A1011 The Planning and Zoning Commission of the City of Grapevine, Texas, met in Regular Session, Tuesday, December 20, 1983, at 9 PM, in the Civic Center, 311 Main Street, following a joint public hearing with the City Council in the Council Chambers, 413 Main Street, which began at 7:30 PM. The following members of the Planning and Zoning Commission were present, to wit: Sharron Spencer Ron Cook Tom Powers Gerald Norman Shane Wilbanks Richard Atkins Chairman Vice Chairman Member Member Member Member constituting a quorum, with Member Harlen Joyce absent, with the following City Staff, to wit: J.R. Stephen Richardson Doug Eberhart Joy Welch Director of Public Works City Planner Engineer Secretary Chairman Spencer called the meeting to order in the Civic Center at ap- proximately 9 PM, and explained the procedures and purposes of the meeting. OLD BUSINESS ZONING APPLICATION Z83-48 - JONES & BOYD The first item for the Con -mission to consider and make a recommendation to the City Council was Zoning Application Z83-48, submitted by Jones and Boyd. The zone change request for 0.645 acres of property, Lots 5-A and 5-B of the W.C. Lucas Addition, currently zoned "SP" Specific Use, was for "SP" Site Plan for the storage, retail sale and off -premise consumption of alcoholic beverages (beer only), incidental to the operation of a convenience store and gasoline service station, further providing for the construction and operation of a car wash facility; all in accordance with a site plan. Having been tabled from the November 15 meting by the Planning and Zoning Commission when at that time a revised site plan was suggested to move the driveway entrances and indicate the alcoholic beverage storage area on the site plan, the Commission now expressed concern relative to the height of the sign proposed to be used. Chairman Spencer questioned Mr. Beachey, employed by the developer, who advised that a 25 foot high Gulf Sign would be used as well as an entry and an exit signs.) Further, it was determined that the sign ordinance would govern height. Then Vice Chairman Cook made a motion to recommend that the City Council approve the zone change request providing that entry and exit signs be shown and curbing requirements be mt. In the public hearing Mr. Baddaker advised that the applicant was requesting "R -1,,T-2" Multi -Family zoning for the 19.997 acres located approximately 1,200 feet south of Hall -Johnson and west of Highway 121. Further, he advised that the present zoning is "R-1" Single -Family, however, the recommended use by the Master Plan is high density residen- tial. There was little discussion, and Karen Spann reported receipt of no letters or petitions. No one was present to speak relative to the subject zoning case. In the Can-nission portion of the meting, the majority of the members indicated preferring a site plan for the subject property before making a decision for rezoning. The primary concern was street layout. Chairman Spencer then called for a motion, and Vice Chairman Cook so moved to table Zoning Application Z83-53 to enable time for street layouts to be worked out, and Shane Wilbanks seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Wilbanks and Atkins Nays: Norman and Powers Absent: Joyce The next item for the Commission to consider and make a recommendation to the City Council was Zoning Application Z83-54, submitted by Mr. Ray Ellis. In the public hearing Mr. Baddaker advised that the subject property, located northeast of "MR M's" on Highway 26, was 4.877 acres, presently zoned "L -I" Limited Industrial, and has a proposed zoning of "C -OU" Commercial -outdoor and the Master Plan recommends Commercial usage. Then Mr. Baddaker introduced Mr. Ray Ellis, applicant for the zoning case who described the type of car wash facility planned. Mr. Baddaker was questioned relative to drainage and traffic problems and advised that a frontage road might be able to handle the ingress -egress and eliminate so many curb cuts. (Mr. Ellis had advised that two thirty foot drives would be separated by a 60 foot medium and the drainage problem could be handled by a private evaporative system which had been approved by the health department). There were no guests present to speak, and no correspondence was received opposing the subject request; however, Ms. Spann reported that a letter from DFW Airport requesting an avigation release had been received should the zoning change be granted. In the Coomission portion of the meting, the City Planner responded to questions from the Commission relative to a zone change not being required to build a carwash. It should be shown on the moratorium map as "LI", but it is not; therefore, technically, a zone change is not required, Mr. Richardson advised. In response to questions from Chair- man Spencer relative to the thoroughfare going through the airport area, Mr. Eberhart advised that the slow response from the airport was possibly due to the planned parking lot in the area of a runway extension. There were some questions and deliberation relative to overall density of the area and the proposed location of the apartments. Ms. Spann reported that no correspondence was received relative to the subject case, and the only person speaking relative to the case was Mr. Bruce Crouse who requested that the case be tabled for further review, that he was not really in opposition to the case, but would like to be able to view a more detailed site plan. There was some discussion relative to "0" Lot Line homes offering more privacy due to placement of windows. In the Commission portion of the meting, Mr. Wilbanks reviewed reasons to deny the zoning change. Then Mr. Dewey was called upon to describe the use planned for the area. Chairman Spencer invited home owners in the area to speak, and an unidentified homeowner questioned the density as well as a market for the "0" Lot Line homes planned. Shane Wilbanks made a motion to deny the request, and Vice Chairman Cook seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook and Wilbanks Nays: Powers, Norman and Atkins Absent: Joyce Chairman Spencer advised that the City Attorney has ruled that a tie vote constitutes denial. The next item for the Commission to consider and make a recommendation to the City Council was the final plat of the Harwell Addition,Phase II. This plat, located on the north side of Dove Road directly north of Parra Linda Estates is served adequately by City utilities, and five feet of additional right-of-way has been provided for Dove Road. Further, the plat conforms with all zoning and subdivision ordinance requirements, Mr. Eberhart advised. The only change would be changing the proposed Shelly lane to Longhorn Trail to maintain continuity on both sides of Dove Road. There was a brief discussion relative to reasons for changing the street name. The Con -mission members were advised that this plat was tabled at an earlier meting to enable the developer to relocate the alley entrances on Old Mill Run and Ridgeview Drive, and since they have been relocated three lots east of Pool Road as requested by the Ccumission. P&Z Minutes 12-20-83 Page 6 There was a brief discussion relative to garage entrances, and Mr. Grantland advised that there would need to be swing garages. There was further lengthy discussion prior to a motion made by Tom Powers and to approve the plat subject to alley extensions, and Richard Atkins seconded the motion. Then Richard Atkins made a motion to table the plat until the meting of January subject to alley extensions; however, following further discussion, it was determined that the first motion had not been withdrawn and when it was determined that Mr. Powers motion still stood, Mr. Atkins withdrew his motion to table the plat and stated that his second to Mr. Powers motion should stand. The vote to recommend that the Council approve the plat was as follows: Ayes: Cook, Powers, Norman, Wilbanks and Atkins Nays: Spencer Absent: Joyce The next item for consideration by the Commission in order to make a recommendation to the City Council was the replat of the Oak Knoll Subdivision. Those present were advised that the replat located at Northwest Highway and State Highway 114 was approved by the City Council and Planning and Zoning Commission in February of 1980; however, the plat was never recorded at the courthouse; therefore, due to a 60 day requirement for filing at the courthouse after approval, subsequent to re -review, Staff recommends approval. Commissioners questioned Mr. Roy Stewart, then following a brief discussion relative to location of the plat, Gerald Norman made a motion to recommend that the City Council approve the plat as submitted, and Shane Wilbanks seconded the motion, which prevailed by the following vote: Ayes: Spencer, Cook, Powers, Norman, Wilbanks & Atkins Nays: None Absent: Joyce Mr. Baddaker questioned Commissioners relative to having a special meeting Monday, December 26, however, the general consensus of those present was negative; therefore, no meeting was scheduled.
