion of the May 31 meeting, Mr. Baddaker advised that Mr. Boyle had informed that when the berms were originally installed to divert the natural flow of the drainage, this was a violation of the State Law, irregardless that the aforementioned Federal Agency (the Department of Agriculture) had funded the addition of berms. Mr. Baddaker displayed a revised plat reflecting a 15 foot drainage easement that, Mr. Wetzel had agreed to via telephone conversation earlier this date which would accommodate the drainage problem; therefore, the Public Works Director informed those present that he would recommend the plat be approved with the 15 foot drainage easement as now shown. The secretary distributed copies of a petition having 18 signatures of property owners in the area of the subject plat. The petitioners attested to the following statement: "We, the undersigned wish to confirm that prior to 1981, we never experienced excessive water runoff from the properties west of Blevins Street." At this point the Wetzels arrived at the meting. Mr. Wetzel advised that he did not agree with the City of Grapevine's legal council, and that he was pursuing his own legal council in regard to the subject tract; however, he had in fact, advised Mr. Baddaker to prepare a plat indicating the 15 foot easement, which he would dedicate hoping it would solve the sheet drainage problem. Such temporary construction buildings shall be removed immediately upon completion or abandonment of con- struction, and such field offices shall be removed immediately upon occupancy of 95% of the lots of the subdivision. 3. Guest quarters, cabana, pavilion or roofed area When any of the foregoing permitted accessory uses are detached from the principal single family dwelling, said uses shall be located not less than 45 feet from the front line, 20 feet from any street right-of-way and 6 feet from rear and side lot lines. Whenever a garage or carport is entered directly from an alley or rear (side) private driveway, a fence may be permitted within the front setback no closer than 25 feet to the street right-of-way. Said fence shall be of masonry or materials similar to those uti- lized on the principal single family structure and shall not exceed 6 feet in height. Off-street parking shall be provided in accordance with the provisions of this ordinance and other applicable ordinances of the City. No parking of recreational vehicles, motor homes or towed trailers shall be permitted within the required front setback area. Other vehicular parking is allowed in the front yard setback only when on an improved surface. The following shall be minimum requirements for any principal use structure: 1. The first item for consideration by the Planning and Zoning Commission for the purpose of making a recommendation to the City Council was Zoning Application Z83-18. In the earlier public hearing session Mr. Baddaker advised that the subject property was located approximately 120 feet east of Barberry Road and Hightinber Drive and further that the 1.4 acres presently zoned "R-20"Single Family would become "R-7.5" Single Family if the request is approved. The Master Plan recommended use is for low density residential. Mr. Baddaker then introduced Mr. W.J. Shepherd of Starnes and Associates Engineers, representing the applicants, who explained the purpose of the requested zone change. Questions from the P&Z members pertained principally to adequate access, number of lots and lot sizes. There were no questions from the Council. Arthur Pierce, a resident of Barberry Road, was present and expressed disapproval of the zoning change due to the size of the lots in the proposed development. Mr. Gil Traverse and Mr. Steve Henderson, property owners in Phase I of High Country Estates, expressed approval for the "R-7.5" Single -Family zoning. The City Secretary advised receipt of a petition with 12 signatures expressing approval of the zone change for High Country, Phase II. In the Commission portion of the meeting, Mr. Baddaker advised that the lots in High Country, Phase I, were about the sam size as those proposed for the Phase II Addition presently being considered if the zone change is granted. In response to questions from Commissioner Ron Cook, Mr. Fred Joyce advised that potential drainage problems would likely necessitate larger lots in portions of the subject Phase II development. Following further discussion, Harlen Joyce made a motion to approve the request, as submitted, and subsequent to Chairman Spencer's quote from the P&Z By -Laws, he withdrew the motion. Following further discussion, the motion was withdrawn and the public hearing was held. In the Commission's portion of the meting following a brief deliberation, Member Shane Wilbanks made a motion to table the zone change request, and Member Gerald Norman seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Hawkins, Norman and Wilbanks Nays: None Absent: Powers The next item for consideration by the Commission was Zoning Application Z83-21, submitted by Richard A. Reutlinger, for the purpose of making a recommendation to the City Council. The City Engineer advised those present that the applicant proposed to change .65 acres located at 303 Northwest Highway from "C-2" Convunity Business, to "SP" Site -Plan for the construction and operation of a veterinary hospital, all in accordance with a site plan, with animals being kept overnight within an enclosed structure during periods of treatment and not to be a kennel and that the Master Plan's recommended use is for low intensity office/commercial. Mr. Baddaker, then introduced the applicant, Dr. Rick Reutlinger, who explained the purpose of his request as being for a strip shopping center with one-fourth of the office space to be the veterinary clinic. There were none present for or against the request for zone change, and City Secretary Karen Spann reported that no correspondence was received relative to the subject request. Mr. Baddaker advised that the subject property's location is 303 West Northwest Highway. He further advised that prior drainage problems should be eliminated with the site plan submitted with the request for zone change for the animal hospital and that no street right-of-way being necessary in Northwest Highway.
