HomeMy WebLinkAbout1983-11-15A M1111 N Effiffiff- I N' M The Planning and Zoning Commission of the City of Grapevine, Texas, met in Regular Session, Tuesday, November 15, 1983, at approximately 11 P.M. in the Civic Center, 311 Main Street, following a joint public hearing with the City Council in the Council Chambers, 413 Main Street, which began at 7:30 P.M. The following members of the Planning and Zoning Commission were present, to wit: Sharron Spencer Chairman Pon Cook Vice Chairman Harlen Joyce Member To Powers Member Gerald Norman Member Shane Wilbanks Member Richard Atkins Member constituting a quorum, with no one absent, with the following City Staff to wit: J.R. Baddaker, P.E. Stephen C. Richardson Doug Eberhart Joy Welch Director of Public Works City Planner Engineer Secretary To be as expeditious as possible due to the late hour with the lengthy agenda and Chairman Spencer being detained in the Council Meeting momentarily, Vice Chairman Ron Cook called the meting to order, explaining its procedures and purposes. The first item of old business for the Commission to consider and make a recommendation to the City Council was Zoning Application Z83-39, submitted by David Albert and Associates; however, having been tabled during the public hearing no Con -mission action was needed. In the earlier public hearing, Mr. Baddaker advised that the subject request to change 1.15 acres of "R -l" Single -Family zoned property to "S -P" Site Plan for the placement of two billboards was in the vicinity of the St. Louis, S.W. Railway and Highway 121. Further, Mr. Baddaker introduced Mr. Scott Keeshin who advised that again, as at the October and September meetings, a problem remained with the FAA, and David Albert and Associates were again requesting that the request be tabled until the next regular public hearing of the Planning and Zoning Commission and City Council. Consequently, Commissioner Harlen Joyce made a motion to table the public hearing on the subject zoning request to December 20, 1983, and Commissioner Gerald Norman seconded the motion which prevailed by the following vote: Note: Chairman Spencer arrived at the meting and assumed the Chair. Using artist's depictions, the site plan and other pictures and literature, he described at length the proposed development which would consist of 305 lots utilizing the "0" Lot Line standards (only centering the 1300 to 2000 square foot homes on 5,000 square foot lots). There were many questions directed to Mr. Haynes relative to the 5,000 square foot lots since the minimum requirement in a single-family devel- opment is 7,500 square feet, and following a lengthy deliberation, the general consensus of Council and the Planning and Zoning Commission was disapproval of the lot sizes which were designed to accomodate "0" Lot Line homes in a high density area. Those present speaking in opposition to the zone change were Peggy Engholm, president of the Russwood Estates Home Owners Association, Lee Dodson, President of Laguna Vista Home Owners Association, Ed Dawson, President of Marina Del Rey, and Robert Shanks, a home owner in Laguna Vista. Mr. Bob Hunt of the Russwood Subdivision expressed approval and an unidentified guest questioned the City Engineer relative to water and sewer availability for the area. The City Secretary reported receiving a letter from J.J. Ammnss, Jr. expressing approval of Mr. Haynes' request, a letter from the Corp of Engineers expressing no opposition to the development and a letter from Carrie Browning expressing opposition. Later, in the Commission's portion of the meting, Commissioner Wilbanks expressed objection to the 5,000 square foot lot sizes, and Vice Chairman Cook concurred. Following a brief discussion, Chairman Spencer, requested a motion, and Shane Wil -banks so moved to recommend that the Council deny the request for zone change, and Vice Chairman Gook seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Powers, Wilbanks and Norman Nays: Atkins and Joyce ZONING APPLICATION Z83-48 - JONES AND BOYD The next item for consideration by the Commission in order to make a reccumendation to the City Council was Zoning Application Z83-48, submitted by Jones and Boyd. In the public hearing, Mr. Baddaker advised that the property, Lots 5-A and 5-B of the W.C. Lucas Addition was .645 acres zoned "SP", Specific Use. Further, he advised that the requested zoning was "SP" Site Plan for the storage, retail sale and off -premise consumption of alcoholic beverages (beer only) , incidental to the operation of a convenience store and gasoline service station, further providing for the construction and operation of a car wash facility; all in accordance with a site plan, and the Master Plan's reconviended use is Commercial. Mr. John Jones, representing the applicant, Jones and Boyd, reported that the major change to the existing business would be the addition of a drive -though car wash and the relocation of a gas pump, should the zone change be granted. Commissioner Wilbanks questioned the existing site of the drive entrance and it was noted that the dimensions of the car wash would be 41' X 17', the storage building would be 521 X 32' and the existing building was 401 X 401. Mrs. Frank Pilney expressed opposition to the request. Frank Graham, Mr. Ball's associate discussed further details of the proposed development. During a very lengthy discussion with Corrmission and Council questioning the applicant at length, the primary concerns expressed were for the 5,000 square foot lots proposed in the single-family development as well as the north -south arterial street. Guests speaking in opposition to the subject zoning application were Mr. Don Riecss, Mr. Frank Elmgren, Mrs. Joe Ann Putnam, Mr. Reynold Johnson and Mr. Berry Botterman, all of Tanglewood, Mr. Don Bigbie of #4 Windy Knoll and Mr. Machen Abernathy of 2804 Ridgewood Drive. Then, Mr. Don Harris of the Planning Department of DEW Airport expressed no objections to the proposed development. He also discussed the portion of the subject property located in the airport noise corridor. The City Secretary reported that one letter of opposition had been received from Mr. Larry Lightner and in a letter Mr. William H. Leder of DEW Airport expressed approval. A petition with 118 signatures representing opposing property owners was received as well. The letter of opposition from Mr. Lightner was read into the record as requested. In the Cannission portion of the meting Chairman Spencer advised that the Commission could approve a portion of the site plan and deny any portion as well. Mr. Baddaker and John Ball answered questions relative to the North-South Arterial. In the public hearing Mr. Baddaker advised that the subject property was located north of West Northwest Highway between Lucas Street and Scribner Street. The requested zoning was "R4T-2" Multi -Family District and "C -C" Community Commercial District, with the property currently zoned for a Planned Development of apartments, townhomes and retail/office space. The Master Plan's reconmended use was for Commercial and High Density Residential. Mr. Jackie Davis, applicant, then outlined the proposed development of the property, indicating multi -family zoning on the north half of the tract and Community Commercial on the scuthen portion. In response to many questions from ComTtission and Council, Mr. Davis indicated a desire to cooperate in meeting all requirements such as easement dedication for the, as yet, unplanned area in question. Mrs. Howard Holt of 322 Lucas and Mx. Aubrey Mauldin of 314 Lucas spoke in opposition to the rezoning. The City Secretary reported receipt of three letters of opposition to the development as well as a petition containing 10 signatures, also in opposition. The primary concern expressed by those opposing the rezoning was traffic congestion. Mr. Baddaker advised that the property located on the west side of Dove Loop Road, just north of the Marina Del Rey Apartments, presently zoned "PUD" concerns the same property involved in Z83-47 for "SP" zoning for "0" Lot Line homes., submitted by Mr. Ron Haynes, which was previously denied by the Commission and tabled by the City Council pending the outcome of the zoning request this evening. Mr. Baddaker further advised that City requirements had been met with only a flowage easement of the Corp of Engineers to be worked out for the final plat. Staff would then, recommend approval if the zoning change is granted by the City Council. There being little discussion or deliberation, Chairman Spencer called for a motion, and Commissioner Powers so moved to table the plat until the regular meeting of December 20, 1983, and Shane Wilbanks seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Powers, Norman, Wilbanks & Atkins Nays: None The next item was for the Commission to consider the minutes of the meeting of October 18, 1983.
